Lease terms

LEASE TERMS RENT PAYMENT Rent is due on the first (1st) day of each month and shall be paid by ACH transfer, Zelle, or another payment method approved by Landlord in writing. Tenant agrees to pay the full monthly rent when due. Partial payments will not be accepted without Landlord's prior written consent. Acceptance of a partial payment shall not constitute a waiver of any rights under this Lease. LATE PAYMENT OF RENT If rent is not received within five (5) calendar days after the due date, Tenant shall pay a late fee of $75.00. Any payment returned due to insufficient funds, stop payment, or other bank-related reasons shall be subject to a returned payment fee to the extent permitted by California law. Acceptance of a late fee shall not waive Landlord's right to require timely payment of rent or exercise any other rights provided by this Lease or applicable law. UTILITIES AND PARKING Landlord shall pay all HOA assessments and fees. Rent includes water, trash, natural gas, and two assigned parking spaces. Tenant is responsible for electricity, internet, cable (if desired), and any other services not specifically listed as included. The assigned parking spaces may not be transferred, rented, assigned, or otherwise provided for use by non-residents without Landlord's prior written consent. OCCUPANCY Only individuals listed on this Lease may reside in the premises on a permanent basis. Guests staying more than fourteen (14) consecutive days or more than thirty (30) total days in any twelve-month period must receive Landlord's prior written approval. PETS Pets are permitted only with Landlord's prior approval and an additional pet rent of $50 per month per approved pet. SMOKING Smoking and vaping are prohibited inside the unit and in any indoor common areas. HOA RULES AND REGULATIONS Tenant shall comply with all HOA rules, regulations, bylaws, parking restrictions, quiet hours, and community policies provided by Landlord, as amended from time to time. Tenant shall be responsible for any HOA fines, penalties, damages, fees, or costs resulting from violations committed by Tenant, occupants, guests, invitees, or pets. LAUNDRY ROOM AND GATE KEY One HOA-issued key is provided for access to the community laundry room and street gate. Tenant shall be responsible for a $150 replacement fee if the key is lost, damaged, or not returned at move-out, subject to HOA replacement costs. MAINTENANCE AND REPAIR REPORTING Tenant shall promptly notify Landlord of any condition requiring repair or maintenance, including but not limited to water leaks, plumbing issues, drainage problems, mold or mildew, appliance malfunctions, electrical issues, pest infestations, safety hazards, or any condition that could cause damage to the premises. Tenant shall take reasonable steps to minimize damage until repairs can be completed, including shutting off water when appropriate and immediately reporting emergencies. Tenant shall be responsible for damages resulting from failure to promptly report a maintenance issue or from negligence, misuse, or intentional damage caused by Tenant, occupants, guests, or pets. Tenant shall not make repairs, alterations, or improvements to the premises without Landlord's prior written consent, except in an emergency necessary to prevent immediate injury or significant property damage. WALLS AND ALTERATIONS Tenant may hang pictures, artwork, or similar decorative items using reasonable methods that cause minimal damage to walls. Any excessive wall damage, large holes, anchors, mounting hardware, shelving, televisions, or other fixtures installed by Tenant must be removed and repaired by Tenant before move-out. Tenant shall not paint, wallpaper, or otherwise alter the color or finish of any wall, ceiling, cabinet, or surface without Landlord's prior written consent. Any approved paint or alterations must be restored to the original color and condition before move-out unless otherwise agreed in writing by Landlord. LOCKS AND SECURITY Tenant shall not change, rekey, replace, or install any locks, security systems, or access devices without Landlord's prior written consent. Any approved lock changes shall require Tenant to provide Landlord with working keys or access codes. ACCESS TO PREMISES Landlord may enter the premises in accordance with California law for inspections, repairs, maintenance, improvements, or to show the property to prospective tenants, purchasers, lenders, contractors, or as otherwise permitted by law. Except in emergencies, Landlord shall provide any notice required by California law before entering the premises. RENTER'S INSURANCE Renter's insurance is strongly recommended but is not required under this Lease. Tenant acknowledges that Landlord's insurance does not cover Tenant's personal property, vehicles, guests, or personal liability. Tenant is solely responsible for obtaining insurance coverage for personal belongings, temporary living expenses, and personal liability protection if desired. Landlord shall not be responsible for loss of or damage to Tenant's personal property resulting from fire, water leaks, theft, vandalism, power outages, natural disasters, or other causes except as required by law. MOVE-OUT CONDITION Upon termination of the Lease, Tenant shall surrender the premises in clean condition, free of trash and personal belongings, and in substantially the same condition as received, excluding ordinary wear and tear. Tenant shall clean all appliances, cabinets, countertops, sinks, bathrooms, floors, and other interior surfaces before vacating the premises. Any cleaning, repair, hauling, key replacement, HOA-related charges, or damage beyond ordinary wear and tear may be deducted from the security deposit as permitted by California law. SUBLEASING AND ASSIGNMENT Tenant shall not sublease, assign, transfer, or otherwise permit occupancy by any person not listed on this Lease without Landlord's prior written consent. EARLY TERMINATION Tenant may request to terminate this Lease before the expiration of the lease term by providing at least thirty (30) days' written notice to Landlord. Tenant shall remain responsible for rent and all lease obligations until the earlier of: (a) the expiration of the Lease term, or (b) the commencement date of a replacement tenant approved by Landlord, as required by California law. Landlord shall make reasonable efforts to re-rent the premises as required by California law. Tenant shall pay an early termination fee equal to one month's rent to help cover advertising, screening, administrative expenses, and turnover costs associated with reletting the unit. Any prepaid rent or security deposit shall be handled in accordance with applicable law and may not be applied toward the early termination fee unless otherwise permitted by law.
