TERM OF LEASE: 12 months HOLDOVER: If Tenant does not contact Owner and Owner does not contact Tenant at the end of the lease, and Tenant remains in the residence, Tenant's rental agreement becomes a month-to-month rent. Tenant must follow the original lease agreement. RENT: Rent shall be $1,450 per month, payable in advance upon the 5th day of each month. You may pay rent electronically via Venmo or in person by delivering to the Owner's residence provided at time of rental. Rent paid after the twelfth (12th) day of the month shall be deemed delinquent. If rent is not paid by the 12th day of the month, Tenant shall pay a late charge of $50.00 beginning on the 11th day of the month. There will be a twenty-five ($25.00) charge on all returned checks. SECURITY DEPOSITS: As a condition of this lease, Tenant must comply with the provisions of the Security Deposits Agreement which is attached hereto and incorporated by reference. The security deposit may not be used by the resident(s)for the payment of rent. PETS: Pets are allowed be brought onto the property per prior discussion between Owner and tenant. The deposit of $1,000 accounts for one pet. The Tenant must seek approval by the Owner to allow additional pets. If approved, Tenant will be subjected to pay a $200 deposit per additional pet and will be subject to the penalties, damages, deductions, and provisions set forth in the Security Deposit Agreement. OWNER'S PROPERTY: Tenant shall be responsible for any loss, property damage and/or cost of repairs or service including plumbing and maintenance caused by negligence or improper use by Tenant's family or guest. SUBLETTING: Tenant may not sublet, assign or secure a replacement unless Owner gives written permission thereon. ENTRY AND INSPECTION: Tenant shall permit Owner or Owner's representatives to enter upon the property at reasonable times and upon reasonable notice for the purposes of inspecting the property, making necessary repairs, showing the property to prospective tenants, or any other reasonable business purpose. Additionally, Tenant shall permit Owner to access the storage building located in the backyard at reasonable times and upon reasonable notice. RULES AND REGULATIONS: As a condition of this lease, Tenant must comply with provisions of the Rules and Regulations Agreement, which is attached hereto and incorporated by reference. The Owner from time-to-time, may adopt rules or regulations concerning the use and occupancy of the premises. Tenant shall be provided a written copy of such rules and regulations. Failure to abide by these rules and regulations shall be grounds for termination of this lease, as provided by law. LIABILITY OF OWNER AND TENANT: The Owner shall not be liable for damages or loss to persons or property caused by Tenants or other persons. The Owners shall not be liable for personal injury to Tenant and/ or Tenant's guest or damages of loss of Tenant's personal property (furniture, jewelry, clothing, etc.) from theft, vandalism, fire, water, hail, snow, explosions, sonic booms, any acts of God, or other causes whatsoever. DEFAULT BY TENANT: When any of the following events occur the Owner may, at Owner's option, terminate Tenant's right to occupancy by giving Tenant the notice required by law, or increase monthly rental amount by giving Tenant a thirty (30) day notice. A. Tenant fails to pay rent or other lawful charges due. B. Tenant fails to reimburse Owner for damages or repairs necessitated by Tenant's negligence. C. Tenant, his or her family, guest, or other occupants violate this contract, Owner's Rules and Regulations or applicable state law or local laws. D. Tenant abandons the property. Any notice contemplated by this contract may be given by mail or personal delivery to Tenant's residence. Termination does not release Tenant from liability from future rental. If Owner is forced to file suit for eviction, unpaid rental charges, or damages, Owners shall seek judgment for costs and reasonable attorney's fee. When the property has more than one Tenant and one Tenant defaults, each of the other Tenants shall be responsible for the full payment of rent and full compliance with all terms of this contract. LIEN: The Owner may have a lien on all personal property on the premises (except property exempt by statutes) to secure payment of delinquent rent and other sums due and unpaid under this contract. GENERAL: This contract is the entire agreement between the parties, and Tenant acknowledges that no other oral or written agreement exists, either expressed or implied. This contract may be modified only in writing and signed by all parties. The Owner has relied on the Tenant's statements on the rental application in executing this contract any misinformation therein shall be considered a cause for termination by Owner of Tenant's rights of occupancy. SPECIAL PROVISIONS: Tenant shall permit Owner to access the blue storage building located in the backyard at reasonable times and upon reasonable notice. Smoking or vaping of any substance inside the home is strictly prohibited. Tenant agrees to maintain the Premises in a clean, sanitary, and orderly condition at