Lease terms
1. Renter's Responsibilities Tenant is responsible for all utilities, including but not limited to water, electricity, gas, internet, and trash services. Tenant must keep the property clean and sanitary, dispose of garbage properly, and maintain any required yard care. 2. No Smoking Policy Smoking (excluding vaping) is strictly prohibited inside the property. Any smoking-related damages (e.g., stains, burns, odors) will be deducted from the security deposit. 3. Renter's Insurance Tenant must provide proof of renter's insurance before move-in. 4. Income Verification Proof of income, such as pay stubs or bank statements, must be submitted prior to lease signing. 5. Pets Pets are allowed with a fee. If a pet is kept on the property, the tenant must have the house professionally cleaned upon move-out. Unauthorized pets will result in additional charges, including potential lease violations. 6. Security Deposit A $2,300 security deposit (equivalent to one month's rent) is required before move-in. The deposit will be refunded within 30 days after lease termination, pending property inspection and deduction of any damages, outstanding fees, or unpaid utilities. Deductions may include missing keys, extermination costs, unreturned garage remotes, damages beyond normal wear and tear, and unpaid rent. 7. Lease Duration & Renewal The lease term is 12 months unless otherwise specified. Automatic Renewal: If no written termination notice is given, the lease automatically renews on a month-to-month basis. Either party must provide at least 30 days' written notice to terminate. 8. Lease Termination & Early Move-Out Early Termination Fee: If the tenant terminates the lease before the agreed-upon end date, they will be responsible for a minimum $2,300 termination fee or more, at the owner's discretion, based on the terms agreed upon between the landlord and tenant. 9. Maintenance & Repairs Tenant's Responsibility: Tenant is responsible for general upkeep, such as replacing light bulbs, air filters, and smoke detector batteries. Landlord's Responsibility: The landlord will handle major repairs, including HVAC, plumbing, and structural issues. Repair Requests: All repair requests must be submitted in writing. Emergency repairs affecting health or safety should be reported immediately. 10. Late Payment & Returned Payment Fees Rent is due on the 1st of each month. If not received by the 5th, a $50 late fee applies, plus $25 per day thereafter (up to 30 days). Any returned payment will incur a $50 returned payment fee. 11. Lawn Care Tenant is responsible for lawn maintenance, including mowing, trimming, and weed control at least every two weeks. Tenant must also follow city water restrictions and ensure the foundation is watered properly. 12. Sprinkler System The property includes an automatic sprinkler system. Tenant must operate it properly and ensure it remains in good working condition. 13. Subletting & Assignment Subletting or assigning the lease is not permitted without the landlord's written consent. 14. Move-Out Requirements Tenant must leave the property in the same condition as received, free of trash, debris, and personal belongings. If the lease is violated or abandoned, the landlord has the right to dispose of any belongings left behind. 15. Holdover Rent If the tenant remains in the property beyond the lease term without renewal, rent increases to three (3) times the normal monthly rent, calculated daily. 16. HOA & Violation Fees If the property is part of a Homeowners' Association (HOA), the tenant must comply with HOA rules and pay any transfer fees required to place the HOA account in their name. Tenant Responsibility for Fees: If the owner is charged any fines, penalties, or fees by the HOA, city, or any governing body due to a violation that occurred during the tenant's lease period, the tenant is responsible for paying those fees, even if they are billed after move-out. 17. Access for Showings & Repairs Keybox Authorization: The landlord may place a keybox on the property for showings during the last 45 days of the lease. Landlord or authorized agents may access the property for repairs or showings with reasonable notice.
