Lease Terms for 4 Bed 2.5 Bath Property 1. Rental Property: The property located at 5927 S Challenger Way, St George, UT, 84790 consisting of four bedrooms and two and a half bathrooms. 2. Term of Lease: The term of the lease is 12 months or more 3. Rent Payment: The monthly rent for the property shall be two thousand four hundred dollars ($2,400), payable on the 1st of each month. Renters are responsible for all utilities (electricity, water, gas, internet, etc.) associated with the property. 4. Late Fees: A late fee of $150 shall be charged if the rent is not received by the 3rd of each month and $5 for every day after that where the rent is not paid 5. Pet Policy: Pets are not allowed on the Property unless authorized by the landlord(s) in writing, except for small dogs and guide dogs for physically disabled persons. If the landlord approves the dog, the tenant must complete a pet registration form provided by the landlord and pay all applicable deposits and fees required. The applicable pet deposit is $250 for any approved small dog (under 20 pounds) and $100 for each additional animal over 10 pounds (no more than 20 pounds). If the tenant violates the pet restrictions of this lease, the tenant will pay the landlord a fee of $1,500 per lease term for each violation of the pet restrictions, as additional rent for any unauthorized pet. Each animal shall constitute a separate violation. The landlord may remove or have removed any unauthorized pet and deliver it to appropriate local authorities or request local authorities to remove any unauthorized pet by providing written notice to the tenant. The tenant agrees that the landlord will not be liable for any harm, injury, death, or sickness to any unauthorized pet as long as the landlord has used reasonable and humane means to remove or cause any unauthorized pet to be removed. The tenant will be responsible and liable for any damage to the property or to others caused by any unauthorized pet and for all costs the landlord may incur in removing or causing any unauthorized pet to be removed. 6. Security Deposit: A security deposit of two thousand four hundred dollars ($2,400) shall be paid upon signing this lease. The security deposit will be held as security for any damages to the property beyond normal wear and tear. 7. Maintenance and Repairs: The landlord shall be responsible for major repairs and maintenance of the property. Renters shall promptly notify the landlord of any necessary repairs. 8. Governing Law: This lease shall be governed by the laws of the state of Utah. 9. Guests: Tenant will not permit any guest to stay in the Property longer than seven (7) days without Landlord's written permission. 10. Parking: Tenant will not permit more than two (2) Vehicles (including but not limited to automobiles, trucks, recreational vehicles, trailers, motorcycles, and boats) on the property unless authorized by the landlord in writing. Tenant will park vehicles in the driveway, in the garage, or on the street as permitted by local law and HOA rules. Landlord is not subject to any tow fees. Landlord may tow, at tenant's expense, for any improperly parked or inoperative vehicle on or adjacent to the property in accordance with applicable state and local law and HOA rules. 11. Access by Landlord: Landlord or anyone authorized by Landlord may enter the Property by reasonable means at reasonable times, without notice, to (1) inspect the Property for condition, (2) make repairs, (3) show the Property to prospective tenants, purchasers, governmental inspectors, fire marshals, lenders, appraisers, or insurance agents, (4) exercise a contractual or statutory lien, (5) leave written notices, or (6) seize nonexempt property after an event of default. Landlord shall make their best efforts to provide 24-hour prior written notice. 12. Move-In Condition: Tenant has inspected and accepts the Property as is except for conditions materially affecting the safety or health of ordinary persons or unless expressly noted otherwise in this Lease. Landlord has made no express or implied warranties about the condition of the Property and no agreements have been made about future repairs unless specified in this Lease. Tenant is advised to prepare a written document noting any defects in or damage to the Property and deliver it to Landlord within forty-eight (48) hours after the Commencement Date of this Lease. Tenant's failure to timely deliver the document will be deemed as Tenant's acceptance of the Property in a clean and good condition, with no defects or damage. Property Maintenance: (a) Tenant's General Responsibilities:Tenant will use reasonable diligence in the care of the Property and, at Tenant's expense, will be responsible for the following: 1. Promptly disposing of garbage only in appropriate receptacles and at regular intervals in compliance with the neighborhood's trash and recycling procedures. 3. Supplying and changing heating and air-conditioning filters at monthly intervals. 4. Supplying and replacing light bulbs and smoke-alarm batteries. 5. Eliminating any condition dangerous to health and safety caused by Tenant or Tenant's guests. 6. Cost of pest control. 7. Lost or misplaced keys. 8. Promptly notifying Landlord of needed repairs. (b) Yard Maintenance: Tenant shall mow and properly water all landscape. Tenant shall maintain hedges and shrubs in a neat and orderly manner in accordance with the homeowner association rules. (c) Proper Maintenance of the Overall Structure: Tenant shall properly maintain the overall structure of the edifice and maintain the general structure of the property. (d) Prohibited Acts by Tenant: Tenant will not, unless Landlord gives written permission, do the following: 1. Remove any part of the Property or any of Landlord's personal property for any purpose. 2. Remove, change, or rekey any lock. 3. Make holes in the woodwork, floors, or walls, except that a reasonable amount of small nails may be used to hang pictures in sheetrock or grooves in paneling. 4. Permit any water furniture in the Property. 5. Install new or additional telephone or television cables or outlets or alarm systems. 6. Replace or remove carpet, paint, or wallpaper. 7. Install, alter, or change any fixture. 8. Keep or permit any hazardous material on or near the Property, such as flammable or explosive materials that might cause any insurance coverage to be suspended or canceled or any premiums to be increased. 9. Dispose of any environmentally detrimental substance (such as engine oil or radiator fluid) on the Property. 10. Cause or allow any mechanic's or materialmen's lien to be filed against any part of the Property or Tenant's interest in this Lease. 11. Smoke, vape, or use e-cigarettes inside the Residence. 12. Remove any attachment inside or outside the property. 13. Paint or take down any wall or fence. 14. Use the garage for any purpose other than parking vehicles. Entire Agreement: This lease constitutes the entire agreement between the parties and supersedes all prior agreements and understandings.
