RESIDENTIAL LEASE AGREEMENT FOR SINGLE-FAMILY DWELLING One-Year Term | State of Georgia, USA 1. LEASE AGREEMENT Landlord hereby leases to Tenant and Tenant leases from Landlord all that tract or parcel of land, with such improvements as are located thereon, the residential property located at: 70 Driskell Ave SW, Mableton, GA 30126, together with all the fixtures, landscaping, improvements, and appurtenances, all being hereinafter collectively referred to as "Leased Property" or "premises". INCLUDED as part of the Leased Property (if present): all attached light fixtures and bulbs including ceiling fans; permanently attached plate glass mirrors; heating, cooling, and plumbing fixtures and equipment; all doors, storm doors and windows; all window treatments (e.g. shutters, blinds, shades, curtains, draperies) and hardware; all wall-to-wall carpet and hardwood flooring; range; all built-in kitchen appliances; all bathroom fixtures and bathroom mirrors; awnings; all landscaping and all outdoor lighting; mailbox. Tenant acknowledges that all included items are in good working order at the time of move-in except as otherwise noted. 2. LEASE TERM The term of this lease shall be for one (1) year, unless earlier terminated in accordance with the Lease Agreement. 2. RENTAL AMOUNT Tenant agrees to pay Landlord the total monthly rent of $2000 per month, due on the 1st day of each month. Rent shall be paid to the Landlord. If rent is not received by the 1st day of the month, a late fee of $50 will be assessed. 3. SECURITY DEPOSIT Tenant shall deposit with Landlord the sum of $2000 as a security deposit. This deposit will be held to cover damages (excluding normal wear and tear), unpaid rent, or other breach of this lease. The deposit will be returned within 30 days of the lease termination, less any lawful deductions, along with an itemized statement. If the premises are returned with damage beyond normal wear and tear, or if the Tenant breaches or terminates the lease early without proper notice and consent, the security deposit may be withheld in full at the Landlord's discretion. Tenant acknowledges and agrees that forfeiture of the security deposit does not relieve Tenant of liability for any additional damages or unpaid rent. 4. OCCUPANTS Only the following individuals may reside in the premises: Immediate Family Members (ie: spouse, children) No other individuals may occupy the premises without Landlord's prior written consent. 5. PROPERTY CONDITION Tenant acknowledges that Tenant has examined the premises, including appliances, fixtures, and systems, and accepts them in their current condition "as-is", except as otherwise noted in writing by the Landlord. Tenant agrees to keep the premises in a clean and sanitary condition and to promptly notify Landlord of any damage, defects, or needed repairs. A move-in inspection checklist will be completed by both parties at the start of the lease term. Tenant agrees to return the premises in substantially the same condition, except for normal wear and tear, at the end of the lease. 6. USE OF PREMISES The Premises shall be used solely for residential purposes. No commercial, illegal, or hazardous activity is permitted. 7. UTILITIES Tenant is responsible for the payment of all utilities, services, and fees related to the Premises, including: Electricity Water/Sewer Gas Trash Collection Internet/Cable Other: ____________________________ 8. MAINTENANCE AND REPAIRS Tenant agrees to keep the premises clean and in good condition and shall immediately notify Landlord of any damage or required repairs. Tenant shall be responsible for any damage caused by Tenant or their guests. 9. LANDLORD'S RESPONSIBILITIES Landlord agrees to comply with all applicable building and housing codes materially affecting health and safety; maintain in good and safe working order all electrical, plumbing, sanitary, heating, ventilating, and air conditioning systems supplied or required to be maintained by the Landlord; keep the roof, structural components, and foundation of the premises in good repair; provide access to essential services such as water and electricity, where such services are under Landlord's control; make necessary repairs not caused by Tenant's misuse or negligence within a reasonable time after receiving written notice from Tenant. Landlord shall not be liable for any loss or damage to Tenant's personal property unless caused by Landlord's gross negligence or intentional misconduct. 