HAMMOND, IN RESIDENTIAL LEASE AGREEMENT (Short Mid-Term Rental / Occupancy) This Lease is between Owner/Landlord: ______________________ and Tenant(s): ______________________. Property: ____________________________________________ (the "Premises") Term: From ___________ to ___________. 1. RENT Monthly Rent: $________ due by the ___ day of each month. Accepted payment: _____________________________________ Rent is late if not received by midnight on the due date. 2. LATE FEES & INTEREST Late Fee: $20 per day beginning the day after rent is due. Grace Period: 5 days to pay rent and any late fees. After Grace Period: 2% per month interest may be applied on amounts due upon demand. Nonpayment may be cause for termination and legal action. 3. SECURITY DEPOSIT Tenant shall pay a security deposit of $________ before move-in. Owner will comply with Indiana law on deposit use and return timelines. Owner may use deposit only for legally authorized purposes. Owner must return deposit or provide an itemized statement within 45 days after termination and return of possession. After that, Tenant is responsible for gas utilities, paid monthly, and any other utilities unless expressly agreed in writing. 5. USE OF PREMISES Residential use only; no commercial use, no business operations, no illegal activity. Premises must be kept neat, safe, and in compliance with Hammond property maintenance and city code standards. 6. OCCUPANCY LIMIT Maximum of Six (6) persons at any time. Only the following may reside here: Additional persons require written permission and may incur additional fees. Tenant is liable for all guests. 7. NO SUBLETTING No subleasing, assignment, or transfer of possession without Owner's written approval. 8. NO PARTIES & QUIET HOURS No parties allowed. Quiet hours: 10:00 PM 8:00 AM. Tenant shall comply with city noise and nuisance ordinances. 9. NO SMOKING No smoking or vaping inside the Premises. 10. PETS Pets are negotiable with prior written approval and may require a pet fee or deposit. 11. RIGHT OF ENTRY Owner may enter with at least 24 hours' notice for: Inspections Repairs Maintenance Showing the property Compliance with laws Emergency entry allowed without notice. 12. JOINT AND SEVERAL LIABILITY Tenants are jointly and severally responsible for rent, fees, damages, and other lease obligations. 13. LOCAL COMPLIANCE HAMMOND REGULATIONS Rental Registration: Property must be registered with the City of Hammond's rental registration program by April 15 each year and upon change of ownership. A small annual fee applies. Failure to register can result in significant fines and enforcement action. Short-Term Rental Considerations: If rented for short-term stays (commonly under ~30 days) or advertised on platforms like Airbnb/VRBO, additional zoning, permit, or licensing requirements may apply, including: Zoning compliance Permit or special use if not owner-occupied Safety features (smoke detectors, CO detectors, fire extinguishers) Providing a Good Visitor Guide and parking plan Noncompliance can lead to fines and possible suspension of permission to rent. 14. HOLDOVER / OVERSTAY If Tenant remains past lease expiration without written extension: Tenant pays $50 per day, and Owner may pursue eviction. 15. EARLY TERMINATION / BREAK FEE If Tenant ends the Lease early: Tenant remains liable for rent owed until re-rental or lease end. Tenant shall pay a lease break fee of $________ plus re-leasing costs. 16. LEASE TERMINATION BY OWNER Owner may terminate for: Nonpayment Lease violations Illegal conduct Unauthorized occupants Nuisance complaints or code violations Termination shall follow Indiana statutory requirements. 17. RENT ABATEMENT Rent will not abate unless Premises is legally uninhabitable under law. 18. INDEMNIFICATION Tenant shall indemnify and hold Owner harmless from claims, damages, liabilities, or expenses arising from Tenant's use of the Premises or Tenant's guests. 19. FORCE MAJEURE Owner shall not be liable for performance delays due to events beyond control. 20. SEVERABILITY If any provision is invalid, the remainder stays in effect. 21. GOVERNING LAW This Lease is governed by the laws of the State of Indiana. 22. ENTIRE AGREEMENT This document constitutes the full Agreement.
