Lease terms
Security Deposit. Tenant has deposited with Landlord the sum of $2,800.00 (the "Security Deposit"), as defined in 92.102, Texas Property Code. No interest or income will be paid to Tenant on the Security Deposit. Tenant must give Landlord at least thirty (30) days' advance written notice of surrender as a condition for refund of the Security Deposit. Early Termination. Tenant may terminate this Lease before the expiration date only by: (i) giving Landlord at least 60 days' advance written notice; (ii) paying all rent due through the termination date; and (iii) paying an early termination fee equal to two (2) months' rent ($5,600.00) on or before the termination date. This fee is liquidated compensation for re-letting costs and lost rent, not a penalty, and does not limit Tenant's liability for property damage. Statutory early-termination rights (family violence, military deployment/transfer, certain offenses) are preserved. Renewal. Tenant may request renewal by written notice at least 30 days before the expiration date; renewal is subject to Landlord's written approval and any revised terms offered by Landlord. Pets. Pets are permitted only with Landlord's prior written approval of each pet (maximum 2). Each approved pet requires a non-refundable pet fee of $350.00 before occupancy and monthly pet rent of $50.00. Pet damage is not normal wear and tear. Unauthorized pets incur $100 per pet per month until removed or approved. This clause does not apply to service or assistance animals, for which no fee or pet rent applies. Guests. Guests may stay a maximum of 14 consecutive days without prior written notice to Landlord. Longer stays constitute unauthorized occupancy and a default under this Lease. Lawn Maintenance. Tenant is responsible for regular upkeep of the lawn and landscaping, including mowing, edging, trimming hedges and bushes, and maintaining outdoor areas, on at least a bi-weekly schedule during the growing season. Lawn condition must comply with HOA standards. Damage due to Tenant's neglect is Tenant's responsibility. Property Inspections. Landlord may conduct periodic inspections with at least 24 hours' notice to verify compliance with lease terms and maintenance standards. HOA Fees. Regular HOA assessments are paid by Landlord. Any HOA fines or charges incurred due to the actions of Tenant, Occupants, or their guests will be promptly reimbursed by Tenant. Hazardous Materials. Tenant will not store or use hazardous, flammable, or explosive materials on the property, except reasonable quantities commonly found in household products. Pest Control. Tenant must keep the premises clean to prevent pest infestation. Tenant is responsible for treatment costs unless the infestation is caused by structural conditions or other factors not attributable to Tenant's actions or negligence. Mold Notification. Tenant agrees to promptly report any signs of water intrusion, moisture buildup, or visible mold to Landlord. Landlord is not liable for damages resulting from Tenant's failure to notify or mitigate mold growth. Tenant will cooperate with remediation efforts as needed. Abandonment. If Tenant is absent from the premises for more than seven (7) consecutive days without prior written notice while rent is unpaid, the premises may be considered abandoned, and Landlord may take possession and remove Tenant's belongings in accordance with the Texas Property Code. Liability. Unless caused by Landlord, Landlord is not responsible to Tenant, Tenant's guests, family, or occupants for damages, injuries, or losses to person or property caused by fire, flood, water leaks, ice, snow, hail, winds, explosion, smoke, interruption of utilities, theft, burglary, vandalism, other persons, condition of the property, or environmental contaminants. Tenant will promptly reimburse Landlord for any damages caused by Tenant, guests, occupants, or pets, including cost of repairs. Insurance Disclaimer. Landlord is not responsible for loss or damage to Tenant's personal property. Tenant must maintain renter's insurance covering personal belongings and liability with limits of at least $200,000, naming Landlord as an interested party, with proof provided before move-in and upon request. Smart Home Devices. The property includes smart thermostats, sprinkler controller, video doorbell, and exterior cameras. Tenant will not remove, disable, or alter these devices without written consent. Landlord will remove the doorbell/cameras at Tenant's written request. Tenant acknowledges the water softener may reduce water pressure. Inventory & Condition. Tenant will complete and return an Inventory & Condition Form within five (5) days after move-in; otherwise the property is deemed in clean, safe, good working condition except as noted in writing.
