A 30-DAY NOTICE OF VACANCY MUST BE GIVEN TO RECEIVE BACK THE SECURITY DEPOSIT. SECURITY DEPOSIT CANNOT BE USED FOR LAST MONTH'S RENT. 1. LATE CHARGE: RENT IS DUE ON THE 1ST OF EACH MONTH. All payments shall be received no later than 5:00 pm on the 5TH day of each month, regardless of if that falls on a weekend or holiday, or a late fee of $25.00 shall be added and an additional fee of $5.00 per day shall be assessed until rent is paid in full including late fees accrued. If mailed, rent must still be received no later than 5:00 pm on the 5th of the month or late fees will be charged. IF RENT AND LATE FEES ARE NOT RECEIVED BY THE 15TH OF THE MONTH A 30 DAY EVICTION NOTICE WILL BE ISSUED FOR THE RESIDENT(S). IF RESIDENTS ARE TURNED OVER TO COLLECTIONS, RESIDENTS SHALL BE FINANCIALLY RESPONSIBLE FOR ALL DEBT COLLECTIONS SERVICE FEES. A fee of $50 shall be added to any payment of rent which a deficient (bounced) check shall have been given 2. SECURITY DEPOSIT FOR THIS PROPERTY IS $1500.00 1. SECURITY DEPOSITS: The total of the above deposits shall secure compliance with the terms and conditions of this agreement and all but $100 will be refunded to RESIDENT within 30 days after the premises have been completely vacated less any amount necessary to pay OWNER: a) cleaning costs; b) key replacement costs; c) cost for repair of damages to premises and/or common areas above ordinary wear and tear, or cleaning costs related to removing residue from smoking inside the unit and d) any other amount legally allowable under the terms of this agreement; e) Resident must have completed lease in entirety; f) Resident must give a 30 day written notice of vacating: EVEN IF LEASE IS FULFILLED g) Resident must schedule a walk through on day of move out to determine amount of security deposit that will be refunded, complete the move out checklist and must be completely vacated and walk through completed by the date Resident entered as their last day on the 30 day notice or Resident shall forfeit complete deposit. If deposits do not cover such costs and damages, the RESIDENT shall immediately pay said additional costs for damages to OWNER. Residents may not apply security deposit to last month's rent or to any unpaid rent and or late fees. 2. UTILITIES: RESIDENT agrees to pay all utilities and/or services based upon occupancy of the premises. 2.1. Liberty Utilities: for electric & water 2.2. TRASH SERVICE: You may use any company that you prefer. 3. SMOKING: NO SMOKING IS ALLOWED IN THIS UNIT. EVIDENCE OF SMOKING IN UNIT WILL MERIT COMPLETE LOSS OF DEPOSIT AND RESIDENT WILL BE HELD FINANCIALLY RESPONSIBLE FOR ALL COSTS OF SMOKE RESIDUE REMOVAL.THIS COULD INCLUDE REPLACING CARPET, REPAINTING WALLS AND CEILINGS AND CLEANING OF AIR DUCTS. 4. LIQUID FILLED FURNISHINGS: No liquid filled furniture, receptacle containing more than ten gallons of liquid is permitted without prior written consent and meeting the requirements of the OWNER. RESIDENT also agrees to carry insurance deemed appropriate by OWNER to cover possible losses that may be caused by such items. 5. DESTRUCTION OF PREMISES: If the premises become totally or partially destroyed during the term of this Agreement so that RESIDENT'S use is seriously impaired, OWNER or RESIDENT may terminate this Agreement immediately upon 3day written notice to the other. RESIDENT acknowledges that he/she has examined the premises and that said premises, all furnishings, fixtures, furniture, plumbing, heating, electrical facilities, all items listed on the attached property condition checklist, if any and/or all other items provided by OWNER are all clean, and in good satisfactory condition except as may be indicated elsewhere in this Agreement. RESIDENT agrees to keep the premises and all items in good order and good condition and to immediately pay for costs to repair and/or replace any portion of the above damaged by RESIDENT, his guests and/or invitees, except as provided by law. At the termination of this Agreement, all of the above items in this provision shall be returned to OWNER in clean and good condition except for reasonable wear and tear and the premises shall be free of all personal property and trash not belonging to OWNER. It is agreed that all dirt, holes, tears, burns, and stains of any size or amount in the carpets, drapes, walls, fixtures, and/or any other part of the premises, do not constitute reasonable wear and tear. 6. ALTERATIONS: RESIDENT shall not paint, wallpaper, alter or redecorate, change or install locks, install antenna or other equipment, large nails, or adhesive materials, place signs, displays, or other exhibits, on or in any portion of the premises without the written consent of the OWNER except as may be provided by law. Absolutely no use of any adhesive command strips or like products. Any damage done to the sheetrock by adhesive strips shall be the Resident's financial responsibility. Resident is allowed to hang things on the wall. Resident agrees to use the smallest nail possible for the job. 7. PROPERTY MAINTENANCE: RESIDENT shall deposit all garbage and waste in a clean and sanitary manner into the proper receptacles and shall cooperate in keeping the garbage area neat and clean. RESIDENT shall be responsible for disposing of items of such size and nature as are not normally acceptable by the garbage hauler. RESIDENT agrees to keep the inside and the outside of the premises clean and picked up. Trash is to be immediately and properly disposed of. No trash is allowed to sit outside. 