TERM: The term of this Rental Agreement is for 12 MONTHS RENT: $ 1650.00, payable in advance, without demand, on the first day of each month. UTILITIES: Tenant is responsible for the electric, sewer, and water utility. GRACE PERIOD: If I fail to pay the rent within Ten (10) days after it becomes due and payable, I am in default. I will notify you of any escalation in insects or vermin in a timely manner and work with you in good faith to remedy the problem mutually. I will also comply with any insurance companies which have issued or are about to issue insurance policies covering this Property or its contents. I will not commit nor will I allow any guest to commit any illegal acts on the property or common areas. I will not allow any activity on the property or common areas which would be a nuisance or increase your insurance premiums. I will notify You in writing of any dangerous condition, deterioration or damage to the Property (including Common Areas, if any) so that You may make necessary repairs. I will be responsible for damage to the Property (including Common Areas, if any) caused by my action or inaction or that of my guests, invitees or visitors. I agree to indemnify, defend (with counsel of Landlord's choice), and hold You harmless for any liability, costs (including reasonable attorneys' fees), or claims resulting from my breach of this Lease or the negligence, violation of law, or willful misconduct of myself or my guests, invitees or visitors. You may execute any papers on my behalf as my attorney-in-fact to accomplish this. This is not applicable in this agreement per the #4 RENT terms allowing special emergency terms in the event of cost escalations. FIRE OR OTHER CASUALTY: My duty to pay rent may be reduced by fire or other casualties not caused by my negligence or willful act. I will not be required to pay rent while my enjoyment of the Property is substantially impaired. I may also leave the Property and end this Agreement as of the day I leave. I must notify you of this in writing within 14 days. You will then return all rent due to me. I may also vacate any unusable part of the Property. My rent would be reduced to the extent that the fair rental value is reduced. SECURITY DEPOSIT: I have deposited $ _1700.00___________ with you as security that I will live up to all of the terms of this Agreement. If I do not break any of the terms of this Agreement, you will return this deposit and any interest due within 30 days after I vacate the premises or within 15 days of receipt of my written notification of my new address, whichever is later, as provided by law. You may apply as much of the deposit as necessary to reimburse you for any damage resulting from my occupancy aside from normal wear and tear as discussed in section CARE OF PROPERTY. LATE CHARGE: If you have not received the full amount of any of my monthly rental payments by the Tenth day after the due date, I will pay a late charge equal to Five (5%) Percent of the monthly rental payment to you. If the bank does not honor my check, I will pay to you a $50.00 service charge for each occurrence in addition to any other charges which may be incurred. PAYMENT OF COSTS AND EXPENSES: If I am in default of this Agreement, you will have the right to be paid back for all of your costs and expenses including reasonable attorney's fees as allowed by law. RENTAL APPLICATION: I agree that you may cancel this Agreement if I have made an incorrect, untrue, or misleading statement on the attached Rental Application. INTEREST ON UNPAID CHARGES: I am responsible and liable for interest on any unpaid rent, costs, fees, expenses, and other charges allowable, including damages, if any, at 15% per annum. RULES AND REGULATIONS: I must observe the Tenant's Rules which are attached to and are a part of this Agreement. I understand that you made these Rules, according to the law, for the safety, care, cleanliness and good order of the Property. DAMAGE AND INSURANCE: You will not be responsible for any loss to personal property due to fire, theft, water or any other damage. Also, you will not be responsible for damage or injury caused by the carelessness or improper conduct of others. I understand it is my responsibility to maintain renter=s insurance to protect my property and/or other interests. VALIDITY OF AGREEMENT: If any part of this Agreement is against the law, the rest of this Agreement will remain in full force.
