Subletting: Subletting the property or any portion thereof (including via platforms like Airbnb or VRBO) is strictly prohibited without prior written consent from the Landlord. Utilities & Services Renter Responsibility: Renter is responsible for the timely payment of all utilities including water, sewer, trash, natural gas, electricity, and heating fuel. Account Setup: Renter must transfer all applicable utility accounts into their name effective as of the lease start date and provide proof of transfer to the Landlord prior to receiving keys. Winter Protection: To prevent pipe bursts, Renter must maintain a minimum indoor temperature of 55 F during winter months. Pre-Move-In Inspection (Mandatory) To ensure an accurate record of the property's condition and protect the Renter's security deposit, a mandatory "Baseline Condition Report" must be completed. Tenant Inspection: Within 48 hours of receiving keys and prior to moving any furniture into the home, the Renter is required to conduct a thorough walkthrough of the premises. Photo Documentation: Renter must take clear, high-resolution photographs of any existing imperfections, including but not limited to: Flooring: Scratches, scuffs, or discoloration on hardwood, tile, or laminate surfaces. Walls & Trim: Any chips in paint, nail holes, or scuff marks on baseboards. Appliances & Fixtures: Dents, scratches, or functional issues with provided appliances. Submission: All photos and a written list of noted damages must be sent to the Landlord via email or a shared digital folder within the 48-hour window. Effect of Non-Compliance: If the Renter fails to submit documentation within the specified timeframe, it shall be legally Conclusive Evidence that the property was received in "Excellent/Like-New" condition, and the Renter may be held liable for any damages discovered at the time of move-out. Renter's Insurance Requirement The Landlord's insurance policy does not cover the Renter's personal belongings or liability for accidents occurring inside the unit. Coverage: Renter is required to maintain a Renter's Insurance policy with a minimum of $100,000 in personal liability coverage. Verification: Proof of a valid policy must be provided to the Landlord prior to move-in and maintained throughout the duration of the lease. Maintenance & Property Care Minor Upkeep: Renter is responsible for basic "consumable" maintenance, including replacing light bulbs, smoke detector batteries, and furnace/AC filters (recommended every 3 months). Plumbing: Renter is responsible for costs associated with clearing plumbing clogs caused by the disposal of improper materials (e.g., "flushable" wipes, feminine products, or cooking grease). Alterations: No painting, permanent fixtures, or structural changes may be made to the property without express written permission from the Landlord. Exterior Maintenance Lawn & Garden: Renter is responsible for regular lawn mowing, weeding of flower beds, and watering of landscaping to maintain the property's curb appeal. Snow & Ice: Renter is responsible for the removal of snow and ice from all private walkways, stairs, and driveways within 24 hours of any snowfall event to ensure safe passage. Mandatory Radon Disclosure Landlord has provided Renter with the state-approved radon brochure and any known history of radon testing. Renter acknowledges the state's recommendation to have the property tested for radon. Bed Bug Disclosure Per Colorado law, Renter must notify Landlord in writing within 24 hours of any suspected pest infestation (including bed bugs). Landlord will arrange for an inspection within 96 hours of receiving written notice. Landlord Right of Entry The Landlord respects the Renter's privacy but reserves the right to access the property for essential business purposes. Notice: Landlord will provide at least 24 hours' notice prior to entering for routine inspections, necessary repairs, or showings to prospective tenants/buyers. Emergency Access: In the event of an emergency (e.g., fire, flooding, or gas leak), Landlord may enter the premises immediately and without prior notice to protect life and property. Security Deposit & Move-Out To ensure a full return of the security deposit, the Renter is expected to return the property in "Move-In Ready" condition, barring normal wear and tear. Cleaning Standards: Renter shall perform a professional-grade deep clean of the entire premises, including inside appliances (oven, refrigerator, microwave), cabinets, drawers, and windowsills. Flooring: All carpets must be professionally steam-cleaned, and hard flooring must be swept and mopped. Documentation of professional carpet cleaning may be requested by the Landlord. Repairs & Walls: All non-approved alterations must be reversed. Small nail holes must be patched and sanded; however, large holes or "anchor" holes must be professionally repaired and touch-up painted to match the original wall color. Personal Property: All personal belongings and trash must be removed from the interior, garage, and yard by the lease termination date. Any items left behind will be considered abandoned and disposed of at the Renter's expense. Final Inspection & Keys The official end of the tenancy is marked by the return of all access devices to the Landlord. Walkthrough: A final joint walkthrough will be conducted within 48 hours of the move-out date to document the property's condition. Key Return: Renter must return all sets of keys, garage door openers, and security fobs. Failure to return all keys will result in a fee for re-keying the property for security purposes. Deposit Return: The security deposit, minus any lawful deductions for unpaid rent, utilities, or repairs for damage exceeding normal wear and tear, will be returned to the Renter within 60 days after the termination of the lease or surrender of the premises, as specifically agreed upon in this lease agreement.
