RESIDENTIAL LEASE AGREEMENT Property: 8712 Privet Drive, North Chesterfield, VA 23237 This Residential Lease Agreement ("Agreement") is entered into between Landlord: __________________________ and Tenant(s): __________________________. 1. Lease Term The initial lease term shall be twelve (12) months, beginning on ______________ and ending on ______________. Upon expiration of the initial term, this Agreement shall automatically continue on a month-to-month basis unless terminated in accordance with this Agreement and applicable Virginia law. 2. Rent Tenant agrees to pay monthly rent of $2,400.00. Rent is due on the 1st day of each month. Rent is considered late beginning on the 6th day of the month. Any applicable late fees shall be charged only as permitted by Virginia law. 3. Move-In Funds Before receiving possession of the property, Tenant shall pay: First month's rent: $2,400.00 Last month's rent: $2,400.00 Security deposit: $2,400.00 Total amount due at lease signing: $7,200.00 4. Security Deposit The security deposit shall be held and administered in accordance with the Virginia Residential Landlord and Tenant Act. Deductions may be made for unpaid rent, damages beyond ordinary wear and tear, cleaning, or other amounts permitted by law. 5. Non-Smoking Policy This is a 100% smoke-free property. Smoking or use of any smoking or vaping product is prohibited inside the home, garage, storage sheds, on the decks, or in any enclosed area on the property. This prohibition includes, but is not limited to: Cigarettes Cigars Pipes Marijuana or cannabis products Electronic cigarettes (e-cigarettes) Vape pens and vaping devices Any other smoking or inhaled combustible products Any damage or excessive cleaning required due to smoking or vaping may be deducted from the security deposit in addition to any other remedies available under the lease or applicable law. 6. Fireplace The fireplace is decorative and may not be used for wood-burning fires. Burning wood, paper, cardboard, trash, or any combustible material in the fireplace is prohibited. 7. Maintenance and Entry Landlord may enter the property for inspections, repairs, maintenance, or to show the property. Except in emergencies or as otherwise permitted by law, Landlord will provide at least 72 hours' notice before entering for routine maintenance or inspections. 8. Lease Violations If Tenant violates any provision of this Agreement, Landlord may provide written notice identifying the violation. Where Virginia law allows an opportunity to cure, Tenant shall have 30 days to correct the violation, or the period otherwise required by law. Failure to cure may result in termination of the lease and eviction proceedings in accordance with Virginia law. 9. Non-Renewal After the initial 12-month lease term, this Agreement shall continue on a month-to-month basis unless either party provides at least 60 days' written notice of termination, subject to any notice requirements under applicable Virginia law. 10. Tenant Responsibilities Tenant agrees to: Keep the property clean and sanitary. Promptly report maintenance issues. Properly care for the irrigation system. Maintain the home, decks, and storage sheds in good condition. Replace HVAC filters as recommended. Not make alterations without Landlord's written approval. Comply with all applicable laws and any homeowners' association rules, if applicable. 11. Default Failure to pay rent or comply with this Agreement may result in notices of default, termination of the tenancy, and eviction proceedings as permitted by Virginia law. 12. Entire Agreement This Agreement represents the complete understanding between the parties. Any amendments must be in writing and signed by both Landlord and Tenant. Occupancy and Guests Only the individuals named as Tenants in this Lease Agreement are authorized to occupy the property as their primary residence. All adult occupants (18 years of age or older) must be listed on the lease and approved by the Landlord prior to occupying the premises. No Tenant may permit any other person to become a resident of the property without the Landlord's prior written approval. Unauthorized occupants may constitute a violation of this Lease Agreement. Guests are permitted for occasional visits. Any guest who remains at the property for more than fourteen (14) consecutive days, or more than twenty-one (21) days in any twelve-month period, must receive the Landlord's prior written approval before continuing to stay at the property. If the Landlord approves an additional occupant, the occupant may be required to complete a rental application, pass any required screening, be added to the lease, and pay any additional rent or fees permitted by law before occupying the property. Failure to comply with this section shall constitute a lease violation and may result in notices and remedies as provided by this Lease Agreement and applicable Virginia law. 14. No Subletting or Assignment Subletting is strictly prohibited. Tenant shall not sublease, rent, license, assign, transfer, or otherwise permit any portion of the premises to be occupied by any person who is not an approved Tenant named in this Lease Agreement. Tenant shall not advertise or offer the property, or any portion of the property, for short-term rental or vacation rental purposes through platforms such as Airbnb, Vrbo, or any similar service. Any attempted sublease, assignment, or unauthorized occupancy without the Landlord's prior written consent shall be considered a material breach of this Lease Agreement and may result in termination of the tenancy and other remedies available under Virginia law. No provision of this Lease shall be interpreted as granting Tenant the right to assign this Lease or sublet the premises. 15. Property Upkeep and Maintenance Tenant agrees to keep the home, yard, decks, storage sheds, and all exterior areas in a clean, safe, and well-maintained condition throughout the lease term. Tenant shall: Maintain the lawn, landscaping, and irrigation system in a reasonable manner unless otherwise agreed in writing. Keep the property free of trash, debris, and excessive clutter. Promptly report maintenance issues or repairs needed to prevent further damage. Replace HVAC air filters as recommended by the manufacturer or Landlord. Maintain cleanliness of all appliances, plumbing fixtures, and interior surfaces. If Tenant fails to maintain the property after receiving written notice and a reasonable opportunity to correct the issue, Landlord may arrange for the necessary maintenance or cleanup. Tenant shall be responsible for reimbursing the Landlord for the actual and reasonable cost of such services, plus any amounts permitted by applicable Virginia law. These costs shall be considered additional rent and shall be due upon demand or with the next monthly rent payment, as permitted by law. Damage resulting from Tenant's negligence, misuse, or failure to maintain the property may also be deducted from the security deposit, subject to applicable Virginia law. 16. Utilities and Services Tenant shall be solely responsible for establishing, transferring into Tenant's name, maintaining, and paying for all utilities and services associated with the property for the entire term of the Lease. Unless otherwise agreed in writing, Tenant shall be responsible for, including but not limited to: Electricity Water Sewer Trash and recycling services (if billed separately) Internet/Wi-Fi service Cable television, streaming, and other media services Telephone service, if desired All required utility accounts shall be transferred into the Tenant's name no later than the Lease commencement date and shall remain active through the end of the tenancy. Tenant shall arrange for utility service to remain active until possession of the property has been surrendered and all keys, garage door openers, and access devices have been returned to the Landlord. Tenant shall provide proof of utility account activation upon Landlord's request. Any interruption of utility service due to Tenant's failure to establish or maintain service shall constitute a lease violation. If the Landlord incurs any costs because utilities were not transferred, disconnected prematurely, or left unpaid, Tenant shall reimburse the Landlord for those actual costs and any other amounts recoverable under applicable Virginia law.