all times. This includes, but is not limited to, lawn maintenance, regular removal of trash, proper storage of personal belongings, cleaning of floors, counters, and appliances, and prevention of excessive dirt, odors, or pest infestations. Tenant shall promptly notify Landlord of any condition requiring repair to prevent damage or deterioration. Failure to maintain cleanliness as described may be considered a breach of this Lease and subject to remedies provided herein. THIS AGREEMENT SHALL EXPRESSLY ALLOW THE OWNER TO REPORT ANY UNPAID RENTALS OR UNPAID DAMAGES TO LOCAL CREDIT BUREAU FOR PERMANENT RECORDATION IN TENANT'S CREDIT FILE. THIS PROVISION WILL IN NO WAY PREVENT ANY RIGHTS OWNER MAY HAVE UNDER OKLAHOMA LAW. MILITARY CLAUSE ADDENDUM IN THE EVENT the Tenant is, or hereafter becomes, a member of the United States Armed Forces on extended active duty and hereafter the Tenant receives permanent change of station orders to depart from the area where the Premises are located, or is relieved from active duty, retires or separates from the military, or is ordered into military housing, then in any of these events, the Tenant may terminate this lease upon giving thirty (30) days written notice to the Landlord. The Tenant shall also provide to the Landlord a copy of the official orders or a letter signed by the tenant's commanding officer, reflecting the change, which warrants termination under this clause. The Tenant will pay prorated rent for any days (he/she) occupy the dwelling past the first day of the month. The damage/security deposit will be promptly returned to the tenant, provided there are no damages to the premises. Rules and Regulations of Leased Property Alterations: No alterations, additions, or improvements shall be made without the written consent of the OWNER. Conduct: Disturbing of the general peace of the residential complex or neighbors, destruction of complex or private property, physical or verbal assaults or any conduct of an offensive or socially unacceptable nature by the Tenant, any member of their family and guests is strictly prohibited and shall constitute a violation of this agreement and is cause for eviction and termination of this agreement. Drug Free Housing: Tenant, any member of the Tenant's household, or a guest or other persons under Tenant's control shall not engage in criminal activity, including drug-related activity, on or near PREMISES. "Drug-related activity means the illegal manufacture, sale, distribution, use, or possession with intent to manufacture, sale, distribute, or use, of a controlled substance (defined in Section 102 of the Controlled Substance Act (21 U.S.C. 802). Tenant, any member of the Tenant's household, or guest, or other persons under the Tenant's control shall not engage in act intended to facilitate criminal activity including drug-related criminal activity, on or near the premises. Tenant, any member of Tenant's household, or guest or other persons shall engage in acts of violence or threats of violence, including, but not limited to the unlawful discharge of firearms. Any single violation of any of the provisions above shall be deemed a serious violation and a material noncompliance with the lease. Guests: Tenants may have guests for a reasonable period, however, if guests are to stay more than seven (7) days, Tenant is to contact Owner/Management and relay reason and circumstances. Owner/Management will determine whether the seven (7) day guest period should be extended and if so for what length. Liability: Tenant agrees to assume liability and pay any damages to the property and improvements of the residential complex and/or property of other Tenants of the complex inflicted by or due to the negligence of tenant, his family or guests. Tenant agrees to assume all risk and liability occasioned by fire, theft or damage to said complex, cars, the contents thereof, and any other personal property belonging to him/her, his family and guests kept in about said premises. Owner /Management shall not be held liable for damages, loss or injury to tenant or to any other person(s) or any property of tenant, family or guests within the residential complex. Occupancy: Residency is restricted to those persons listed on the rental application and/or subsequent lease. Tenants desiring to add persons to the rental application must submit such requests in writing for approval. Approval for adding persons will be made solely at the discretion of the Owner/Management. Maximum occupancy is four and shall be limited to two adults and two children. Pets: Pets are not allowed on premises without prior written approval from Owner/Management. Satellite Dishes: No Satellite dishes shall be mounted to the building structure, fences nor shall they be anchored to the ground in the common areas (yard or parking lot) of the property. Any violation shall result in the immediate removal of the dish and the cost of repairs shall be the responsibility of the resident. Smoke Alarms: Tenant acknowledges premises has a working smoke detector and tenant must keep it in working order at all times. Storage: No Storage of items other than those listed on the rental