Lease terms
1. Lease Term This lease agreement shall begin on the agreed move-in date and continue for an initial term of one (1) year. Upon expiration of the initial lease term, the agreement shall automatically convert to a month-to-month tenancy unless otherwise agreed to in writing by both Landlord and Tenant. 2. Early Move-Out / Lease Termination Tenant agrees to fulfill the entire initial one-year lease term. If Tenant vacates, abandons, or terminates the lease prior to the expiration date without Landlord's written approval, Tenant shall remain responsible for rent and utilities until the property is re-rented or until the lease term expires, whichever occurs first, as permitted by California law. In addition, Tenant agrees to pay an early termination fee equal to one month's rent ($2,400) to help cover costs associated with vacancy, advertising, cleaning, and re-renting the property. Landlord shall make reasonable efforts to mitigate damages by attempting to re-rent the property as required by California law. 3. Landscaping Maintenance Tenant shall be responsible for maintaining all landscaping and yard areas during the tenancy, including mowing, weed control, watering, trimming, and general upkeep of the property. 4. Community Rules Tenant agrees to comply with all applicable community, HOA, and neighborhood rules and regulations. Any fines or violations caused by Tenant, occupants, or guests shall be the responsibility of Tenant. 5. Pet Policy Pets are only permitted with prior written approval from Landlord. Tenant is responsible for any damage caused by pets to the property, landscaping, or structures. Tenant shall properly clean up after pets and prevent excessive noise or disturbances. 6. No Smoking Smoking or vaping of any kind is strictly prohibited inside the residence, garage, or any enclosed structures on the property. 7. Solar System Payment Property is equipped with a solar system. Tenant shall be responsible for a monthly solar payment of $180 per month in addition to monthly rent. 8. PG&E True-Up Charges Tenant understands the property utilizes solar power and regular monthly PG&E bills are expected to be minimal or nonexistent. Tenant shall be fully responsible for any annual or periodic PG&E "true-up" charges incurred during the tenancy. 9. Water Service Tenant shall be responsible for payment of all water utility charges. 10. Trash Service Tenant shall be responsible for payment of trash service charges. Trash billing occurs every three months and shall be paid by Tenant upon receipt or reimbursement request from Landlord. 11. Air Filters Tenant shall be responsible for regularly replacing HVAC air filters during the tenancy to help maintain proper operation of the heating and air conditioning system. 12. Dock Use The dock shall be used in a safe and responsible manner at all times. Tenant shall not move, alter, or modify the dock in any way. If any dock poles, supports, or structural components become loose, damaged, or come out of place, Tenant shall immediately notify Landlord. 13. Rent Due Date & Late Fees Rent is due on the 1st day of each month. If rent is not paid in full by 11:59 PM on the 5th day of the month, a late fee of $75 shall be charged. Beginning on the 6th day of the month, an additional late fee of $10 per day may be charged until rent is paid in full. Total late fees shall not exceed $150. 14. Renter's Insurance Requirement Tenant is required to maintain renter's insurance throughout the duration of the lease term. Proof of active renter's insurance must be provided prior to move-in and maintained at all times during occupancy. 15. General Utilities Unless otherwise stated in this agreement, Tenant shall be responsible for all utilities and services associated with the property during the lease term. 16. Utilities Tenant shall be responsible for placing and maintaining the following utilities in Tenant's name for the duration of the tenancy, when permitted by the utility provider: Water service (Rio Alto Water) Trash service (Green Waste of Tehama) Solar payment/service agreement Tenant shall be responsible for timely payment of all utility charges associated with the property during the tenancy. Property is equipped with a solar system. Tenant understands that regular monthly PG&E bills are expected to be minimal or nonexistent due to solar service; however, Tenant shall also be responsible for any annual or periodic PG&E "true-up" charges incurred during the tenancy. If any utility provider does not allow services to be transferred into Tenant's name, Tenant agrees to reimburse Landlord for such charges within five (5) days of receiving a copy of the bill or request for payment.
