# RESIDENTIAL LEASE AGREEMENT TERM: The initial term of this Lease shall be for a minimum of one (1) year. 1. RENT & SECURITY DEPOSIT: Tenant agrees to pay monthly rent of $_1700__, due on the first day of each month. Tenant shall deposit the sum of $_1700__ as a Security Deposit for the performance of all terms under this Lease. 2. HOA RULES SUPREMACY CLAUSE: The Premises is part of a Condominium Association ("HOA"). Compliance Mandatory Tenant agrees to comply strictly with all Rules, Regulations, Bylaws, and Covenants of the HOA, which are attached hereto as **Exhibit A** and incorporated by reference. Supremacy of HOA Rules In the event of any conflict between the terms of this Lease and the rules of the HOA, the stricter rule shall apply. If the HOA amends its rules during the lease term, Tenant must immediately comply with the new rules upon receipt of written notice. HOA Fines Tenant is financially liable for any and all fines, penalties, or assessments levied against the Landlord or the property by the HOA resulting from violations committed by the Tenant, their occupants, or their guests. These fines will be billed as additional rent. 3. STRICT NON-SMOKING CLAUSE (INSIDE UNIT) This property is a designated 100% non-smoking unit. Exterior / Balcony Boundaries: [x] Smoking is permitted ONLY on the balcony/patio, subject to strict HOA guidelines. Guest Liability Tenant is entirely responsible for the actions and compliance of all guests, invitees, triggers, and visitors. Remediation & Damages: If smoking inside the unit occurs, Tenant is fully liable for all remediation costs. This includes deep cleaning, chemical wash of walls, air duct ionization, repainting, and replacement of carpet, drapes, or blinds. Material Breach Any violation of this Non-Smoking Clause constitutes a material breach of the Lease and is immediate grounds for lease termination and eviction. 4. CONDO FEES & AMENITIES: Tenant has access to shared HOA amenities (pool). Landlord is not responsible for temporary closures of amenities by the HOA. Tenant access may be revoked by the HOA for rule violations. 5. TENANT MAINTENANCE RESPONSIBILITY & MINOR REPAIRS Tenant shall maintain the Premises in a clean, sanitary, and good condition. Minor Maintenance Under $100 Tenant is solely responsible for the cost and execution of any single, non-emergency repair or maintenance item that costs 100.00 or less** per occurrence. This includes, but is not limited to: replacing light bulbs, replacing HVAC air filters, clearing minor drain clogs (such as hair or food debris), replacing smoke detector batteries, and replacing broken appliance handles or knobs. Tenant shall not deduct these minor repair costs from the monthly rent. Major Maintenance & Reporting Landlord is responsible for major structural repairs, plumbing system failures, and the primary heating/cooling systems, provided the damage was not caused by Tenant misuse or neglect. Tenant must immediately report any maintenance issue exceeding $100.00 or any condition that could cause damage to the property (such as water leaks) to the Landlord in writing. Tenant Negligence Regardless of the repair cost, Tenant is 100% financially responsible for any repairs or maintenance required due to the negligence, misuse, or deliberate acts of the Tenant, occupants, or guests. 6. RIGHT OF ENTRY Landlord, Landlord's agent, or HOA maintenance personnel reserve the right to enter the Premises with a minimum of 24 hours' written notice for inspections, repairs, or to verify compliance with non-smoking policies, except in cases of emergency. 7. GOVERNING LAW This lease shall be governed, construed, and enforced in accordance with the laws of the State where the property is located.
