Lease terms

Tenant Responsibilities & Lease Terms Utilities: Tenant is responsible for all water and sewer and electricity charges associated with the property. Internet: Tenant is responsible for establishing and paying for their own internet service. Rent: Rent is due on the 1st of each month. If full payment is not received by the 5th, a one-time late fee of 5% of the monthly rent will be assessed. Assessment of a late fee does not extend the rent due date or waive Landlord's remedies for nonpayment. The unpaid rent and the late fee are both due immediately upon assessment and in no event later than the 15th of the month. Any payment received will be applied first to unpaid rent, then to the late fee. Lease Term: Minimum lease term is 12 months. Last Month's Rent: The last month's rent is due at lease signing, subject to applicable California law and the terms of the lease. Smoking: No smoking or vaping is permitted inside the property or in any area where prohibited by the lease or applicable community/HOA rules. Pets: Pets are permitted as per Pet Policy. Assistance animals are handled in accordance with applicable fair-housing laws. HOA Rules: Tenant must comply with all applicable HOA rules, regulations, and community policies. Damage & Property Care Tenant is responsible for any damage to the property caused by the tenant, occupants, guests, or other persons under the tenant's control, beyond normal wear and tear. Tenant must promptly notify the landlord of any damage, maintenance issue, or condition that could cause further damage to the property. Tenant is responsible for the reasonable cost of repairing damage caused by negligence, misuse, abuse, or failure to properly care for the property, to the extent permitted by California law. Normal wear and tear and ordinary deterioration are not considered tenant-caused damage. Any deductions from the security deposit will be handled in accordance with applicable California law. Early Lease Termination Notice Tenant must provide the landlord with at least 60 days written notice if the tenant intends to request early termination of the lease. Early termination of a 12-month lease is subject to the terms of the lease and applicable California law. Providing 60 days notice does not by itself release the tenant from any remaining obligations under the lease. The tenant remains responsible for rent and other obligations as permitted by law until the tenancy is legally terminated or the property is re-rented, subject to the landlord's duty to mitigate damages.
