FLORIDA VACATION RENTAL AGREEMENT This Vacation Rental Agreement ("Agreement") is entered into on _______________, 20, by and between: Owner/Landlord: __________________________________________ and Guest/Tenant: ___________________________________________ Phone: ______________________ Email: ______________________ PROPERTY Owner agrees to rent to Guest the furnished vacation property located at: 1636 NE 17th Ave Fort Lauderdale, FL 33305 ("Property") This Property is fully furnished and move-in ready. RENTAL TERM Check-In Date: ______________________ Check-Out Date: _____________________ Maximum rental term: Thirty (30) days. This Agreement is intended solely for temporary vacation lodging and does not create a permanent tenancy or residential lease. CHECK-IN AND CHECK-OUT Check-In Time: 10:00 AM Check-Out Time: 4:00 PM Early check-in or late check-out must be approved in writing by Owner or Property Manager. Unauthorized late departures may result in additional charges. RENT, FEES, AND SECURITY DEPOSIT Rental Amount: $7,500.00 Security Deposit (Refundable): $2,500.00 Cleaning Fee (Non-Refundable): $300.00 Total Amount Due Prior to Check-In: $10,300.00 All amounts shall be paid in full prior to occupancy unless otherwise agreed in writing. The Security Deposit shall be refunded within ten (10) calendar days after Guest's departure, provided: - No damage has occurred beyond normal wear and tear; - No excessive cleaning is required; - No items are missing; - No violations of this Agreement have occurred. The cleaning fee covers standard turnover cleaning only. Owner may deduct from the Security Deposit any costs associated with damage, excessive cleaning, unauthorized occupancy, smoking violations, unauthorized pets, missing items, or other breaches of this Agreement. If damages exceed the Security Deposit amount, Guest shall remain responsible for the balance owed. INCLUDED UTILITIES The following utilities are included in the rental price and paid by Owner: - Water - Electricity - Wi-Fi Internet Service OCCUPANCY LIMIT Maximum occupancy is eight (8) persons. Exceeding the occupancy limit without Owner's written approval constitutes a violation of this Agreement and may result in immediate termination of occupancy without refund. PARKING Parking is available in the driveway for a maximum of two (2) vehicles. - No garage access is provided. - No street parking is permitted. - Vehicles parked improperly may be towed at the owner's expense. RESTRICTED AREAS The main walk-in closet located within the master bedroom is not included with the rental and shall remain locked. Guests agree not to access, tamper with, or attempt to enter any locked storage areas reserved for Owner use. NO SMOKING Smoking, vaping, or use of tobacco, cannabis, or similar products is strictly prohibited inside the Property. Violation of this policy may result in additional cleaning charges and deductions from the Security Deposit. NO PETS No pets or animals are permitted on the Property without prior written approval from Owner. Unauthorized pets may result in immediate termination of occupancy and additional cleaning charges. PARTIES, EVENTS, AND NOISE No loud parties are permitted. No weddings, commercial events, gatherings, or organized functions are allowed without prior written approval. Under no circumstances shall any event exceed twenty-five (25) total attendees, including registered guests and visitors. Guests shall comply with all local noise ordinances. Quiet hours shall be observed between 10:00 PM and 8:00 AM. FURNISHINGS AND PROPERTY CONDITION Guest agrees to maintain the Property and all furnishings, appliances, electronics, and household items in clean and good condition. Guest shall be responsible for damage beyond normal wear and tear caused by Guest, occupants, or visitors. SECURITY CAMERAS Guest acknowledges that exterior security cameras are installed outside the Property for security and safety purposes. No cameras are located inside the home or in private living areas. Tampering with security equipment is prohibited. ELECTRONIC DOOR LOCK The Property is equipped with an electronic door lock. Guest agrees not to share entry codes with unauthorized persons. Access codes may be changed or deactivated at the conclusion of the rental term. SWIMMING POOL LIABILITY WAIVER AND RELEASE Guest acknowledges that the Property contains a swimming pool and that swimming and pool activities involve inherent risks, including serious injury, drowning, illness, death, and property damage. Guest assumes full responsibility for the safety and supervision of all occupants and visitors using the pool. Children under eighteen (18) years of age must be supervised by a responsible adult at all times while in or around the pool area. Guest agrees to comply with all pool safety rules and exercise reasonable care. Owner, Property Manager, and their agents shall not be liable for any injury, death, loss, damage, or claim arising from the use of the swimming pool except as required by Florida law. Guest hereby releases and holds harmless Owner, Property Manager, and their agents from any claims related to the use of the pool by Guest, occupants, or visitors. By signing this Agreement, Guest acknowledges acceptance of this Pool Liability Waiver and Release. MAINTENANCE AND PROPERTY MANAGER CONTACT For questions, maintenance requests, emergencies, or assistance during the rental period, contact: Property Manager: Shelem Phone: Guest agrees to promptly report any maintenance issues or property damage. LIABILITY Guest accepts responsibility for the conduct and safety of all occupants and visitors. Owner shall not be liable for accidents, injuries, illness, theft, loss of personal property, or damages occurring during the rental period except as required by law. Guests occupy and use the Property at their own risk. CLEANLINESS AND CHECK-OUT Guest agrees to leave the Property in substantially the same condition as received. Excessive cleaning, trash removal, stain removal, damage repair, smoking violations, unauthorized pets, or missing items may result in deductions from the Security Deposit. VACATION RENTAL STATUS; NO RESIDENCY OR MAIL DELIVERY This Property is offered exclusively as a short-term vacation rental and temporary lodging accommodation. Guest acknowledges that this Agreement does not create a landlord-tenant relationship, permanent tenancy, residency rights, or any claim of possession beyond the rental term. The Property may not be used as a: - Primary residence - Legal residence - Mailing address - Business address - Driver's license address - Voter registration address - School registration address Guest shall not receive mail, government correspondence, utility bills, or other deliveries intended to establish residency at the Property. Any such mail may be refused or returned to sender. Guest agrees to vacate the Property immediately upon expiration of the rental term. No holdover tenancy, month-to-month tenancy, or renewal rights are created by this Agreement. DEFAULT If Guest violates any material provision of this Agreement, Owner may terminate occupancy immediately and require Guest to vacate the Property without refund, subject to applicable Florida law. GOVERNING LAW This Agreement shall be governed by the laws of the State of Florida. ENTIRE AGREEMENT This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, advertisements, representations, or agreements. Any modification must be in writing and signed by both parties.