8. PROPERTY MAINTENANCE: RESIDENT shall be responsible for keeping the kitchen and bathroom drains free of things that may tend to cause clogging of the drains. RESIDENT shall pay for the cleaning out of any plumbing fixture that may need to be cleared of stoppage and for the expense or damage caused by stoppage of waste pipes or overflow from bathtubs, wash basins, sinks or toilets. Resident is financially responsible for the plumbing bill for removal of foreign objects from bathtubs, wash basins, sinks or toilets. 9. PROPERTY MAINTENANCE: RESIDENT shall be financially responsible for replacing any garbage disposal that cracks. This happens when inappropriate items such as spoons, bottle caps, bones and etc are put into the disposal. The disposals will also struggle with any kind of vegetable peelings and pasta. The disposals will work best when: 1. Water is turned on first to run into the disposal. 2. Disposal is turned on with water running into it. 3. Then appropriate food items are slowly put through the disposal. 10. PROPERTY MAINTENCE: It is the Resident's responsibility to REPLACE the air filter each month. This will greatly reduce your electric bill. 11. PROPERTY MAINTENCE: It is the Resident's responsibility to replace burned out light bulbs as they burn out, and for window coverings, also to replace batteries as needed in the smoke alarms. If damage occurs to the property for nonfunctioning smoke alarms due to bad batteries, the Resident will be held liable. Resident is to immediately report nonworking smoke alarms that are not battery related. 12. POSSESSION: If OWNER is unable to deliver possession of the residence to RESIDENTS on the agreed date, because of the loss or destruction of the residence or because of the failure of the prior residents to vacate or for any other reason, the RESIDENT and/or OWNER may immediately cancel and terminate this agreement upon written notice to the other party at their last known address, whereupon neither party shall have liability to the other, and any sums paid under this Agreement shall be refunded in full. If neither party cancels, this Agreement shall be prorated and begin on the date of actual possession. 13. ABANDONMENT: If at any time during the term of this Agreement RESIDENT abandons the Premises or any part thereof, OWNER may, at OWNER'S option, obtain possession of the Premises in the manner provided by law, and without becoming liable to RESIDENT for damages or for any payment of any kind whatever. OWNER may, at OWNER'S discretion, as agent for RESIDENT, relet the Premises, or any part thereof, for the whole or any part thereof, for the whole or any part of the then unexpired term, and may receive an collect all rent payable by virtue of such re-letting, and, at OWNER'S option, hold RESIDENT liable for any difference between the rent that would have been payable under this Agreement during the balance of the unexpired term, if this Agreement had continued in force, and the net rent for such period realized by OWNER by means of such reletting. If OWNER'S right of reentry is exercised following abandonment of the Premises by RESIDENT, then OWNER shall consider any personal property belonging to RESIDENT and left on the Premises to also have been abandoned, in which case OWNER may dispose of all such personal property in any manner OWNER shall deem proper and OWNER is herby relieved of all liability for doing so. 14. INSURANCE: Resident is advised and understands and agrees that personal injury to, and damage or loss to the personal property of Resident, Resident's guests, Resident's family, invitees or other visitors in or on the premises IS NOT INSURED BY THE OWNER for either damage or loss, and the Owner assumes no liability for any such damage or loss. Resident is further advised that, if Resident desires insurance coverage. Resident should inquire of Resident's insurance agent regarding a renter's hazard and liability policy of insurance. Owner shall not be responsible for personal injury, or loss of food, clothing, furniture or any of Resident other possessions in the event of appliance failure, water leak, or water backup, bursting pipes, fire, loss of utility service or other events. In no event shall Owner be responsible for theft, vandalism or mysterious disappearance of Resident's property. Further if Resident, Resident's guests, invitees, or other visitors is damaged, for any reason whatsoever, Resident must give Owner written notice of the injury or damage within seven (7) days of occurrence, Resident is hereby advised to obtain a personal insurance policy to cover any personal losses, or to pay for damage done to the property by the Resident as well. 15. RENTER'S INSURANCE: Residents agree that if something happens with the property listed on this lease that the property owner's insurance does not cover loss of any of Resident's personal belongings. Renter's insurance is REQUIRED to cover all personal property and accidental damage to the property caused by Resident. Owner must be listed on the renter's insurance policy as an interest and at least $300,000.00 for personal liability is required. If the office receives notification that your renter's insurance has been cancelled or non-renewed OR WAS NOT PROVIDED before moving in there will be an additional $100 added to your monthly rent for each missing policy. 