Lease terms

Lease Terms (Please contact if any questions or negotiable adjustments) Lease Duration: The lease term shall be for a minimum period of one (1) year. Upon completion of the initial lease term, the agreement may convert to a month-to-month tenancy unless either party provides a sixty (60) day written notice of termination. Rent & Payment Terms: Monthly rent shall be $2,100. Rent is due on the 21st day of each month. Rent shall be considered late if not received by the 26th day of the month. A late fee of $100 will be assessed if rent is not received by this date. Prorated Rent: If the lease term begins on a date other than the first day of the month, rent shall be prorated based on the number of days of occupancy. Security Deposit (Florida Statute Compliance): A refundable security deposit of $1,500 is required at the time of lease signing. The security deposit will be held in a non-interest-bearing account in accordance with Florida law. Upon termination of the tenancy, the landlord shall return the security deposit within fifteen (15) days if no claim is made. If the landlord intends to impose a claim on the deposit, written notice will be provided to the tenant within thirty (30) days in accordance with Florida law. Move-In & Move-Out Inspections: A walkthrough inspection will be conducted at the beginning of the lease term to document the condition of the property. The property is expected to be clean, organized, and free of damage at move-in. A final walkthrough will be conducted prior to move-out, and the property must be returned in the same condition, excluding normal wear and tear. Cleaning Fee: A cleaning fee ranging from $100 to $350 will be charged at the end of the lease term, depending on the condition of the property at move-out. Utilities: The tenant is responsible for payment of all utilities, including but not limited to water, electricity, gas (if applicable), garbage, and any additional services such as internet (Wi-Fi), cable, and pest control. For reference only, the average monthly utility costs for a household of two (2) adults are estimated as follows: - Water: approximately $30/month - Electricity: approximately $150 $170/month - Garbage: approximately $55/month These amounts are estimates only and may vary based on usage, season, and provider. The landlord does not guarantee actual utility costs. Lawn Care: Routine lawn maintenance is required to be maintained by the tenant. The tenant agrees to maintain the yard in a reasonable condition, including proper disposal of pet waste. Smoking Policy: Smoking is strictly prohibited inside the property. Pets: A maximum of three (3) pets are allowed with prior landlord approval. A non-refundable pet deposit of $250 will be charged, regardless of whether one or two pets are kept on the premises. The tenant is fully responsible for any damage caused by pets. Condition of Property: The tenant agrees to maintain the property in a clean and orderly condition throughout the lease term and to return the property in the same condition as received, excluding normal wear and tear. Tenant Maintenance Responsibilities: The tenant agrees to keep the property and appliances clean and in good condition. Minor upkeep, such as replacing light bulbs, smoke detector batteries, and clearing tenant-caused clogs, is the tenant's responsibility. The tenant must promptly report damage or needed repairs. The tenant shall not remove safety devices, make major repairs without approval, or cause damage through negligence. The landlord is responsible for structural, plumbing, electrical, HVAC, and major appliance repairs, except when damage is caused by the tenant. Landlord Right of Entry: In accordance with Florida law a twelve (12) hour notice is required. We agree the landlord may enter the property with at least forty- eight (48) hours' notice for repairs, inspections, or showings, and at reasonable times. No notice is required in the event of an emergency. Default / Failure to Pay Rent: Failure to pay rent or comply with the terms of this lease constitutes a default and may result in termination of tenancy and eviction proceedings in accordance with Florida law. Notice Address: All legal notices from the tenant to the landlord shall be delivered to an address provided by the landlord at the time the lease is signed. Attorney's Fees: In any legal action arising under this lease, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs. Military Clause: Tenants who are active-duty service members may terminate this lease in accordance with the Servicemembers Civil Relief Act. Fire Safety: The property is equipped with smoke detectors. The tenant agrees to maintain all safety devices in proper working condition and not to disable or remove them. Radon Gas Disclosure (Required by Florida Law): Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county public health department.
