Lease terms

Use and Occupancy: This home is to be enjoyed exclusively as a private single-family residence for the Tenant(s) and occupants named in the Lease Agreement only. Tenant agrees that the Premises shall be used solely as a single-family residential dwelling and for no other purpose, commercial or otherwise. No person other than those named in the Lease may reside at the Premises, even temporarily, without the prior written consent of the Owner/Landlord. Any occupancy by an unnamed individual exceeding 14 consecutive days or 30 total days per year shall be considered a material breach of this Lease. Subleasing, assignment, or short-term rental of the Premises (including via Airbnb, Vrbo, or similar platforms) is strictly prohibited without the Owner's prior written approval, and any violation shall constitute grounds for immediate lease termination. Utilities and Trash: Owner provides trash service. Tenant is solely responsible for establishing and maintaining accounts for, and timely paying, all water, gas, electric, and any other utility charges for the entire lease term. Tenant shall not allow any utility service to lapse or be shut off, and any resulting damage to the property (e.g., frozen pipes from lack of heat) shall be Tenant's financial responsibility. Security Deposit and Last Month's Rent: Tenant shall pay a security deposit and last month's rent at lease signing, held in accordance with the New Mexico Uniform Owner-Resident Relations Act. Failure to deliver both payments in full, in certified funds, prior to move-in shall result in immediate cancellation of this Lease Agreement without further notice, and any funds already tendered shall be handled per applicable law. The security deposit shall not be construed as an advance payment of rent, and Tenant may not apply it to any rent payment during the tenancy. No Smoking / No Events: Smoking, vaping, and the use of any illegal substance is strictly prohibited inside the Premises, in the garage, or within 25 feet of any building entrance, window, or ventilation intake. Tenant shall not hold or permit any party, large gathering, or event on the Premises. Violation of this provision shall constitute a material breach of this Lease and may result in immediate termination and forfeiture of the security deposit toward remediation costs (e.g., smoke odor removal, repainting). Maintenance and Condition: Tenant shall maintain the Premises in a clean, safe, and sanitary condition throughout the tenancy and shall not intentionally or negligently damage, deface, or misuse the property or its fixtures, appliances, or systems. Tenant shall promptly notify Owner in writing of any needed repairs, unsafe conditions, or damage; failure to timely report known issues that worsen due to delay shall make Tenant responsible for the increased cost of repair. Tenant shall bear the cost of repairing any damage caused by Tenant, Tenant's guests, or Tenant's pets, beyond normal wear and tear. Right of Entry: Owner/Landlord shall have the right to enter the Premises for inspection, repair, or to show the property to prospective tenants or buyers, upon reasonable notice as required by New Mexico law, except in cases of emergency, where no notice shall be required. Renter's Insurance: Tenant is required to obtain and maintain a renter's insurance policy with liability coverage of at least $100,000 for the duration of the tenancy and to provide proof of such coverage to Owner upon request. Owner shall not be liable for damage to or loss of Tenant's personal property for any reason, including but not limited to fire, theft, water damage, or acts of God. Unlawful Occupancy / Squatter Prevention: Any holdover or refusal to vacate the Premises beyond the lease expiration or termination date, absent a new written agreement signed by Owner, shall be deemed unlawful trespass. Any unauthorized person occupying the Premises without a valid, current, written lease agreement with Owner shall have no tenancy rights, shall be considered a trespasser, and shall be subject to immediate legal action for removal. Tenant shall be liable for holdover damages equal to 150% of the daily prorated rent for each day of unauthorized occupancy beyond the lease term. Tenant agrees to promptly notify Owner and cooperate fully with Owner and law enforcement in reporting and addressing any unauthorized occupancy or squatting activity on the Premises. Indemnification: Tenant agrees to indemnify and hold Owner harmless from any and all claims, damages, losses, or liabilities arising from Tenant's use of the Premises, except to the extent caused by Owner's gross negligence or willful misconduct. Default and Remedies: In the event of Tenant's default under any provision of this Lease, including but not limited to nonpayment of rent, unauthorized occupants, unauthorized subleasing, or violation of any other lease term, Owner may pursue all remedies available under New Mexico law, including termination of tenancy and eviction. Legal Fees and Enforcement: Tenant agrees to pay all reasonable attorney's fees, court costs, and collection costs incurred by Owner in enforcing any provision of this Lease Agreement, including but not limited to eviction proceedings, collection of unpaid rent or damages, and removal of unauthorized occupants, to the fullest extent permitted by New Mexico law. Severability: If any provision of this Lease is found unenforceable, the remaining provisions shall remain in full force and effect.
