Move-In & Payments Prepaid Rent: Prior to move-in, Tenant shall pay the first full month's rent and the last month's rent of the Lease Term. These funds shall be applied to the specific months designated. Early Termination: If Tenant vacates the Property prior to the expiration of the Lease Term in violation of this Agreement, the prepaid last month's rent may be applied toward Landlord's actual damages, including re-letting expenses, subject to Landlord's duty to mitigate damages under Texas Property Code 91.006. Smoking Prohibitions: This is a 100% smoke-free property. Smoking or "vaping" (including but not limited to cigarettes, cigars, pipes, e-cigarettes, or any federally controlled substances) is strictly prohibited inside the Unit, on balconies, and in all common areas. Penalty: A violation of this policy shall be considered a material breach of the lease. Tenant shall be liable for a fine of $250 per occurrence and the full cost of odor removal and professional cleaning.