10. LAWN AND LANDSCAPING MAINTENANCE Tenant shall be solely responsible for maintaining the lawn and landscaping in a neat, clean, and well-maintained condition, including regular mowing, watering, weeding, leaf removal, and trimming of shrubs. Failure to maintain the lawn may result in charges for lawn service arranged by the Landlord. Tenant shall not make any major changes to the landscaping, including but not limited to removing or planting trees or shrubs, installing new garden beds, or applying herbicides or pesticides, without obtaining prior written approval from the Landlord. 11. ALTERATIONS Tenant shall not make any alterations, additions, or improvements to the premises without the prior written consent of the Landlord. 12. ENTRY BY LANDLORD Landlord may enter the premises for inspection, repairs, or showings with at least 24 hours' notice, except in case of emergency. 13. PETS Pets are allowed with written permission and a refundable pet deposit of $500. An additional pet fee of $75/month shall be assessed for approved pets. The deposit will not be refunded if there is any damage done to floors, carpets, walls, landscaping, or any other aspect of the dwelling by the pets or guest pets. 14. NO SMOKING POLICY Smoking of any kind, including but not limited to tobacco, marijuana, e-cigarettes, or vaping devices, is strictly prohibited inside the premises, garage, or any area within 25 feet of the building. This policy applies to tenants, occupants, guests, and visitors. Any violation of this clause will be considered a material breach of the lease and may result in immediate termination of the tenancy, cleaning fees, or other damages. 15. TERMINATION Upon expiration of the lease term, Tenant shall vacate the property unless this lease is renewed in writing. Tenant must give 30 days' written notice prior to move-out. In addition, Landlord may terminate this lease at any time if Tenant is noncompliant with or breaches any term or condition of this Agreement. Such termination shall be in accordance with applicable Georgia law and may include initiation of dispossessory (eviction) proceedings. 16. HOLDOVER TENANCY If Tenant remains in possession after the lease term without Landlord's consent, Tenant shall be liable for double rent as allowed under Georgia law (O.C.G.A. 44-7-32). 17. DEFAULT Failure by Tenant to pay rent or comply with any provision of this Agreement shall be grounds for termination. Landlord may initiate dispossessory proceedings under Georgia law if Tenant fails to cure the default after written notice. 18. GOVERNING LAW This Agreement shall be governed by the laws of the State of Georgia. 19. FIRE OR CASUALTY DAMAGE In the event the premises are damaged or destroyed by fire, storm, flood, or any other casualty not caused by the Tenant, to such an extent that the premises are rendered uninhabitable, either party may terminate this Lease by providing written notice to the other party. Rent shall be abated from the date of such damage or destruction. If only a portion of the premises is damaged and the remainder is usable, Landlord shall have the option to repair the premises within a reasonable time. Rent shall be reduced in proportion to the unusable portion of the premises during the period of repair. If the damage or destruction is caused by the intentional or negligent acts of the Tenant, Tenant shall be liable for the cost of repairs and rent shall not be abated. 20. INSURANCE Landlord's Insurance: The Landlord shall maintain fire and casualty insurance covering the structure of the leased premises. This insurance does not cover the Tenant's personal belongings or liability for accidents occurring within the premises. Tenant's Insurance: Tenant is required by Landlord to maintain a renter's insurance policy during the term of this lease. Such policy should provide coverage for: Loss or damage to Tenant's personal property Liability for injuries to guests or others occurring within the premises Temporary housing costs in the event the premises become uninhabitable Tenant understands and agrees that the Landlord shall not be liable for any damage, loss, or theft of Tenant's personal property, including from fire, water damage, natural disasters, or theft, regardless of cause. Proof of renter's insurance may be requested by the Landlord at any time during the lease term. 21. SUBLETTING AND ASSIGNMENT Tenant shall not sublet, assign, or transfer this Lease or any interest in the premises, in whole or in part, without the prior written consent of the Landlord. Any attempt to sublet or assign without such consent shall be void and shall constitute a material breach of this Agreement, potentially resulting in termination of the tenancy.
