Lease terms

Utilities: Renter is solely responsible for all utilities (including but not limited to electricity, gas, water, sewer, trash service if billed separately, internet, and any other services). ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Lawn Care & Exterior Maintenance: Renter is responsible for all routine lawn care and yard maintenance (mowing, weeding, edging, etc.). ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Trash & Recycling: Trash must be placed out for collection on the mornings of Monday and Thursday. Recycling must be placed out for collection on Wednesday morning. Renter is responsible for following all local collection rules and keeping the property free of overflowing or improperly stored trash/recycling. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Appliances: The following appliances are provided by the Owner and included with the rental: refrigerator, stove, and microwave. Owner is responsible for repairs to these included appliances arising from normal wear and tear or mechanical failure (not caused by Renter misuse or negligence). Any appliances owned or brought by the Renter are the sole responsibility of the Renter for maintenance, repair, and removal at the end of the tenancy. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Repairs & Damages: Renter is responsible for repairing (or paying for the repair of) any damages caused by the Renter, the Renter's guests, or the Renter's pets (ordinary wear and tear excepted). Owner is responsible for structural issues, plumbing (pipes), and electrical systems that arise from normal wear and tear, age, or defects not caused by the Renter. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Security Deposit: Renter shall pay a security deposit of $2,200.00 (equal to one month's rent) prior to taking occupancy. This deposit may be used by Owner to cover: Unpaid rent or other amounts owed under the lease Cost of repairing damage caused by Renter (or Renter's guests/pets) beyond ordinary wear and tear Reasonable cleaning costs if the property is not returned in a clean condition Any other charges permitted by law The security deposit is not an advance payment of rent and may not be applied by Renter toward the last month's rent without Owner's prior written consent. Within the time required by applicable law after Renter vacates and returns all keys, Owner will return the deposit (or the remaining balance) together with an itemized statement of any deductions. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Rent Payment & Late Fees: Rent in the amount of $2,200.00 is due on the 1st day of each month. A grace period of seven (7) days is allowed. If rent is not received by the end of the grace period (i.e., by the 8th of the month), a late fee of 5% of the monthly rent ($110.00) will be assessed. This is a one-time late fee per late payment and does not compound or accrue daily. Rent and late fees must be paid via provided payment portal. Any payment returned for insufficient funds or any other reason will incur a returned-payment fee of $30 (or the maximum allowed by law), in addition to any late fee that applies. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Notice & Access: Renter must promptly notify Owner (in writing preferred) of any needed repairs, leaks, or issues. Owner's right to enter the property with reasonable notice (typically 24 hours) for inspections, repairs, or showings, except in emergencies. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Insurance: Renter is required to maintain renters insurance covering personal property and liability, and to provide proof upon request. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Pets: Renter is permitted to keep the following pets on the Premises: One (1) large dog, or Two (2) small dogs, or Two (2) cats; and Any additional small pets that are fully contained in a cage, aquarium, terrarium, or similar enclosed environment (including but not limited to gerbils, hamsters, fish, non-venomous reptiles, and birds). No other free-roaming pets are allowed without Owner's prior written consent. Renter is fully responsible for any damage, odors, waste, or infestation caused by any pet (including contained pets), and for ensuring that contained animals remain securely confined. Any pet-related damage or excessive cleaning required beyond ordinary wear and tear may be deducted from the security deposit. Venomous, dangerous, or exotic animals that pose a safety risk are prohibited. For purposes of this Lease, a "small dog" means a dog that weighs twenty-five (25) pounds or less at maturity, and a "large dog" means a dog that weighs more than fifty (50) pounds at maturity. Mixed-breed or unknown-breed dogs will be classified by their actual adult weight. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Smoking: Smoking (including cigarettes, cigars, pipes, vaping, and similar products) is permitted on the Premises. However, Renter is solely responsible for any smoke-related residue, odor, staining, or damage to the property (including walls, ceilings, carpets, window coverings, HVAC systems, and other surfaces or fixtures). The cost of professional cleaning, deodorizing, or repairs needed to remove smoke residue or odor may be deducted from the security deposit. