This is a Short-Term Rental Agreement. The Property shall be furnished by the Landlord. Limited to furniture already inside the home. This is a Non-smoking property. The Landlord shall be responsible for providing the following utilities: Electricity, Internet, Oil / Gas, Trash Collection, Water, Sewer and all other utilities to be paid by the Landlord. Bi-weekly cleaning to be included in the Rental Amount. Cleaning to be done on a day/date to be decided between the Property Manager and Tenant(s). This cleaning is not optional, and Tenant(s) acknowledge and agree to allow the Property Manager into the house and garage on a bi-weekly basis to clean the property. Tenant(s) shall pay a Security Deposit equal to one month's rent, calculated by dividing the total rent due for the rental period by the number of months in the rental term, with any partial month being considered one full month for purposes of this calculation. The Security Deposit, together with the first and last month's rent, is due upon execution of this Agreement. The Property shall not be reserved, and rental dates shall not be blocked on any booking platform, including VRBO, until all required funds have been received. Pets are not permitted to stay overnight or remain on the Property for extended periods without the Landlord's prior written approval. The Landlord reserves the right to inspect the Property with reasonable prior notice, except in the event of an emergency, and in accordance with applicable Arizona law. Should Tenant(s) violate any provision of this Agreement, the Landlord may terminate this Agreement and pursue all remedies available under applicable Arizona law. Tenant(s) agree to vacate the Property immediately upon expiration or lawful termination of this Agreement. Tenant(s) agree to indemnify, defend, and hold harmless the Landlord and Property Manager from any and all claims, demands, damages, liabilities, losses, costs, and expenses arising from Tenant(s)' or Guest(s)' use or occupancy of the Property, except to the extent caused by the Landlord's gross negligence or willful misconduct, or as otherwise prohibited by law. Tenant(s) acknowledge that the Landlord's insurance does not cover Tenant(s)' personal property or personal liability. Tenant(s) shall maintain renter's liability insurance for the duration of the rental period and shall provide proof of such coverage to the Landlord or Property Manager prior to the commencement of the Rental Period. The total amount of individuals allowed to stay at the Property for any period will be limited to 4 people. In addition, the Tenant(s) are allowed to have a total number of 4 Guests on the Property. Tenant(s) agree to pay all reasonable costs, expenses, court costs, and attorney's fees incurred by the Landlord in enforcing this Agreement, to the fullest extent permitted by Arizona law. No refunds shall be issued for shortened stays, early departures, weather conditions, monsoon storms, utility interruptions beyond the Landlord's control, acts of God, internet outages caused by third-party providers, or other circumstances beyond the Landlord's reasonable control. As a condition of occupancy, the primary renter must sign a separate Pool & Spa Liability Waiver prior to check-in. The waiver applies to all occupants and visitors who access the pool or spa during the rental period. Execution of the waiver is mandatory and will be provided with the final lease documents for signature. Tenant(s) shall have access to the garage for vehicle parking and storage during the rental period of July through September 2026. The owner's kitchen storage closet shall remain locked at all times and is not included as part of the rental. Tenant(s) and Guest(s) shall not attempt to access or tamper with the locked owner's closet Tenant(s) acknowledge that the Property is located in the Sonoran Desert and that encounters with native wildlife, including but not limited to scorpions, snakes, spiders, coyotes, javelinas, lizards, and other desert animals, are possible despite routine pest control and property maintenance. Tenant(s) agree to exercise reasonable caution while using both the interior and exterior of the Property. The Property receives regularly scheduled landscaping, pool maintenance, pest control, and other necessary maintenance services. Tenant(s) agree to permit reasonable access to the Property for authorized service providers during normal business hours with reasonable notice from the Property Manager or Landlord whenever practicable. Pool and spa temperatures are subject to seasonal weather conditions, equipment operation, and maintenance requirements. While every reasonable effort will be made to maintain the pool and spa in proper working order, the Landlord does not guarantee a specific water temperature or uninterrupted operation. Temporary maintenance, repairs, or equipment malfunctions shall not constitute grounds for cancellation, rent reduction, or refund. No glass containers, bottles, or glassware are permitted in or around the pool or spa area at any time. Any broken glass in or around the pool or spa may require closure of the pool and professional cleaning, and Tenant(s) shall be responsible for all resulting costs if caused by Tenant(s) or their Guests. Tenant(s) acknowledge that Tucson experiences seasonal monsoon storms, high winds, dust storms, extreme heat, and occasional utility or internet interruptions beyond the Landlord's control. No refunds or rent reductions shall be provided for weather-related events, utility interruptions, internet outages caused by third-party providers, or other circumstances beyond the Landlord's reasonable control. Tenant(s) agree to comply with all applicable City of Tucson, Pima County, State of Arizona, and homeowners' association rules, if applicable, including all short-term rental regulations, occupancy limits, parking requirements, and noise ordinances. Quiet hours shall be observed daily between 10:00 p.m. and 7:00 a.m. Excessive noise, parties, events, or disturbances to neighboring properties are strictly prohibited and may result in immediate termination of this Agreement in accordance with applicable law.
