Lease agreement for the duration will be month-to-month with the possibility of renting for six (6) months. * October 1st through March 30th * * Any cleaning and damage to the property, may be deducted from the $2,000 Security/Damage Deposit. * Restrictions: 1) SMOKE-FREE PREMISES ADDENDUM A) Smoking Prohibition: Smoking is strictly prohibited inside the rental unit at all times. This prohibition applies to the Tenant, members of Tenant's household, and all guests or visitors. B) Definition of Smoking: "Smoking" is defined as the inhaling, exhaling, burning, or carrying of any lighted or heated cigar, cigarette, pipe, hookah, or any other lighted or heated tobacco, cannabis, or plant product. This definition also explicitly includes the use of e-cigarettes, vaporizers, and all other electronic delivery systems. C) Outdoor Restricted Zone: Smoking is strictly prohibited outdoors anywhere within ten (10) feet of all entryways, openable windows, doors, and the HVAC/ventilation system of the rental unit. D) Tenant Liability: Tenant shall be held entirely responsible for any damage, deodorizing, painting, or cleaning costs resulting from a violation of this policy. A breach of this addendum constitutes a material breach of the Lease Agreement and is grounds for immediate termination of tenancy and eviction. 2) NO PETS POLICY ADDENDUM A) Strict Prohibition: No pets or animals of any kind including but not limited to dogs, cats, birds, fish, reptiles, rodents, or insects are permitted on or inside the leased premises at any time. This restriction applies permanently to the Tenant, members of Tenant's household, and all guests, visitors, or invitees. B) No Guest Pets: Pets belonging to guests or visitors are strictly prohibited from entering the property, even for short visits, temporary babysitting, or outdoor yard stays. C) Prohibition of Animal Care Supplies: The presence of animal shelter structures, crates, food bowls, or pet food on the premises will be considered prima facie evidence of a violation of this policy. D) Tenant Liability and Breach: Any unauthorized animal found on the property constitutes a material breach of the Lease Agreement. Tenant will be liable for all costs related to defleaing, deodorizing, carpet cleaning, or repairing any damage caused by the animal. A violation of this addendum is grounds for immediate termination of tenancy and eviction. E) Legally Protected Animals: This policy does not apply to legally recognized Service Animals or Emotional Support Animals (ESAs) as defined by the Fair Housing Act (FHA) and Americans with Disabilities Act (ADA). Tenant must submit proper documentation from their physician and receive written approval from Landlord prior to bringing a protected animal onto the premises. 3) 55+ AGE-RESTRICTED COMMUNITY COMPLIANCE ADDENDUM A) Age Restriction Compliance: The leased premises are located within a 55+ age-restricted housing community operating under the federal Housing for Older Persons Act of 1995 (HOPA). Tenant warrants and represents that at least one permanent occupant of the premises is fifty-five (55) years of age or older as of the commencement date of this lease. B) Age Verification Requirement: Tenant must provide the Landlord with reliable, government-issued photographic proof of age (e.g., driver's license, passport) for all occupants prior to move-in. Tenant agrees to cooperate with all periodic age-verification surveys required by the Landlord. C) Underage Occupants and Guests: No person under the age of eighteen (18) may reside in the leased premises as a permanent resident, unless there is at least one permanent occupant of the premises who is fifty-five (55) years of age or older. D) Indemnification: Any violation of the community's age restrictions by the Tenant, household members, or guests constitutes a material breach of this Lease Agreement and is grounds for immediate eviction. Tenant shall indemnify and hold Landlord harmless from any fines or penalties levied by the HOA due to an age-restriction violation. 4) TENANT RESPONSIBILITIES AND MAINTENANCE CLAUSE A) Rent Payment and Due Date: Monthly rent is due in full on or before the first (1st) day of each calendar month. Rent must be paid via the designated payment method. B) Late Fee and Grace Period: If the full rent payment is not received by Landlord by 11:59 PM on the 1st day of the month, a daily late fee of $5.00 will be assessed immediately to the Tenant's account. Tenant acknowledges that this late fee constitutes liquidated damages intended to compensate Landlord for the administrative costs and inconveniences associated with late collection. C) Non-Payment and Eviction Notice: If rent remains unpaid past the due date, Landlord retains the right to issue a written 5-Day Notice to Pay or Quit in accordance with Arizona law (A.R.S. 33-1368(B)). Tenant can stop eviction proceedings only by paying all past-due rent plus the late fees outlined in this agreement prior to the expiration of the 5-day notice. D) Partial Payments: Landlord is under no obligation to accept partial rent payments. Accepting a partial payment does not waive the Landlord's right to collect the remaining balance or charge the late fees specified herein. E) Care and Cleanliness of Property: Tenant shall maintain the entire single-family dwelling, including yards, porches, and patios, in a clean, sanitary, and safe condition. Tenant is responsible for properly disposing of all trash, recycling, and waste into designated exterior receptacles on scheduled pickup days. Accumulation of garbage, debris, or unwashed dishes that creates foul odors, attracts pests, or creates an unsanitary environment is strictly prohibited and constitutes a material breach of this lease. F) Appliance and System Care: Tenant agrees to operate all electrical, plumbing, heating, ventilation, and air conditioning systems properly. Tenant must not flush anything down the toilets other than toilet paper. Tenant will be held financially responsible for plumbing blockages or appliance repairs caused by misuse, negligence, or foreign objects. G) Duty to Report Damages: Tenant must immediately notify Landlord of any defects, water leaks, roof issues, structural damage, broken windows, or malfunctioning major systems. Failure to promptly report a known issue makes the Tenant liable for any subsequent damage caused by the delay (such as spreading mold from an unreported leak). H) No Alterations: Tenant shall not paint, wallpaper, change or add locks, drive large nails into walls, or make any structural alterations to the interior or exterior of the property without explicit, prior written consent from the Landlord.