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Occupancy / Residents: The Premises is a single-family home. Permanent residents are limited to the individuals named on this Lease Agreement. No additional persons may reside at the property on a permanent or long-term basis without Owner's prior written consent. Temporary guests are permitted for short visits, provided the total number of occupants does not create overcrowding or violate any local ordinances. Guests staying longer than fourteen (14) consecutive days or more than thirty (30) days in any twelve-month period require Owner's written approval. Subletting, assigning the Lease, or allowing anyone else to occupy the Premises is prohibited without Owner's prior written consent. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Alterations & Improvements: Renter may not make alterations, paint, or install fixtures without prior written approval from Owner. Any approved changes become Owner's property unless otherwise agreed. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Additional Maintenance Clarifications: HVAC / Air Conditioning Owner maintains a service contract with A#1 Air for regular tune-ups and preventive maintenance of the air conditioning system. A reusable/cleanable air filter is provided. Disposable filters may also be used. The correct filter size is 20x20. Renter is responsible for cleaning or replacing the filter at regular intervals (recommended every 30 60 days, or more frequently if needed) to ensure proper airflow and prevent damage to the AC compressor or system. Failure to maintain the filter that results in damage to the HVAC system may be considered Renter-caused damage and charged accordingly. Smoke & Carbon Monoxide Detectors Renter is responsible for testing detectors regularly and replacing batteries as needed. Renter must immediately notify Owner if any detector is missing, damaged, or not functioning properly. Pest Control General pest control (including prevention and treatment for common household pests) is the responsibility of the Renter. Owner is responsible only for infestations that are structural in nature or pre-existing and not caused by Renter's actions or lack of sanitation. Other Routine Items Renter is responsible for routine upkeep such as changing light bulbs, keeping drains clear of hair and debris, and maintaining a reasonably clean and sanitary condition throughout the Premises. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Default and Termination The occurrence of any of the following shall constitute a default by Renter and a material breach of this Lease, entitling Owner to terminate the Lease and pursue all available remedies under Texas law, including eviction: Nonpayment of Rent Failure to pay rent or any other amount owed under this Lease when due (after the 7-day grace period). Under Texas law, nonpayment of even a single month's rent after proper notice is grounds for termination and eviction. No specific number of missed payments is required. Criminal Activity Any criminal activity by Renter, occupants, guests, or invitees on or near the Premises, including but not limited to drug-related activity, violence, theft, or any activity that threatens the health, safety, or peaceful enjoyment of others. Material or Repeated Lease Violations Any material violation of this Lease, or repeated minor violations after written notice from Owner. This includes (but is not limited to): -Unauthorized pets or occupants -Significant damage to the property beyond ordinary wear and tear -Failure to maintain the property in a clean and sanitary condition -Unauthorized alterations or improvements -Interference with the rights, comfort, or safety of neighbors -Failure to carry required renters insurance (if applicable) -Abandonment of the Premises -Holding over after the Lease term ends without Owner's written consent Other Serious Breaches Any other act or omission by Renter that substantially interferes with Owner's rights or the purpose of this Lease, or that creates a health or safety hazard. Notice and Cure Before filing an eviction lawsuit, Owner will provide written notice as required by Texas Property Code 24.005 (generally at least 3 days' notice to vacate, or a notice to pay rent or vacate when required for first-time nonpayment). The Lease may specify a different notice period where allowed by law. Certain serious breaches (such as criminal activity or threats to health/safety) may not require an opportunity to cure. Owner's acceptance of partial payment or delayed enforcement of any term does not waive Owner's right to enforce the Lease or pursue remedies for future or continuing defaults. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Lease Term and Renewal: This Lease is for a fixed term of one (1) year, beginning on _______________ and ending on _______________. Approximately thirty (30) days before the end of the Lease term, Owner and Renter will discuss whether the Lease will be renewed and on what terms. If no written renewal agreement is signed by both parties before the end of the term, the tenancy shall end on the stated expiration date and Renter shall vacate the Premises. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Abandoned Property: Any personal property remaining on the Premises after Renter has vacated and returned all keys shall be deemed abandoned. Owner may dispose of such property in any manner Owner deems appropriate, without notice to Renter and without any liability to Renter. Renter waives any claim to abandoned property and acknowledges that it is unrecoverable. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Early Termination: Renter may request early termination of this Lease. Any such request will be reviewed by Owner on a case-by-case basis and may be approved or denied at Owner's reasonable discretion. If early termination is approved.
