One year Lease. If opting out prior to lease agreement you will lose your deposit. LATE CHARGES If tenant fails to pay any installment of rent or any other amount within five days of the date the same is due, tenant shall pay the late payment charge equal to 5% of the base monthly rent. USE NO SMOKING in the apartment. The premises shall be use solely as private residence by TENANT and occupancy shall be limited to tenant. Tenant agrees to comply with all present and future in-laws ordinance and regulations of any public authority relating to the use of this premise. Tenant shall not make or permit any noise or offense of use of the premise or allow any nuisance or use which might interfere with the enjoyment of other tenants or neighbors. Tenant will not permit any hazardous act or use of the premise which might increase the cost of fire insurance or caused the cancellation of such insurance. Tenant will not make or permit any waste on the premises tenant will not permit any liens or encumbrances to be placed on the premises. UTILITIES Tenant will pay for all utilities and services furnished to the first floor premises. And including minimal shared usage of well pump & water conditioner,(that Supplies both first and second floor). Energy usage by downstairs tenant is less than 75KWH/month or 5 therms/month. Thermostat must be maintained at a minimum 55 . Tenant shall pay for garbage pick-up. Tenant shall have garbage and recycles removed from the property monthly. Shoveling sidewalk is tenants responsibility . More then an inch Driveway will be shoveled or plowed by landlord. MAINTENANCE & CONDITION Tenants acknowledges they have examine the premises and they are in a good and habitable condition. Tenant shall keep the premise in a clean and sanitary condition and in as good order and repair as they were at the commencement of the lease. Ordinary wear and tear expected. Tenants shall use all fixtures appliances and facilities in a reasonable manner. Tenants shall dispose of all garbage in designated disposal facilities. Tenant will pay for all damage to the premises and repairs required due to the miss use or negligence of tenants or tenants guest. Landlord will maintain the premises in a habitable condition. Landlord and tenant each agreed to maintain and repair the premises in compliance with all laws, ordinances and regulations to them. ALTERATIONS Tenants shall not deface the premises or make any alterations additions or improvements without on each occasion obtaining the prior written consent of the landlord. Unless otherwise agreed in writing all alterations and additions and improvements shall become the property of the landlord and shall remain on the premise at the expiration or termination of this lease provided however, landlord has the option to require tenants to remove any such operations additions or improvement and restore the premise to its former condition. SUBORDINATION OF LEASE: this lease is subject and subordinate to all present and future mortgages, trust deeds and other security instruments that may be placed on the premises. Although no further act by tenants is necessary to accomplish the above tenant agrees to sign any other instruments subordinating this lease as landlord may responsibly request. MAINTENANCE & CONDITION Tenants acknowledges they have examine the premises and they are in a good and habitable condition. Tenant agrees to keep dehumidifier running at 50% humidity when outdoor temperatures reach 70 degrees(typically when indoor heat is not nessisary May-September).