16. INDEMNIFICATION: OWNER shall not be liable for any damage or injury of or to the RESIDENT, RESIDENT'S family, guests, invitees, agents or employees or to any person entering the Premises or the building of which the Premises are a part or to goods or equipment, or in the structure or equipment of the structure of which the Premises are a part, and RESIDENT hereby agrees to indemnify, defend and hold OWNER harmless from any and all claims or assertions of every kind and nature. 17. RIGHT OF ENTRY AND INSPECTION: OWNER may enter, inspect, and/or repair the Premises at any time in case of emergency or suspected abandonment. OWNER shall give 24 hours advance notice and may enter for the purpose of showing the premises during normal business hours to prospective renters, buyers, lender, for smoke alarm inspections, and/or for normal inspections and repairs. OWNER is permitted to make all alterations, repairs and maintenance that in OWNER'S judgment is necessary to perform. We may periodically set up an appointment to do a walk through in the unit with you, while you live there. 18. ASSIGNMENT: RESIDENT agrees not to transfer, assign or sublet the premises or any part thereof. Any person, not on the lease staying in this unit more than 4 weeks over the age of 18, will need to fill out an application and be approved. 19. PARTIAL INVALIDITY: Nothing contained in this Agreement shall be construed as waiving any of the OWNER'S or RESIDENT'S rights under the law. If any part of this Agreement shall be in conflict with the law, that part shall be void to the extent that it is in conflict, but shall not invalidate this Agreement nor shall it affect the validity or enforceability of any other provision of this Agreement. 20. NO WAIVER: OWNER'S acceptance of rent with knowledge of any default by RESIDENT or waiver by OWNER of any breach of any term of this Agreement shall not constitute a waiver of subsequent breaches. Failure to require compliance or to exercise any right shall not be constituted as a waiver by OWNER of said term, condition, and/or right, and shall not affect the validity or enforceability of any provision of this Agreement. 21. ATTORNEY FEES: If any legal action or proceedings be brought by either party of this Agreement, the prevailing party shall be reimbursed for all reasonable attorney's fees and costs in addition to other damages awarded. 22. JOINTLY AND SEVERALLY: The undersigned RESIDENTS are jointly and severally responsible and liable for all obligations under this agreement. 23. REPORT TO CREDIT/TENANT AGENCIES: you are hereby notified that a nonpayment, late payment or breach of any of the terms of this rental agreement may be submitted/reported to a credit and/or tenant reporting agency, and may create a negative credit record on your credit report. 24. NOTICES: All notices to RESIDENT shall be served at RESIDENT'S premises. All notices to owners should be mailed to owners. 25. INVENTORY: Resident may use all appliances in unit. 26. ENTIRE AGREEMENT: This Agreement constitutes the entire Agreement between OWNER and RESIDENT. No oral agreements have been entered into, and all modifications or notices shall be in writing to be valid. 27. UNLAWFUL ACTIVITY: Unlawful use of or manufacturing of drugs on this property, underage drinking, domestic violence, criminal activity or involvement of police at this property will merit an eviction. 28. GRILLING: Grilling is allowed on this property. Grills shall not be used within 5ft of the house and 5ft away from any overhang of anytime. Any damage done to the property by grilling shall be the Resident's financial responsibility. 29. Resident acknowledges that this lease does offer a buyout clause. If Resident is unable to complete the length of the lease agreement, Resident forfeits complete deposit and SHALL pay a fee of $2500.00. If Resident does not pay the buyout, Resident shall be turned over to collection agency for full amount of remaining lease along with complete loss of deposit. This fee does not apply to any rent while Resident occupies unit. 30. Resident acknowledges that if evicted, Resident forfeits complete loss of deposit and shall be turned over to a collection agency for all rents, late fees, buyout clauses and damages owed. Resident acknowledges that credit score will be adversely affected if this occurs. 31. Resident acknowledges that there is a noise restriction at this property. Any noise or activity that disturbs the peace and quiet of their neighbor is considered a noise violation. 3 noise complaints will merit an eviction. 32. RESIDENT ACKNOWLEDGES THAT NO TRAMPOLINES, SWIMMING POOLS OR ANYTHING THAT MAY POSE A DANGER TO OTHERS AS WELL AS RESIDENTS ARE PERMITTED ON THE PROPERTY UNLESS IT IS ENCLOSED BY A FENCE. 33. Resident agrees to park on their side of the road not block the mailboxes. 35. This unit is capped at 4 residents. There is an additional $75 a month fee for the 4th roommate. They must also pass the application process and show proof of renter's insurance before they would be approved for move in.
