Rent Inclusions, Utilities, and Community Rules Included Utilities: Monthly rent includes high-speed Verizon 5G Wi-Fi, water, electricity, parking, garbage/recycle fees, and HOA fees. Utility Usage Cap: Water and electricity are included provided usage remains within a normal, reasonable baseline. Excessive consumption may result in additional charges. HOA Compliance: The tenant must strictly adhere to all HOA rules and regulations. Any fines or penalties issued by the HOA due to tenant violations will be billed directly to the tenant. Smoking Policy: This is a strictly non-smoking property. Smoking is prohibited anywhere inside the home. Tenants must smoke exclusively on the deck or outdoors. Property Rules & Restrictions: No weapons should be carried on the premises. No illegal substances are allowed on the premises. The room and the premises must be kept clean at all times. Tenants shall not use or access the neighbor's property, and all trash must be disposed of in the designated 633 trash cans, not in the neighbor's bins. Tenants shall not keep any dangerous, flammable, or explosive items on the property that could unreasonably increase the risk of fire or explosion. Security Deposit Terms Refund Policy: The Security Deposit is to be refunded upon leaving the residency, terminating this contract, and returning all keys to the Landlord. Damage & Cleaning Deductions: The Security Deposit covers any damage to the premise. If the room is not kept clean upon checking out, a partial or full deduction can be taken from the deposit to cover deep cleaning expenses. Tenant Liability: If any damage is done to the property or items in the room, the security deposit will be used by the landlord to cover the expenses. If the deposit is insufficient to cover the total damages, the tenant is liable to pay additional money to cover the expense or replace the item with the exact quality/brand. Default Coverages: The Security Deposit also covers cases where the Tenant fails to pay rent or fails to check out on the specified date. Premises Maintenance, Alterations, and Entry Condition of Premises: The tenant shall keep the premises in good condition and follow reasonable standards of cleanliness. The tenant is responsible for any damage caused and must cover all expenses to fix it, or the landlord may collect the required amount to cover those damages. Alterations: Written permission from the landlord is strictly required for any alterations to the premises. Landlord Entry: The Landlord may enter the premises for the purposes of inspection, repair, maintenance, and emergencies. Abandonment: If the tenant abandons the house, the Landlord has the right to enter the room by any means without liability. The Landlord is allowed to presume the tenant abandoned the premise if furniture and other items are removed. Additionally, if the house is unoccupied for a period of 15 consecutive days without written notification to the Landlord, it will be considered abandonment. Legal Liabilities, Parking, and Privacy Unavoidable Property Damage: It will be no fault of the Landlord if the premises are totally or partially damaged or destroyed by fire, earthquake, flood, storm, accident, civil commotion, or other unavoidable causes. It is highly recommended that the Tenant carry their own Renter's Insurance. Vehicle Restrictions: Parking is to be used only for properly licensed and operable motor vehicles. No trailers, boats, campers, recreational vehicles, buses, trucks, or unregistered vehicles are permitted. Indemnification: The Landlord and his family shall not be liable for any damage, injury, or death of or to the Tenant, Tenant's family, guests, invitees, or any other person entering the premises. The Tenant agrees to indemnify, defend, and hold the Landlord harmless from any and all claims of every kind and nature relating to the same. Data Privacy: Any proof of identity provided by the tenant will be securely kept and will not be shared or misused by the landlord. Lease Termination and Move-Out Obligations Early Termination grounds: The Landlord may immediately terminate the tenancy during the initial term or any extension on the grounds of serious or repeated violations of this agreement, criminal activity, non-payment or repeated late payment of rent, or other good cause. Vacating Obligations: Upon termination, the Tenant must surrender the premises in as good a state and condition as they were at the commencement of the agreement, reasonable wear and tear excluded. Specifically, the tenant shall: Give the Landlord all copies of keys or opening devices to the Premises, including mailboxes and common areas. Vacate and surrender the premises empty of all persons and personal property. Clean and deliver the premises to the landlord in the same condition as they were received. Vacate any and all parking and storage spaces. Attorney Fees and Court Costs: In the event of legal action to enforce compliance or collect due rent, the losing party agrees to pay the prevailing party's reasonable attorney fees incurred throughout the proceeding, including trial, appeal, and post-judgment collection.
