Lease terms

Occupancy & Application Requirements To ensure a fair and consistent application process, all prospective occupants age 18 or older must complete a rental application and authorize a credit, background, and identity verification screening, as permitted by applicable federal, state, and local laws. Applications are evaluated using consistent, objective screening criteria, which may include: * Verification of identity. * Credit history and overall financial responsibility. * Rental history, including previous landlord references when available. * Verification of income or other lawful proof of ability to pay rent (generally a combined gross monthly income of at least three (3) times the monthly rent, or another verifiable source demonstrating the ability to meet the rental obligation). * Background screening, to the extent permitted by applicable law. * Accuracy and completeness of the information provided in the application. Additional occupancy requirements include: * All occupants age 18 or older must be listed on the application and lease agreement. * Occupancy limits will comply with applicable federal, state, and local laws. * A completed lease agreement, payment of the required security deposit, and first month's rent (or other amounts due at move-in) are required before occupancy. * Applicants must comply with all lease terms, community rules (if applicable), and applicable laws throughout the tenancy. All applications are reviewed using the same objective criteria and without regard to any protected characteristic under applicable law. Subletting, Assignment & Unauthorized Occupancy This Lease is personal to the Tenant(s) identified in the Lease Agreement. Tenant shall not assign this Lease, sublet, license, advertise, or otherwise transfer all or any portion of the Premises, whether for compensation or without compensation, without the Landlord's prior written consent, which may be granted or withheld in the Landlord's sole discretion, except as otherwise required by applicable law. The Premises may be occupied only by the individual(s) approved by the Landlord and identified in the Lease Agreement. No additional occupants may reside at the Premises without the Landlord's prior written approval. The listing, advertising, or offering of the Premises, or any portion thereof, on any short-term rental or vacation rental platform (including, but not limited to, Airbnb, Vrbo, Furnished Finder, Booking, Craigslist, Facebook Marketplace, or similar platforms) by the Tenant is strictly prohibited. Any unauthorized assignment, subletting, licensing, or occupancy shall constitute a material breach of this Lease and may result in termination of the tenancy and any other remedies available to the Landlord under applicable law. Acceptance of rent from any unauthorized occupant shall not be deemed consent to any assignment, sublease, or occupancy unless expressly acknowledged by the Landlord in a written agreement. Please Note Any application fee charged will comply with California law and will be used only to recover the actual costs of screening and processing the application.
