Lease terms

Utilities, Pool Service, and Security Deposit Terms 1. Pool Service and Maintenance Owner shall provide routine pool maintenance service once per week at Owner's expense. Any additional pool service requested by Tenant, including but not limited to storm-related cleanings or special service visits, shall be billed directly to Tenant and considered additional rent. 2. Utilities Electric utility service shall remain in Owner's name. Tenant agrees to reimburse Owner monthly for all electric usage based on actual billing. Payment shall be due upon receipt of invoice and shall be considered additional rent. Use of the pool and/or spa (jacuzzi) heater will significantly increase electric usage, and Tenant acknowledges full responsibility for all associated costs. 3. Security Deposit The security deposit shall not be applied toward the final month's rent under any circumstances. 4. Condition of Premises and Furnishings The Premises are furnished and contain high-end finishes, including but not limited to marble surfaces and premium audio equipment. Tenant agrees to maintain the Premises in a clean and careful manner and to avoid any actions that may cause damage. Upon termination of tenancy, the Premises will be inspected. The security deposit will be refunded in accordance with Arizona law, less any deductions for damages beyond normal wear and tear. Tenant shall be responsible for damage caused by negligence or misuse, including but not limited to staining, etching, or permanent damage to marble surfaces caused by food, liquids, or improper care. 1. Assumption of Risk Tenant acknowledges that the Premises include a swimming pool and spa (jacuzzi), which may present inherent risks, including but not limited to drowning, slipping, falling, or injury. Tenant agrees to assume all risks associated with the use of the pool, spa, and surrounding areas. 2. No Pool Fence / Not Child-Safe Tenant acknowledges that the pool area is not separately fenced and that the property is not designed or represented as child-safe. Tenant accepts full responsibility for supervising all occupants and guests, including minors, at all times. 3. Slip and Fall Hazard Tenant understands that pool decks, patios, and surrounding surfaces may become slippery when wet. Tenant agrees to use caution and to ensure that all occupants and guests exercise reasonable care to prevent slip-and-fall injuries. 4. Diving Board Not in Use Any diving board, if present, is not operational and is strictly prohibited from use. Tenant agrees to ensure that no occupant or guest uses or attempts to use the diving board under any circumstances. 5. Patio Doors / Access Points Tenant acknowledges that patio and exterior doors are not equipped with automatic closing or child-safety mechanisms. Tenant accepts full responsibility for securing all doors and monitoring access to the pool area. 6. Indemnification Tenant agrees to indemnify, defend, and hold harmless Owner from any and all claims, liabilities, damages, or expenses arising from the use of the pool, spa, or surrounding areas by Tenant, occupants, or guests, including claims resulting from injury, death, or property damage.