agreement shall be stored outside the residential premises. Sub-Lease: Assignment of this agreement or a sub-lease without prior written approval of owner/management is prohibited and shall be a breach of contract. Trash: Trash shall be placed in dumpster(s) immediately. No trash shall be placed on front doors or other no-appropriate locations. Tenants can be charged up to twenty dollars ($20.00) for clean-up. Termination: Tenant(s) shall vacate upon termination and cause all personal effects to be removed from said property at once and peacefully surrender and deliver up said premises, together with all improvements thereon. If not so removed, the same will be deemed abandoned. Tenant shall upon termination, pay Owner/Management all rents and other sums that may be due and owed. All rents and charges due and owed shall constitute a lien against the Tenant's property and effects on said premises, which may be foreclosed upon by Owner/Management in the same manner as foreclosure of Security Agreements under the Uniform Commercial Code of the State of Oklahoma. Utilities: Tenant is required to keep electric, water and gas utilities on at all times. Lack of utilities is cause for termination of lease and eviction. Vehicles: Only one (1) vehicle per adult resident shall be permitted. Parking is for residents only. Vehicles shall be parked in designated areas only. Parking on unpaved areas is strictly prohibited. Vehicles leaking fluid may not park in driveway or garage until such leaking is repaired. Major repairs and maintenance of vehicles on property grounds is strictly prohibited. Violations: Violations by tenant, any member of Tenant's family, or guest(s), of any terms, rules or regulations herein provide for as hereafter adopted, of which Tenant is given notice shall constitute breach of this rental agreement and owner/management may at its option, terminate this rental agreement by giving a five (5) or (10) days written notice, as required by law, to tenant by delivering same in person to tenant or any member of his family or any person in possession of said premises. Security Deposit Agreement Property Address: 5025 NW 29th Street, Oklahoma City, OK 73127 This Agreement shall govern the refunds of all deposit(s) including deposits for any and all purposes, and shall apply to renewals and/or extensions of the LEASE. The deposit(s) will be refunded only after each and all of the following conditions have been met and after appropriate deductions, if any, have been made. Conditions for Refund Notice of at least thirty (30) days to be made in writing giving notice of intent to vacate must be given to the Owner prior to the ending date of the lease term, renewal period. In the event of the automatic renewal extension pf the lease, rent shall be paid through the last day of the month following the expiration of the thirty (30) day notice, unless Owner agrees otherwise in writing. The notice required by this provision will be void should the Tenant hold over past the day he/she has notified Owner he/she will move. Full Term: The full term of the rental contract (or any renewal or extension periods) must have ended. Rent Paid: at the time of move-out, all rents, late charges, and services charges must be paid in full through the end of the lease term or through the end of the month or any renewal or extension period. Tenant may not apply security deposit(s) to rent. Tenant agrees that the full monthly rent will be paid on or before the due date of each month, including the last month of occupancy. Forwarding Address: a written copy of Tenant's forwarding address or addresses must be left with owner. Cleaning Requirements: The property shall be left clean and neat and in the same condition, reasonable wear accepted, as when Tenant took possession. Carpets and flooring are to be clean. All cabinets are to be emptied and all personal belongings removed with trash disposed of appropriately. Keys shall be turned into the Owner. Deductions from Total Security Deposit(s) Failure to Clean: If Tenant fails to clean in accordance with the above paragraphs, reasonable charges to complete such cleaning shall be deducted. Other Deductions: After inspection by Owner, appropriate charges will be deducted for any unpaid sums due under the rental contract, including damages or repairs to the property. Deductions for late payments and returned checks will be set out in the rental Lease and Deposit Receipt or Rules and Regulations. Inspection with Owner: When Tenant moves out, Tenant is urged to inspect the property with owner, or Owner's Agent, during normal business hours. Return of Deposit(s): After all of the above conditions have been complied with by the Tenant and lawful deductions have been made, the balance of the security deposit(s) will be mailed to Tenant's forwarding address along with an itemized accounting of any deductions no later than 30 days after written demand. Insufficient Deposit(s): If lawful charges, deductions, damages, and other unpaid sums due under the rental contract exceed the total amount of deposit(s), Tenant(s) shall pay such excess amount upon written demand mailed to Tenant(s).
