1. Lease Term Fixed 12 month lease, renewing only upon mutual written agreement and satisfactory inspection. (Clear, concise, legally compliant. No issues.) 2. Rent & Fees Rent Due & Late Fees Rent is due on the 1st of each month. Late after the 5th. Late Fee: $85 flat + $20/day until paid (must be reasonable under Florida law). Pet Policy Negotiable No pets allowed unless approved in writing. Pet fee + Pet Addendum required. 7. Smoke Free Property Policy 100% smoke free (entire interior and all exterior areas near windows/doors). Smoking includes tobacco, marijuana, hookah, and e cigarettes/vape products. Violations are material non compliance and may result in eviction + remediation charges. 8. Tenant Responsibilities Tenant must: Replace HVAC filters monthly. Replace light bulbs & smoke/CO batteries as needed. Only flush toilet paper; no oils/grease/chemicals/wipes. Maintain the yard (mowing, debris removal). Report maintenance issues immediately. Make no alterations without written approval. Maintain all appliances and fixtures. Never disable detectors or block exits. Damage & Repair Charges Tenant is responsible for damages caused by misuse, negligence, or failure to report issues. Landlord may charge actual cost of repair + labor. 9. Owner Responsibilities Maintain major systems (roof, HVAC, plumbing, water heater). Provide proper notice before entry (Florida custom: 12 hour notice for non emergency entry). Conduct quarterly inspections. 10. Occupancy & Use Maximum occupancy: 1-2 persons (subject to code). Residential use only. No subletting, room renting, or Airbnb/short term rentals. 11. Required Florida Disclosures (2025 2026 Updates) A. Flood Disclosure (SB 948 / 83.512) Landlord must disclose: Known prior flood damage, Any insurance claims, Any government assistance received. Failure to provide this disclosure may allow tenant termination after a flood related loss. B. Email Notice Addendum (HB 615 2025) Email notice is permitted only if: Both parties sign an Email Notice Addendum, Tenant provides designated email address, Delivery is provable and not returned undeliverable. C. Eviction Notice Update (SB 716 July 2026) Nonpayment notice increases from 3 days 5 days (excluding weekends & legal holidays). 12. Insurance Renter's insurance required with liability coverage. Landlord listed as interested party. 13. Move In Condition Property professionally cleaned before move in. Tenant must return property in same clean condition (normal wear excluded). Move in checklist + photos/video completed at key handoff. 14. Move Out Procedure & Security Deposit Return Notice to Vacate Tenant must give 30 day written notice before move out. Inspection Final inspection conducted; tenant may attend. Florida's Mandatory Deposit Timelines 15 days Return full deposit if no deductions. 30 days If Landlord wants to deduct anything, must send written claim notice within 30 days or forfeits all rights to deduct. Tenant has 15 days to dispute the claim. 15. Compliance The property complies with federal, state, and local Fair Housing laws. Screening is uniform: credit, income, background, rental history. 16. Early Termination & Abandonment 16.1 Early Termination (Voluntary "Buy Out" Option) (a) Notice: Tenant must provide 30 day written notice. (b) Early Termination Fee (ETF): Tenant pays 2 months' rent as agreed liquidated damages. (c) Rent Liability Until Re Rented: Tenant responsible for rent until: Lease ends, OR New tenant begins paying rent. Landlord must make reasonable efforts to re rent (mitigation). (d) No Over Collection: Landlord cannot collect more than actual provable damages or total rent owed. (e) Condition: Tenant must return the property clean and undamaged beyond normal wear. 16.2 Abandonment Abandonment occurs if tenant: Vacates without notice and unpaid rent exists, or Removes personal property and disconnects utilities. Landlord may re enter, re rent, and claim damages. 16.3 Security Deposit Handling (Early Termination or Abandonment) (a) 15 Day Return: If no claim, deposit must be returned within 15 days. (b) 30 Day Claim: If claiming deductions, Landlord must send written notice within 30 days or forfeits right to deduct. (c) Tenant has 15 days to dispute deductions. 16.4 Updated Nonpayment Notice Rule If Tenant owes rent before vacating, the statutory notice is: 5 days (starting July 2026), excluding weekends and legal holidays. Email notice addendum may allow electronic service where permitted.
