# Lease Terms and Property Rules ## Lease Term The initial lease term shall be six (6) months. Upon expiration of the initial lease term, the tenancy shall automatically convert to a month-to-month tenancy unless terminated by either party in accordance with California law and the terms of this Agreement. ## Rent and Included Utilities Monthly rent shall be $4,000. The following utilities are included in the monthly rent: * Internet service * PG&E utility service up to a maximum of $250 per month If the monthly PG&E bill exceeds $250, Tenant shall be responsible for the amount exceeding $250. Any utility overage shall be due within ten (10) days of written notice from Landlord or may be collected with the following month's rent. Tenant agrees to use utilities responsibly and avoid excessive or wasteful consumption. ## Parking and Garage Tenant shall have exclusive use of: * Two-car garage * Driveway parking * Available street parking, subject to local regulations Tenant shall keep all parking areas clean and free of excessive storage, debris, or inoperable vehicles. ## Yard Maintenance The property includes a front yard and backyard. Tenant agrees to: * Water and maintain all landscaping in a reasonable manner. * Keep the yard free of weeds, trash, debris, and pet waste. * Promptly notify Landlord of any irrigation, drainage, or landscaping issues. Failure to maintain the yard may result in charges for restoration, cleanup, or professional landscaping services. ## Water Softener The home is equipped with a water softener system. Tenant agrees to use the system properly and maintain appropriate salt levels during the tenancy unless otherwise agreed in writing. Any damage caused by misuse or neglect of the water softener shall be the responsibility of the Tenant. ## Plumbing and Drain Usage The home's plumbing system contains older pipes that are susceptible to clogs and damage. Under no circumstances shall Tenant or Tenant's guests flush or dispose of any items other than human waste and toilet paper into toilets, sinks, showers, tubs, or drains. Prohibited items include, but are not limited to: * Wipes of any kind (including "flushable" wipes) * Paper towels * Feminine hygiene products * Cotton swabs * Grease, fats, and oils * Food scraps * Chemicals * Foreign objects If a clog, backup, or plumbing repair is determined to have been caused by Tenant negligence, misuse, or violation of this provision, Tenant shall be responsible for all related repair, service, restoration, and plumbing costs. ## Additional Dwelling Unit (ADU) An additional dwelling unit (ADU) is located on the property and is not included in this rental agreement. Tenant acknowledges and agrees that: * The ADU is occupied separately and independently from the main residence. * The yard area is a shared space between occupants of the main residence and the ADU. * Tenant shall respect the privacy, quiet enjoyment, and reasonable use of the shared yard by all occupants. ## Occupancy Only individuals listed on the Lease Agreement may reside at the property. Guests staying longer than fourteen (14) consecutive days or more than twenty-one (21) cumulative days in any twelve-month period must receive prior written approval from Landlord. ## No Subletting Subletting, assignment of the lease, short-term rentals, Airbnb-type rentals, or allowing unauthorized occupants to reside at the property is strictly prohibited without prior written consent from Landlord. ## Pet Policy No pets of any kind are permitted on the property without prior written approval from Landlord. This prohibition includes, but is not limited to: * Dogs * Cats * Birds * Reptiles * Rodents * Fish tanks or aquariums * Any other domestic or exotic animals Unauthorized pets shall constitute a violation of this Lease Agreement. ## No Smoking Policy The property is a non-smoking property. Smoking and vaping are strictly prohibited anywhere on the premises, including: * Inside the residence * Garage * Driveway * Front yard * Backyard * Shared outdoor areas This prohibition includes cigarettes, cigars, pipes, marijuana, e-cigarettes, vaporizers, and all other smoking devices. Tenant shall be responsible for all cleaning, deodorization, repainting, repairs, and restoration costs resulting from smoking or vaping on the property. ## Community Expectations The property is intended to provide a peaceful and respectful living environment. Landlord is seeking calm, responsible, and considerate tenants and neighbors. Tenant agrees to: * Conduct themselves respectfully toward neighbors and other occupants of the property. * Avoid excessive noise, disturbances, nuisance activities, or disruptive behavior. * Maintain the property in a clean and orderly condition. * Respect the shared yard space and privacy of ADU occupants. * Ensure all guests comply with the terms of this Agreement. ## Material Violations and Default The following shall constitute material violations of this Lease Agreement: * Unauthorized occupants residing at the property * Subletting or short-term rentals without approval * Keeping unauthorized pets * Smoking or vaping on the property * Failure to maintain the yard as required * Repeated disturbances, nuisance behavior, or excessive noise * Misuse of the plumbing system resulting in damage * Failure to pay rent, utility overages, or other charges when due * Illegal activity occurring on the premises * Any other substantial violation of this Lease Agreement In the event of a material violation, Landlord may serve any notice required by California law and pursue termination of tenancy, eviction, recovery of damages, and any other remedies available under applicable law. Tenant shall be financially responsible for all damages, repair costs, cleaning costs, unpaid rent, unpaid utility overages, plumbing repairs, landscaping restoration costs, attorney's fees where permitted by law, and any other losses resulting from Tenant's violation of this Agreement. ## Security Deposit The security deposit shall not be considered last month's rent and may not be applied toward rent payments during the tenancy. Upon termination of tenancy, the security deposit shall be returned in accordance with California law, less any lawful deductions for: * Unpaid rent * Unpaid utility overages * Cleaning costs * Repairs beyond normal wear and tear * Damage caused by Tenant, occupants, or guests * Any other deductions permitted by California law Any damages or charges exceeding the amount of the security deposit shall remain the responsibility of the Tenant.
