Lease terms

Terms: Renter agrees to pay the full monthly rent amount of $4650.0 on or before the first day of each month. If the renter should move out from the premises prior to the expiration of the 1-year lease, they shall be liable to pay 2 months of rent as early lease termination fee. The 1-year lease converts to a month-to-month lease after the 1st year, until 1) either party shall terminate this agreement by giving a written notice of intention to terminate at least 30 days prior to the date of termination OR 2) the owner and the tenant(s) enter into a new lease contract. Payments: Renter agrees to pay a security deposit of $4650.00 at the time of signing the rental lease agreement. Renter agrees to pay the first month rent of $4650.00 at least 30 days before the lease start date. Renter agrees to pay the second and the subsequent months rent of $4650.00 on or before the first day of each month. Security Deposit: The security deposit shall secure compliance with the terms and conditions of this agreement and shall be refunded to the resident within 14 days after the premises have been completely vacated less any amount necessary to pay the owner including but not limited to any unpaid rent, cleaning costs, key replacement costs, and cost to repair damages to premises above ordinary wear and tear. If deposits do not cover such costs and damages, the resident shall immediately pay said additional costs for damages to the owner. Late Charge: A late fee of $150.00 shall be added and is due for any payment of rent made after the 4th of the month. Utilities: Renter is responsible for all monthly utilities including gas and electric (PG&E), water bills (San Jose Water), WiFi Internet Access (Comcast, if needed), and Cable TV (if needed). Smoking: No Smoking Allowed Anywhere on the Premises. Pets: No Pets and/or animals of any kind are allowed Anywhere on the Premises, for any amount of time. Front and Back Yard care agreement: Tenant acknowledges that the Property includes a landscaped yard with lawn areas, automatic irrigation systems (front and rear), patio areas, and multiple fruit trees. Tenant agrees to maintain all outdoor areas in a clean, safe, and well-kept condition throughout the tenancy. Tenant may not cut, prune, or remove trees without written approval. If tenant fails or unwilling to maintain the yard, Landlord will provide a professional landscaping service at a cost of $80/month, payable by Tenant as additional rent. Assignment: Residents agree not to transfer, assign, Airbnb, or sublet the premises or any part thereof. Insurance: Residents acknowledge that owners insurance does not cover personal property damage caused by fire, theft, rain, war, acts of God, acts of others, and/or any other causes, nor shall the owner be held liable for such losses. Residents are hereby advised to obtain their own insurance policy to cover any personal losses.
