Lease terms

RECOMMENDED LEASE TERMS Lease Term: * 12-month lease. * Lease automatically converts to month-to-month after expiration unless a new lease is signed. Monthly Rent: * $5,000 due on the 1st of each month. * Late fee of 10% of monthly rent after a 5-day grace period. * Returned check fee: $50. Security Deposit: * $5,000 security deposit due before move-in. Occupancy: * Only approved occupants listed on the lease may reside in the property. * Guests staying longer than 14 consecutive days or 30 days in a year require written landlord approval. Pets: * Pets only with prior written approval. * Non-refundable pet fee and/or monthly pet rent as determined by landlord. * Tenant responsible for all pet-related damages. Utilities: * Tenant responsible for all utilities and services unless otherwise specified. Maintenance: * Tenant shall keep the property clean and sanitary. * Tenant shall promptly report maintenance issues. * Tenant responsible for damage caused by tenant, occupants, guests, or pets. Property Inspections: * Landlord may conduct routine property inspections every six (6) months with proper notice. * Additional inspections may be conducted as permitted by law. Alterations: * No painting, remodeling, satellite dishes, security systems, or major alterations without written landlord approval. Smoking: * No smoking or vaping anywhere on the property. Renters Insurance: * Tenant must maintain renters insurance throughout the lease term with minimum liability coverage of $100,000. * Proof of insurance required before move-in and upon renewal. HOA Compliance: * Tenant must comply with all HOA rules and regulations. * Fines caused by tenant violations shall be paid by tenant. Default and Nonpayment: * Failure to pay rent constitutes a lease violation. * Landlord may pursue eviction and all remedies allowed under New Mexico law. * Tenant responsible for court costs, attorney fees, and collection costs where permitted by law. Early Termination: * Tenant remains responsible for rent through lease expiration unless landlord approves an early termination agreement. * Early termination fee equal to two months' rent may apply. Property Sale Clause: * If landlord decides to sell the property during the lease term, landlord may show the property with proper notice. * Lease transfers to new owner unless otherwise agreed by both parties. Notice Requirements: * Tenant must provide at least 30 days written notice before vacating at lease end. * All notices must be in writing. Move-Out: * Property must be returned in substantially the same condition as received, excluding normal wear and tear. * Professional cleaning required at move-out. * All keys, remotes, and access devices must be returned.
