Security deposit, first, and last month's rent due at lease signing. The rent is due monthly, on or before the 1st day of each month. Rent is to be collected using CashApp or Zelle transaction for documentation purposes. Tenants will have a late extension period until the 5th day of the month to make a late rent payment, which will also include a late fee. Payments in full not received by the 5th day of the month may result in termination of lease agreement with 7 days notice to vacate. The tenants will need to collect and remove their belongings from the rental property no later than the 7th day after termination of lease date. Otherwise, tenant belongings may be subject to forfeiture. Renter expectations and requirements for renewal: 1. Tenant has followed rental agreement and expectations as detailed in this agreement during rental period. 2. Tenant adheres to the following expectations: No damage to rental property including furnishings and/or appliances. No complaints from HOA. No smoking (including vaping or tobacco pipes of any type) inside the rental property. Use of garage with fresh air ventilation is acceptable. No illegal drugs of any kind on property. No subletting or additional tenants without landlord approval. Tenants pay for water and utilities. Property issues will be identified and addressed by tenant, not deferred. Tenants are required to carry home warranty plan and are responsible for deductibles. Front and back yard to be maintained by tenants. Yard should be cut, edged, raked of leaves, and trash/debris picked up. Air conditioner/heater maintenance including filter and vinegar treatment. Dryer maintenance including cleaning lint vents, traps, and hoses. Garage and driveway should be protected from major fluid drips and stains. Non-compliance may result in non-renewal of rental agreement/contract. Rental property issues should not be deferred so as to minimize larger issues. Tenant is required to get renter's insurance and carry a home warranty plan during the entirety of the rental period. Home warranty deductibles are the tenants' responsibility. Cost of major foundation, plumbing, and HVAC issues (ie. replacements) not covered by the tenant's home warranty will be worked out with landlord. For major issues not covered by home warranty, initial assessments and 3 estimates are required of the tenant. Water and utility bills are not included in the rent. Landlord has the right to stop by to assess property periodically (as needed). Tenants will be required to provide landlord 30-day notice to vacate in writing or electronically before the end of the rental agreement. Otherwise, at the end of the rental period, a month to month agreement will begin automatically with the same payment structure as long as there are no tenant violations. A new contract will not be required for month to month as long as there are no concerns. At the time of lease renewal or during month to month leasing, landlord reserves the right to modify rent amount or lease terms with 30-day notice to tenants. Once agreement/contract is terminated at end of rental period with proper notice or due to termination based on stipulations above, security deposit will be returned in full within 30 days of move out less: Any outstanding rent and late fees including final rent payment if 30 day notice to move out is not provided or termination of lease (eviction) has occurred. Cost of damages to property Outstanding fees associated with HOA violations or similar Cost of door knobs/keys replacement if necessary Cleaning and property disposal costs Any topics not explicitly covered in this contract may be addressed in the Property Code Laws. This agreement/contract is intended to be binding and enforceable.
