Lease terms
Lease Term The lease shall begin on the agreed-upon commencement date and continue for the term specified in the lease agreement unless terminated in accordance with District of Columbia law. Monthly Rent Rent shall be due on the 1st day of each month. Rent received after the 15th day of the month shall be considered late and may be subject to any late fees permitted under District of Columbia law. Rent shall be paid by the method designated by the Landlord. Security Deposit A security deposit equal to the amount stated in the lease is due at the time of lease signing. The security deposit will be held and returned in accordance with applicable District of Columbia laws, less any lawful deductions for unpaid rent, damages beyond normal wear and tear, or other permitted charges. Utilities The Tenant shall be solely responsible for establishing and paying all utility services during the lease term, including but not limited to: Electric Gas Water and Sewer (if applicable) Internet Cable Any other utility services serving the property unless otherwise stated in writing. Lawn and Exterior Maintenance The Tenant agrees to: Maintain the lawn, landscaping, flower beds, and exterior grounds in a neat and orderly condition. Remove trash and debris from the property. Keep sidewalks, walkways, and outdoor areas reasonably clean. Comply with all District requirements regarding snow and ice removal, if applicable. Routine Property Inspections The Tenant agrees to allow the Landlord to conduct a routine maintenance inspection every ninety (90) days. Except in emergencies, reasonable advance notice will be provided in accordance with District of Columbia law. Maintenance Reporting The Tenant shall promptly report any maintenance issue or damage. All non-emergency maintenance concerns must be reported within 72 hours of discovery. Failure to timely report damage that results in additional deterioration may make the Tenant responsible for resulting repair costs to the extent permitted by law. Repairs The Tenant shall: Keep the premises clean and sanitary. Promptly notify the Landlord of plumbing leaks, electrical issues, HVAC concerns, roof leaks, appliance failures, or other conditions requiring repair. Not perform repairs or alterations without the Landlord's prior written approval. Pets A maximum of two (2) pets is permitted. Each pet must: Weigh 40 pounds or less at full maturity. Be properly licensed and vaccinated. Be supervised at all times. Not create excessive noise or nuisance. The Tenant is fully responsible for any damage caused by pets and agrees to pay all associated repair costs. Alterations The Tenant shall not paint, remodel, install fixtures, mount televisions, install satellite dishes, or otherwise alter the property without the Landlord's prior written consent. Occupancy Only individuals listed on the lease may occupy the premises. No subleasing or assignment is permitted without the Landlord's prior written consent. Smoke and Carbon Monoxide Detectors The Tenant agrees to: Test detectors periodically. Replace batteries when necessary (unless prohibited by law or otherwise provided by the Landlord). Immediately notify the Landlord if any detector is not functioning. Illegal Activity The premises shall not be used for any unlawful activity or any activity that disturbs neighboring residents. Insurance The Tenant is strongly encouraged to obtain renters insurance. The Landlord's insurance does not cover the Tenant's personal belongings. Entry by Landlord The Landlord may enter the premises for inspections, repairs, maintenance, or to show the property to prospective purchasers or tenants by providing notice as required under District of Columbia law, except in emergencies where immediate entry is permitted. Damage The Tenant shall be responsible for damage caused by the Tenant, household members, guests, or pets beyond normal wear and tear. Abandonment If the property appears abandoned, the Landlord may proceed in accordance with applicable District of Columbia law. Default Failure to pay rent, maintain the premises, comply with lease obligations, or otherwise breach the lease may constitute default and may result in remedies available under District of Columbia law, including termination of the tenancy. Move-Out Requirements Upon termination of the lease, the Tenant shall: Return all keys, garage openers, and access devices. Remove all personal belongings. Leave the property in broom-clean condition. Dispose of all trash. Return the property in substantially the same condition as received, excluding ordinary wear and tear. Governing Law This lease shall be governed by the laws of the District of Columbia. Any provision inconsistent with District of Columbia law shall be interpreted or modified to comply with applicable law without affecting the remaining provisions of the lease. Additional Protective Provisions for the Landlord Any waiver of a lease provision must be in writing and signed by the Landlord. Failure by the Landlord to enforce any lease provision on one occasion shall not constitute a waiver of future enforcement. The Tenant is responsible for the conduct of all guests and invitees. The Tenant shall not store hazardous or flammable materials on the property except for ordinary household products. The Tenant shall immediately notify the Landlord of any notices from government agencies, insurance claims, or legal actions affecting the property. The Tenant agrees to comply with all homeowners' association or community rules, if applicable. Attorney's fees and court costs may be awarded as permitted under District of Columbia law. These terms provide a balanced lease while protecting the property owner's interests and remaining compatible with typical District of Columbia residential leasing requirements. For maximum legal protection, it's advisable to have the final lease reviewed by a D.C. real estate attorney or use a D.C.-specific lease template with these custom provisions incorporated. Lease Renewal This lease shall automatically expire at the end of the stated lease term unless renewed by mutual written agreement of both the Landlord and Tenant. The parties agree that the lease is intended to be renewed on an annual (12-month) basis, subject to satisfactory tenancy, compliance with all lease terms, and applicable District of Columbia law. At least 60 days before the lease expiration date, the Landlord will notify the Tenant whether the lease will be offered for renewal and, if applicable, provide any updated lease terms, including rent adjustments. Any renewal must be executed in writing and signed by both parties before the commencement of the new lease term. Note: Under District of Columbia law, residential leases often convert to a month-to-month tenancy if neither party signs a new lease and the tenant remains in possession. If your intent is to require a new one-year lease each year, you should have the final lease reviewed by a D.C. real estate attorney to ensure the provision complies with D.C.'s tenant protection laws and any applicable rent stabilization requirements.
