FLORIDA RESIDENTIAL LEASE AGREEMENT This Residential Lease Agreement ("Agreement") is entered into on _________, 20, by and between: Landlord: _______________________________________ Tenant(s): _______________________________________ Property Address: 2465 Jernigan Road Jacksonville, FL 32207 1. Lease Term The lease begins on __________________ and ends on __________________. After expiration, the tenancy shall continue on a month-to-month basis unless terminated in accordance with Florida law or a new lease is executed. 2. Rent Monthly Rent: $__________ Rent is due on the 1st day of each month. Payments shall be made by: 3. Security Deposit Tenant shall pay a security deposit of $__________ before taking possession. The deposit will be handled in accordance with Chapter 83, Florida Statutes. 4. Late Fees If rent is not received by the 5th day of the month, Tenant shall pay a late fee of $75, plus $10 per additional day until paid, not to exceed applicable law. Acceptance of late rent does not waive Landlord's rights. 5. Returned Checks A returned payment is subject to the maximum fee permitted by Florida law. 6. Occupants Only the following persons may occupy the premises: No additional occupants may reside in the property for more than fourteen (14) consecutive days without Landlord's written approval. 7. Maintenance Tenant agrees to: * Keep the property clean and sanitary. * Promptly notify Landlord of maintenance issues. * Replace HVAC filters regularly if applicable. * Maintain smoke detector batteries. * Keep plumbing free from misuse. * Mow and maintain the yard unless otherwise agreed. Tenant shall be responsible for damages caused by negligence or misuse. 9. Landlord Maintenance Landlord shall maintain the premises in accordance with Florida Statutes 83.51. 10. Smoking Smoking and vaping are prohibited inside the residence. 12. Alterations Tenant shall not paint, remodel, install fixtures, or make structural changes without written permission. 13. Entry Landlord may enter the premises upon reasonable notice as permitted by Florida law, except in emergencies. 15. Illegal Activity Illegal activity on the property constitutes a material breach of this Agreement. 16. Assignment and Subleasing Subleasing or assignment is prohibited without Landlord's written consent. 17. Default Failure to pay rent or comply with this Agreement may result in termination and eviction pursuant to Chapter 83, Florida Statutes. Tenant shall be responsible for court costs and attorney's fees where permitted by law. 18. Abandonment If the premises appear abandoned as defined under Florida law, Landlord may exercise rights provided by statute. 19. Lead-Based Paint If the property was built before 1978, the federally required Lead-Based Paint Disclosure shall be attached. 21. Entire Agreement This Agreement constitutes the entire agreement between the parties. Any modifications must be in writing and signed by both parties. 22. Governing Law This Agreement shall be governed by the laws of the State of Florida. ADDITIONAL LEASE TERMS AND ADDENDA 23. Renter's Insurance Tenant shall obtain and maintain renter's insurance throughout the lease term with a minimum of $100,000 in personal liability coverage. Proof of insurance shall be provided to Landlord before move-in and upon renewal of the policy. Tenant acknowledges that Landlord's insurance does not cover Tenant's personal belongings. 24. HVAC Filter Maintenance Tenant shall inspect and replace the HVAC air filter at least every ninety (90) days, or more frequently if recommended by the manufacturer. Failure to do so resulting in damage to the HVAC system may make Tenant responsible for repair costs caused by neglect. 25. Routine Maintenance Responsibilities Tenant agrees to: * Replace burned-out light bulbs. * Replace smoke detector batteries as needed (unless sealed, long-life units are installed). * Keep sinks, toilets, and drains free from misuse. * Promptly report water leaks, plumbing problems, roof leaks, mold, pest infestations, or other maintenance concerns. * Maintain the yard by mowing, trimming, and removing weeds unless otherwise agreed in writing. * Keep the premises reasonably clean and sanitary. Tenant shall be responsible for damages resulting from negligence or misuse. 26. Guest Policy Guests may not remain on the property for more than fourteen (14) consecutive days or thirty (30) total days during any twelve-month period without the Landlord's prior written approval. Unauthorized occupants constitute a material violation of this Lease. 27. Move-In Inspection Landlord and Tenant shall complete a written Move-In Inspection Report before Tenant takes possession of the premises. The report shall document the condition of the property and shall be used when evaluating the property at move-out. 28. Mold Prevention Tenant agrees to: * Operate bathroom exhaust fans when bathing. * Promptly notify Landlord of leaks or moisture intrusion. * Maintain reasonable cleanliness to discourage mold growth. * Avoid blocking HVAC vents. Tenant shall immediately report any signs of mold or water intrusion. 29. Property Condition Tenant accepts the premises in clean, safe, and habitable condition unless otherwise noted on the Move-In Inspection Report. 30. Lock Changes Tenant shall not change, add, or re-key any locks without Landlord's written permission. If approved, Tenant shall provide Landlord with working keys within twenty-four (24) hours after installation. 31. Vehicles Only legally registered and operable vehicles may be parked on the property. Vehicle repairs, storage of inoperable vehicles, trailers, boats, or recreational vehicles are prohibited without written permission. 32. Attorney's Fees If either party brings legal action arising from this Lease, the prevailing party may recover reasonable attorney's fees and court costs to the extent permitted by Florida law. 33. Non-Renewal Notice Unless otherwise required by law, either party intending not to renew this Lease at the end of the fixed term shall provide at least sixty (60) days' written notice before the lease expiration date. 34. Military Service Nothing in this Lease limits a tenant's rights under the federal Servicemembers Civil Relief Act or applicable Florida law. 35. Severability If any provision of this Lease is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 36. Electronic Signatures The parties agree that electronic signatures and electronically transmitted copies of this Lease shall have the same legal effect as original signatures, to the extent permitted by applicable law. 37. Entire Agreement This Lease, together with any attached addenda, constitutes the entire agreement between the parties. No oral statements or promises shall modify this Agreement unless reduced to writing and signed by both Landlord and Tenant.
