1. Financial & Payment Terms Rent Due Date & Late Fees: First month, last month and security deposit required. Rent is $3,800.00 per month, due strictly on the 1st of each month via Baselane ACH. A late fee of $100.00 applies if rent is not received by the 5th of the month at 11:59 PM. Interest-Bearing Security Deposit Compliance: The tenant's security deposit will be held in a separate, interest-bearing escrow account at Thread Bank, Member FDIC, via the Baselane financial platform. In strict accordance with Florida Statute 83.49, the tenant will be entitled to receive interest payments earned on the deposit (a minimum of 75% of the annualized average interest rate actually earned by the account), paid out annually and/or upon move-out. Statutory Escrow Notice: The Landlord will provide the tenant with the formal, written statutory disclosure notice detailing this bank account within 30 days of receiving the deposit, as required by Florida law. Returned Payment Fee: A $50.00 fee applies for any electronic payments or ACH transfers that are declined, reversed, or returned for insufficient funds. Tenant Responsibility for Utilities: The tenant is strictly responsible for setting up, maintaining active accounts for, and paying 100% of all utility services connected to the property. This includes, but is not limited to, electricity, water, sewer, internet, and cable. 2. "As-Is" Secondary Amenities & Appliance Exclusions Primary Systems Covered: The Landlord maintains full structural and mechanical responsibility for the home's main central HVAC system and the primary kitchen refrigerator. Office Supplemental AC Unit Exclusion: The separate supplemental AC unit located in the office is provided strictly in "as-is" condition as an extra convenience amenity. The main central HVAC system covers the entire house; usage of the office AC is optional. If the supplemental office AC unit breaks, malfunctions, or becomes non-functional, the Landlord is not responsible for its repair, service, or replacement. Garage Refrigerator Exclusion: The secondary refrigerator located in the garage is provided strictly in "as-is" condition as an extra convenience amenity. If the garage refrigerator breaks, leaks, or stops cooling, the Landlord is not responsible for its repair, maintenance, or replacement. The tenant may use it at their own discretion. 3. Maintenance, Repairs, & Property Care Tenant Deductible for Minor Repairs: The tenant is financially responsible for paying the first $100.00 of the cost for any single repair, service call, or maintenance item performed on the premises (e.g., minor plumbing clogs, running toilets, garbage disposal jams, minor hardware fixes). The Landlord will cover costs exceeding $100.00, provided the damage was not caused by tenant misuse or negligence. The tenant must pay this directly to the service provider or reimburse the Landlord within 10 days of the invoice. The tenant must obtain Landlord's written approval before scheduling any third-party service calls or repairs. Strict Non-Smoking Policy: Smoking, vaping, or burning of any kind including but not limited to cigarettes, cigars, pipes, e-cigarettes, vaporizers, and marijuana is strictly prohibited anywhere inside the interior walls of the property. This policy applies to the tenant, household members, and all guests. A violation of this clause constitutes a severe material breach of the lease, grounds for immediate eviction, and renders the tenant entirely liable for all costs associated with smoke remediation, odor removal, air duct cleaning, and wall repainting. Smart Home System Care: The property features an upgraded smart lighting system and a smart oven/microwave combination. The tenant agrees not to modify, reset, bypass, or replace any smart hardware, switches, or pre-configured smart home hub devices without express written consent from the Landlord. Any systematic or technical resets requiring professional IT re-configuration due to tenant tampering will be billed entirely to the tenant. Strict AC Filter & Pest Control Clauses: The tenant is required to replace the central HVAC air filters every 30 days. The tenant is responsible for basic indoor pest control (ants, bugs) after the first 30 days of occupancy. No Alterations: The tenant may not paint walls, change exterior locks, or make cosmetic or structural alterations to the property without prior written approval from the Landlord. 4. HOA, Community, & Screening Rules Mandatory Window Screen Maintenance: Per Florida habitability statutes, the Landlord provides clean, intact window screens. The tenant is legally responsible for maintaining all exterior window screens in good, clean condition throughout the lease. Any damage to screens during tenancy will be repaired strictly at the tenant's expense. HOA Bylaws & Compliance: The tenant must strictly follow all rules, regulations, and parking restrictions set by the Homeowners Association (HOA). A copy of the HOA bylaws is attached to this lease. The tenant is strictly liable for paying any fines or penalties issued by the HOA due to their violations. HOA Pre-Approval Contingency: This lease is strictly contingent upon written pre-approval from the HOA board. The tenant agrees to submit all required paperwork, background screenings, and HOA screening fees within 5 days of lease signing. If the HOA rejects the applicant, this lease is automatically void with zero liability to the Landlord. 5. Liability, Insurance, & Asset Protection Mandatory Renters Insurance: The tenant must maintain a personal renters insurance policy with a minimum of $100,000.00 in personal liability coverage throughout the entire lease. The Landlord must be named on the policy as an "Additional Interest" or "Interested Party" so the Landlord is immediately notified by the insurer if the policy lapses or is canceled. Proof of insurance must be provided before keys are handed over. Landlord Right of Entry: The Landlord retains the right to enter the premises for routine maintenance, repairs, or inspections upon giving a minimum of 24 hours' written notice to the tenant, in accordance with Florida law. Emergency entry requires no notice. Hold Harmless & Guest Policies: The Landlord is not liable for any damage, theft, or loss of the tenant's or their guests' personal property. Guests staying longer than 14 consecutive days or 28 days total in a calendar year require written approval from the Landlord and must undergo background screening if requested. Strict Pet Addendum: Standard pets are limited to those explicitly approved in writing and must align perfectly with HOA restrictions. A non-refundable pet fee of $200.00 per pet is required. No unapproved animals are allowed on the property at any time. 6. Florida Mandatory Radon Gas Disclosure Verbatim Disclosure: The lease explicitly includes the required text under Florida Statute 404.056(5): "RADON GAS: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county health department."
