Lease Term: 1.1 The lease term shall be for a period of 1 (one) year, unless otherwise extended or terminated. 1.2 Any termination or extension of this lease must be approved in writing by both the Landlord and the Tenant. If the Tenant wishes to terminate the lease at its expiration, written notice must be provided to the Landlord at least 30 days prior to the termination date. Failure to provide such notice will result in the Tenant being responsible for the full rent of the following month. Rent Payment: 2.1 The monthly rent for the premises is $2,300 (USD). Rent is due on the 1st day of each month. 2.2 If the rent is not paid within 5 days of the due date, a late fee of $150 (USD) shall be charged. Additionally, any delinquent rent shall accrue interest at a rate of 15% per annum until paid. 2.3 The Tenant shall make all rental payments to the Landlord by check or electronic transfer, as specified by the Landlord in writing. Utilities: 3.1 The Tenant is responsible for putting all utilities, including water, gas, electricity, and any other utilities, under their name. 3.2 The Tenant shall be responsible for payment of all utility bills associated with the premises during the lease term. House Rules: House Rules: 4.1 Smoking: Smoking inside the house, garage, or any other structure located on the property is strictly prohibited. The Tenant shall ensure that no occupants, guests, or invitees violate this rule. 4.2 Use of the Property: The property shall only be used as a private residence for the named Tenant(s). No person other than the immediate family members of the Tenant(s) may reside on the property without the prior written consent of the Landlord. Up to two small dogs are allowed on the property with an additional fee of $100 (USD) per dog per month added to the rent. The Tenant may have up to three guests staying on the premises, but not for more than seven days without the written approval of the Landlord. 4.3 Pet Policy: Two small dogs are allowed on the property, subject to an additional monthly fee of $100 (USD) per dog. These pet fees shall be paid along with the monthly rent. 4.4 Hazardous Materials: The Tenant shall not store or allow the presence of hazardous, flammable, or explosive materials on the property that may unreasonably increase the risk of fire or explosion. The Tenant shall not allow any liens or encumbrances to be filed or recorded against the property. 4.5 Conduct: The Tenant, occupants, guests, and invitees shall not engage in any unlawful, disorderly, or disruptive conduct that disturbs the neighbors or other individuals. The Tenant acknowledges receipt of any additional house rules and regulations, if any, which are incorporated herein by reference and hereby made part of this Agreement. The Tenant is responsible for abiding by these rules. Smoke Detectors: 5.1 The Tenant acknowledges that smoke detectors are installed on the premises for the safety and protection of all occupants. 5.2 The Tenant shall not tamper with or disable any smoke detectors during the lease term. In the event of a malfunctioning smoke detector, the Tenant shall promptly notify the Landlord for necessary repairs or replacement. 5.3 The Tenant shall test each smoke detector regularly to ensure its proper functioning. The Landlord may also conduct periodic inspections to verify the operability of smoke detectors. Mold Waiver: 6.1 The Tenant acknowledges that mold can develop in certain conditions, especially in humid environments. The Tenant understands that mold can cause health issues and property damage. 6.2 The Tenant waives any claims against the Landlord for any mold-related issues that may arise during the lease term. The Tenant agrees to promptly notify the Landlord of any signs of mold or moisture problems on the premises. 6.3 The Tenant agrees to take appropriate measures to prevent mold growth, including proper ventilation, cleaning, and notifying the Landlord of any plumbing leaks or water intrusions. 6.4 The Landlord shall promptly address any reported mold issues that are caused by the Landlord's negligence or failure to maintain the property in good repair. Maintenance and Repairs: 7.1 Initial Inspection: The Tenant acknowledges having had the opportunity to inspect the premises prior to entering into this Agreement. The Tenant agrees that they accept the premises in its current condition and that the Landlord shall have no further obligation to make any repairs or improvements unless otherwise specified in this Agreement. 7.2 Tenant's Responsibility: 7.2.1 The Tenant shall be responsible for maintaining the premises in a clean and orderly manner. This includes, but is not limited to, maintaining all equipment, fixtures, appliances, furniture, furnishings, and any other personal property in good, clean, and well-maintained condition. 7.2.2 Upon termination of the lease, the Tenant shall surrender the premises, unless owned by the Tenant, in the same condition as when they took possession, normal wear and tear excepted. 7.2.3 The Tenant is responsible for maintaining the exterior of the premises, including the yard and any landscaping, in a reasonably neat, clean, and attractive condition. This includes, but is not limited to, mowing the lawn if applicable and removing weeds. 7.2.4 The Tenant shall promptly address any pest infestation, including, but not limited to, cockroaches and mice, at their own cost. 7.2.5 The Tenant shall be responsible, at their own cost, for all repairs required as a result of damages caused by the Tenant, their occupants, guests, or other invitees. 