Lease terms

Term of rental. This Room Rental Agreement is on a month-to-month. If this Room Rental Agreement starts partway through the month, the first month's rent will be prorated and the month-to-month terms will then proceed from the 1st day of each month. Termination. Either Party may terminate this Agreement with 30 days written notice personally delivered to the other Party. Homeowner may terminate this Agreement with seven (7) days written notice (and a seven-day period to cure) if the Renter is in default under this Room Rental Agreement. Rent and security deposit. Monthly rent to be paid by Renter to Homeowner is per month, due on or before the 1st day of each calendar month during the term of this Room Rental Agreement. The first and last month's rent must be paid in advance upon the signing of this Room Rental Agreement. If this Room Rental Agreement begins partway through the month, the first month's rent will be prorated. Rent must be paid in direct deposit regularly through apartment system or zelle for some occasion for only emergency/special reason. In addition, Renter will pay Homeowner a security deposit of (no more than 4 weeks rent) as security for any damages to the House caused by Renter. The Security Deposit will be returned to Renter within [10 days] of termination of this Room Rental Agreement, less any deductions for damages, with an accompanying itemized statement explaining any deductions. Late payment. If renter is late for 5 days, late fee is 5% of his room rent. If 10 days has past, late fee is 10% of his room rent. After the 10 days, tenant will be give warning eviction notice. Short term. If short term is up and tenant hasn't find employment and cannot be able to maintain rent, tenancy will be terminated immediately unless tenant is able to make arrangement with landlord with an agreement in writing. Utilities. Rent includes all utilities (Water/Gas/Electricity), except as indicated below. Renter will be responsible for payment of the following percentages of monthly utility bills: Household rules. Common Areas- Everyone is to clean up after themselves or any guests in common areas. Personal rooms- Should be clean and carpet vacuumed out at least once a month, no food or food wrappers/trash is to be kept in rooms at all. Bathrooms- Should be cleaned out after each use and when needed. Kitchen- Should be cleaned after cooking. All dishes and cookware should be cleaned after used and left to dry, then to be put up in proper area. Dishes should be rinsed off before putting in and when full needs to be turned on. When dishes are dry they need to be put back up. Bathroom Should be cleaned after using. Don't leave personal items on top of surfaces, floor and make sure all surrounding is clutter free. Spray bathroom spray or wipe bathtub after every use. Cleaning Supplies- Is a shared supply between landlord and fellow roommates Guests- No more than 3 guests at a time, unless discussed and accepted by Landlord. Only 1 guest can stay the night and for no longer than 1 day, unless discussed and accepted by Landlord. An extra $70 will be added to Rent for a Guest that stays (sleeps, showers, eats, uses utilities) with Tenant for more than a 2 days, with permission from Landlord. Smoking- Cigarettes or any other type of Smoking Is not permitted at all in the house. If smoking outside the house, all cigarette butts need to be properly disposed of in a trashcan. Alcohol Use- Alcohol may only be consumed by those the age of 21 and older, and only in a responsible manner. Drug Use- Any type of illegal Drug is not to be brought around or used in the house. Any violation of this rule and the Authorities will be contacted and tenant will be evicted. Music/TV/Noise- Noise should not be loud enough to bother any one in the house or for the sound to travel out of the room with the door shut. If it does, when asked to turn down the first time should be done immediately and not raised again. 10pm is quiet time and it should be respected. *Pets- Pet are not allowed. Parking- Parking is for rent. Garbage/ Recycle- Tenant is responsible of taking the trash and recyclables. Renters can arrange a rotation responsibilities. Garbage is taken out on Wednesdays and Sundays. Recycle is Sundays. House, appliances and electronic care- Tenants responsibility to care for all amenities, all common rooms and utilities. Tenants will repair for any broken appliances, furniture, clogged sink, toilet and bathtub, electronics and damaged wall he or she has done. Tenants are not allowed to modify, paint and make holes to hang to any wall. If there is any damage or modification, tenant is responsible for any damage. Cooking Tenants should not cook any food with strong odor that may offend other tenants in the property. Avoid cooking strong fishy, spices that will linger in the halls, walls and house surroundings. Chores- tenants will participate on a rotation cleaning schedule with the disposing of trash/recycle during trash and recycle days. Your Repair Responsibility Mold (from living conditions): Keep your home clean and dry, with adequate ventilation and air movement. This means making sure all rooms receive heat and airflow on a consistent basis. Immediately clean up any sign of mold or mildew growth to prevent damage to the building. This includes behind furniture, in windows, in corners of walls, etc. (Some) Leaks: You are responsible for leaks caused by misuse or neglect (such as knocking drain lines loose). Report all leaks immediately, as they can become a very big problem very quickly. Faucets/knobs: Faucets and knobs can break easily if not handled properly. Broken windows, blinds, doors, glass, locks, or any other damage caused directly/indirectly by you or your guests. Batteries: It is your responsibility to keep your own smoke detector in your room (except shared rooms such as hallways, kitchen and living room) in working order by replacing the batteries on a regular schedule. Clogged- toilets, bathtubs, sinks, and other drains - tenants should unclog and maintain all drains to be clog free from scum, hair or any debris. Conflict resolution. In the interest of household harmony, the Parties each agree to make reasonable efforts to maintain a peaceful environment within the House work together to resolve any differences. Modifications. This Room Rental Agreement constitutes the entire agreement between the Parties and cannot be changed unless both agree in writing to do so. There are not any understandings or representations that contradict any terms in this document. Privacy. As required by law, the landlord may enter the tenant's room only for the following reasons: (a) in case of emergency; (b) to make necessary or agreed-upon repairs, improvements, supply necessary agreed upon services, or exhibit dwelling unit to prospective or actual purchasers, mortgages, tenants, workers, or contractors; (c) when the tenant has abandoned or surrendered the premises; (d) pursuant to court order; (e) or to inspect living area of tenant to make sure all rules are being followed. Locks and security devices. The landlord agrees: to provide and maintain locks or other security devices necessary to keep the residential premises reasonably secure, and to give each tenant under this agreement a copy of the key or opening device or information to open any lock or security device for the residential premises or common property to which the tenant is entitled to have access, and Liabilities. Tenants shall be responsible for his/her personal property/belongings. Landlord is not liable for any loss or damage of tenants belonging within the building and around the premises. The tenant agrees: not to alter, remove, distribute or add any lock or other security device without reasonable excuse (which includes an emergency, an order of the NSW Civil and Administrative Tribunal, termination of a co-tenancy or an apprehended violence order prohibiting a tenant or occupant from having access) or unless the landlord agrees,
