Minimum 1 year lease RESIDENTIAL RENTAL AGREEMENT & DEPOSIT RECIEPT As of ___________ Red Door Rentals of Lafayette LLC hereinafter referred to as Lessor lease unto Lessee(s) The 1st floor dwelling located at: 612 Harding St Apt A, Lafayette, La 70503 for the sum of seventeen hundred dollars ($1700.00) monthly. 1. Term: The term hereof shall commence on ____________ and continue until __________ at 12 pm 2. Rent: Rent shall be paid in advance on the 1st day of each month to owner (Lessor) 1. Lease: Lessee's may not break the rental agreement for any reasons accept under the conditions provided under Louisiana law. Lessor will hold Lessee responsible through legal process for lost rent and or damages to property. At the conclusion of 12 months rental period and any time thereafter, Lessor has the right to evaluate and subsequently raise monthly rental rate. Lessor must advise Lessee twenty-one (21) days in advance of rental rate increase. If Lessor wishes to terminate this rental agreement at any time, he will provide Lessee with (21) days written notice. 2. Deposit: Lessee(s) places seventeen hundred dollars, ($1700.00) Dollars as damage, abnormal wear & tear, and unpaid rent/utility deposit, receipt of which is acknowledged here by Lessor. If Lessee breaks this lease abandons the premises or is evicted from premises this will result in loss of deposit. Security deposit not applicable towards last month's rent. Deposit is to be returned, less any deductions, upon termination of this tenancy, provided keys to property are returned to Lessor, premises are left in acceptable condition, and said Lessee, members of his family, friends, servants, agents or pets have caused no damage to property (except usual deterioration) and owes no rents, utilities, late charges or penalties to Lessor. 3. Repairs: No repairs shall be due Lessee by Lessor except to the roof, leaks from windows & doors, and necessary repair of HVAC, refrigerator, range & washer/ dryer, If an appliance is damaged by Lessee(s) and rendered nonworking due to same it will not be replaced or repaired by Lessor. 4. Damage: Lessee agrees to report to Lessor any damage to the leased premises within twenty-four (24) hours of its occurrence or discovery, and upon his failure to do so; Lessee shall be bound to repair any consequent or resulting damage. Any major damages or difficulties or anything that may cause further damage (such as a plumbing leak) must be brought to the Lessor's attention immediately. 5. Late Fee's: Lessee hereby agrees that in the event said rent is not paid when due or within three (3) days thereafter, Lessee shall pay a late fee of Fifty dollars ($50.00) Dollars flat until the 7th day of the month and ($5.00) per day thereafter, until paid in full. 6. Multiple Occupancy: It is expressly understood that this agreement is between the owner & each signatory jointly and severally in the event of default by any one signatory each & every remaining signatory shall be responsible for timely payment of rent & all other provisions of this agreement. 7. Utilities: Lessee shall be responsible for the payment of all utilities and services including electricity, water & gas. Lessee shall keep utilities on at all times. 8. Maintenance & Alterations: Lessee shall at his own expense & at all times maintain the premises in a clean & sanitary manner including all equipment & appliances & assumes responsibility of the proper maintenance of the property including mowing of yard. Lessee further assumes responsibility for repair of any damage caused by themselves, their guests and/or pets. In the event of freezing weather Lessee agrees to undertake precautionary measures such as dripping faucets to prevent damage from stoppage of sewer facilities or broken water lines. Lessee acknowledges that the premises are in good order & repair unless otherwise indicated herein. Lessee shall not alter, reconstruct or remodel or paint any parts of the premises without the Lessors permission. Lessee shall not commit any waste on said premises or any noise or nuisance act that may disturb the quiet enjoyment of any tenant in the building. 9. Sublease / Guest Policy: Lessee shall not lease, sublease, rent, loan or give access to the premises without the written permission of the Lessor. Lessee agrees that the total number of persons permanently residing in the dwelling shall be _____ Guests may stay no more than 14 days within 6 months or 7 nights consecutive nights. 12. Animals: __________________ Lessee(s) agrees to p/u dog waste, dog toys or leads/cables from yard or anything that could damage mower. 13. House Rules: In the event that the premises are a portion of a building containing more than one unit Lessee agrees to abide by all house rules, whether promulgated before or after the execution thereof including but not limited to rules with respect to noise, odors, disposal of refuse, animals parking and use of common areas. Take turns occasionally cleaning the laundry room. 14. Entry & Inspection: Lessor will have the right to enter the premises (a) in case of emergency (b) to make necessary or agreed repairs, alterations, supply necessary or agreed services, exhibit the premises to suspect or actual purchasers, mortgagees, tenants, workmen or contractors. (c) When tenant has abandoned or surrendered the premises. Except under (a) and (c) Entry may not be made other than normal business hours and without not less than 12 hours prior notice. 15. Indemnification: Owner shall not be liable for any damage or injury to tenant(s) or any other person, or to any property occurring on the premises or any part thereof or in common areas thereof unless such damage is the proximate result of the negligence or unlawful act of owner his agents or employees. Tenant agrees to hold owner harmless to any claims for damages, no matter how caused except for injury or damages for which owner is legally responsible. 16. Default: If Lessee shall fail to pay rent when due or perform any term hereof, after not less than 3 days written notice of such default given in the manner required by law, the Lessor at his option may terminate all rights of tenant hereunder, unless tenant within said time shall cure such default. If tenant abandons or vacates the property, while in default of the payment of rent, owner may consider any property left on the premises to be abandoned and may dispose of the same in any manner allowed by law. In the event that the owner reasonably believes that such abandoned property has no value, it may be discarded. All property on the premises is hereby subject to lien I in favor of the owner for the payment of all sums due hereunder to the maximum extent allowed by law. In the event of default by tenant, owner may elect (a) to continue the lease in effect and enforce all his rights and remedies hereunder, including the right to recover the rent as it becomes due, or (b) at any time terminate all of Tenants rights hereunder and recover from Tenant all damages he may occur by reason of breach of the lease, including the cost of recovering the premises and including the worth at the time of the of such breach of lease, including the cost of recovering the premises and including the worth at the time of such termination, or at the time of award if suit be instituted to enforce this provision of the amount by which unpaid rent for the balance of their term exceeds the amount of such rental loss which the Tenant proves to be reasonably avoided. 17. Additional Terms: Lessee agrees that outdoor areas of the premises and shared washroom will be kept clean and sanitary. Lessee agrees not to smoke inside the dwelling. Lessor agrees to maintain the yard with his equipment. Lessor will retain the right to tow away at owners expense abandoned or non-running vehicles. Parking for unit A is on the concrete driveway if you need additional parking you may use the space in the front to the LH side of concrete driveway, this space is guest parking for both units. Lessor will not allow school parking for your guests, only visiting guests. If pest control is needed Lessee agrees to pay the cost. 18. 5 Day Notice: In any case, Lessee hereby specifically waives the requirements for the five (5) day notice to vacate for non-payment of rent as set forth in the revised Civil Code of the State of Louisiana, (article 4701) and in the Code of Civil Procedure as they may be amended. 19. Return of Keys: Lessor may deduct from lessee security deposit $50.00 if keys are not promptly returned by lessee at the termination of the lease and/or whenever lessee vacates the premises whichever is sooner. 20. Renewal of lease: This contract will automatically renew for 1 year if no new contract is signed within 45 days of the expiration of the original contract or if lessee does not have in writing a 5 day notice to vacate. 21. Lockouts: Lockbox provided. If you get locked out and have no way to get in do not enter by breaking in door or through the window.