7.2.6 The Tenant shall not remove the Landlord's fixtures, furniture, furnishings, or any other personal property from the premises without prior written consent from the Landlord. This includes, but is not limited to, the following items: stove, fridge, dishwasher, microwave, washing machine, dryer, water purifier, heater, and air conditioning, which are provided for the Tenant's use in the premises. Entry and Inspections: 8.1 Entry by Landlord: The Landlord or their authorized representatives may enter the premises at reasonable times and upon reasonable notice to the Tenant for the purposes of inspection, maintenance, repairs, or showing the premises to potential buyers or tenants. In cases of emergency, the Landlord may enter the premises without prior notice. 8.2 Inspection Notice: The Landlord shall provide the Tenant with at least 24 hours' notice before conducting a non-emergency inspection of the premises. 8.3 Cooperation: The Tenant agrees to cooperate with the Landlord during inspections and shall not withhold access to the premises, provided that proper notice has been given. 8.4 Condition Reports: The Landlord may conduct periodic inspections to assess the condition of the premises and to ensure compliance with the terms of this Agreement. The Landlord may provide the Tenant with a written report detailing any necessary repairs or violations of the lease agreement. Security Not Promised: 9.1 The Tenant acknowledges that the premises do not have security or surveillance systems, and the Landlord does not promise or guarantee the security or safety of the Tenant, their occupants, guests, or invitees while on the premises. 9.2 The Tenant is responsible for taking appropriate measures to safeguard themselves, their personal property, and the premises, including, but not limited to, the installation of security systems, locks, and any other security devices. No Alterations: 10.1 The Tenant shall not make any alterations, improvements, or additions to the premises without the prior written consent of the Landlord. 10.2 Any alterations, improvements, or additions made by the Tenant with the Landlord's consent shall become the property of the Landlord and shall remain on the premises at the end of the lease term, unless otherwise agreed in writing by the Landlord. Illegal Activity: 11.1 The Tenant shall not engage in any illegal activities on the premises, including but not limited to drug-related offenses, unlawful possession of firearms or weapons, or any other criminal activity. 11.2 The Tenant acknowledges that engaging in illegal activity on the premises will constitute a material breach of this Agreement and may result in immediate termination of the lease and eviction. Renters Insurance: 12.1 The Tenant is strongly encouraged to obtain and maintain renters insurance for the duration of the lease term. Renters insurance is intended to protect the Tenant's personal property and liability in the event of loss, damage, or injury caused by covered perils such as theft, fire, or accidents. 12.2 The Landlord's insurance policy does not cover the Tenant's personal property or liability. The Tenant acknowledges that they are responsible for securing their own renters insurance coverage. Security Deposit: 13.1 The Tenant shall deposit with the Landlord a security deposit in the amount of $2,100 (USD) to secure the performance of the Tenant's obligations under this Agreement. 13.2 The security deposit shall be held by the Landlord in a separate account. 13.3 The security deposit shall be refundable to the Tenant, less any deductions for unpaid rent, damages beyond normal wear and tear, costs incurred by the Landlord due to the Tenant's breach of this Agreement, and any outstanding obligations of the Tenant, within [number of days] days after the termination of the lease, provided that the Tenant has fulfilled all of their obligations under this Agreement. Landlord Shall Not Be Liable: 14.1 The Landlord shall not be liable for any injury, loss, or damage to the Tenant, their occupants, guests, or invitees, or to any personal property belonging to them while on the premises, regardless of the cause, unless such injury, loss, or damage is directly caused by the Landlord's willful misconduct or gross negligence. 14.2 The Tenant is encouraged to obtain renter's insurance to protect against any losses or damages not covered by this Agreement. Default by Tenant: 15.1 If the Tenant fails to comply with any provision of this Agreement, including but not limited to the payment of rent, the Landlord may serve a written notice on the Tenant specifying the breach and demanding remedy within a reasonable time (not less than 7 days). 15.2 If the Tenant fails to remedy the breach within the specified time or commits a material breach of this Agreement, the Landlord may terminate this lease and initiate eviction proceedings in accordance with applicable law. Abandonment: 16.1 Abandonment occurs when the Tenant vacates the premises without notice and fails to pay rent for a period of time as specified by applicable law (e.g., 15 days). 16.2 In the event of abandonment, the Landlord may enter the premises, take possession, and relet the premises at the Tenant's expense. The Landlord shall make reasonable efforts to mitigate damages. 16.3 If the Landlord relets the premises, any amounts collected from the new tenant shall be applied to the Tenant's outstanding obligations, including any costs incurred by the Landlord in reletting the premises. Attorneys' Fees: 17.1 In the event of any legal action or proceeding arising out of or relating to this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs incurred in connection with such action or proceeding. Severability: 18.1 If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law. Notices: 19.1 All notices, demands, or requests required or permitted by this Agreement shall be in writing and shall be delivered personally, sent by certified or registered mail, or by a reputable courier service.
