Lease terms
1. PREMISES The premises leased is an apartment with two (2) bedrooms and one (1) bathroom located at 5238 W. Winona St., Floor 1, Chicago, Illinois 60630 (the "Unit"). The entire property wherein the Unit is located shall be referred to as the "Property," including all residential units, common areas, and any exterior areas associated with the Property. Parking is not included with the Unit, and street parking availability is not guaranteed by Landlord. The Unit includes the following appliances and amenities: Refrigerator Stove/Oven Access to shared washer and dryer facilities 2. AGREEMENT TO LEASE Landlord agrees to lease to Tenant and Tenant agrees to lease from Landlord, according to the terms and conditions set forth herein, the Unit. 3. TERM This Agreement shall begin on [AGREED DATE] and continue on a month-to-month basis until terminated by either Party. Any termination shall be made in writing and in accordance with all applicable Illinois and Chicago laws governing notice requirements. 4. RENT Tenant agrees to pay Landlord rent in the amount of One Thousand Seven Hundred Dollars ($1,700.00) per month (the "Rent"), payable in advance on the first (1st) day of each calendar month, 12:00 AM, during the Term. Rent shall be paid to Landlord at such address or by such method as Landlord designates. 5. LATE FEE If Rent is not received within five (5) days after its due date, Tenant shall pay a late fee of Thirty-Five Dollars ($35.00). 6. RETURNED PAYMENTS Tenant shall pay a fee of Thirty-Five Dollars ($35.00) for any returned check, rejected ACH payment, or other failed payment transaction. 7. MOVE-IN FEE Tenant shall pay a one-time, non-refundable move-in fee in the amount of Five Hundred Dollars ($500.00) prior to occupancy of the Unit. The move-in fee is intended to cover administrative, processing, and turnover costs associated with the commencement of tenancy and shall not be considered a security deposit. The move-in fee is non-refundable and shall not be returned upon termination of this Agreement, regardless of the condition of the Unit at move-out. 8. UTILITIES Tenant shall be responsible for payment of electricity, natural gas, cable, internet, and any other services separately billed to the Unit. Landlord shall be responsible for water, sewer, trash collection, and radiator heat (reword this with Nanay and Tatay) 9. OCCUPANCY The Unit shall be occupied solely by Tenant and no more than five (5) occupants in total. The Unit is a two (2) bedroom residence, and occupancy shall comply with all applicable laws and ordinances. 10. PETS No pets shall be permitted without the prior written consent of Landlord. Landlord may impose a non-refundable pet fee, monthly pet rent, restrictions, or other conditions at Landlord's discretion. 11. USE The Unit shall be used solely for residential purposes. Tenant shall comply with all applicable laws and shall not engage in any activity that disturbs other occupants of the Property. 12. MAINTENANCE AND REPAIRS Tenant shall maintain the Unit in a clean, sanitary, and safe condition and shall promptly notify Landlord of any maintenance issues. Tenant shall be responsible for any damage to the Unit caused by Tenant or Tenant's guests beyond normal wear and tear. Landlord shall be responsible for maintaining the structural elements and major systems of the Property in compliance with applicable law. 13. ALTERATIONS Tenant shall not make any alterations, additions, or improvements to the Unit without the prior written consent of Landlord. 14. ENTRY Landlord may enter the Unit upon providing notice of not less than forty-eight (48) hours, as required by applicable law, for inspection, maintenance, repairs, or to show the Unit to prospective tenants, purchasers, contractors, or lenders. Landlord may enter without prior notice in the event of an emergency. 15. SUBLEASING Tenant shall not assign this Agreement or sublease the Unit without the prior written consent of Landlord, which consent shall not be unreasonably withheld. 16. DEFAULT Any failure by Tenant to pay Rent when due or to comply with any term of this Agreement shall constitute a default. Upon default, Landlord may exercise any remedies available under Illinois law. 17. MOVE-OUT Upon termination of this Agreement, Tenant shall vacate the Unit, remove all personal property, return all keys, and leave the Unit in clean condition, reasonable wear and tear excepted. Any personal property left behind after Tenant vacates may be handled by Landlord in accordance with applicable law. 18. SMOKING Smoking, vaping, and the use of cannabis or tobacco products is prohibited inside the Unit and all indoor common areas of the Property. 19. KEYS AND LOCKS Tenant shall be responsible for the cost of replacing lost keys, access devices, or lock changes requested by Tenant. Tenant shall not install or change any locking device without prior written approval from Landlord. 20. RENTERS INSURANCE Tenant is encouraged to maintain renter's insurance covering personal property, liability, and other losses. Landlord shall not be responsible for loss of or damage to Tenant's personal property except as required by law. 21. JOINT AND SEVERAL LIABILITY If more than one Tenant signs this Agreement, each Tenant shall be jointly and severally liable for all obligations under this Agreement, including Rent, damages, fees, and compliance with all lease terms. 22. GOVERNING LAW This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois. 23. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between the Parties and supersedes all prior understandings, negotiations, or agreements, whether written or oral.
