Terms at 3423 Mount Pleasant Ave

LEASE AGREEMENT This rental agreement is one full year agreement, during which the tenant agrees to pay the full amount due at the end of each month. The owner promises not to increase rent in the middle of the 12 months period. The owner will inform the tenant at least 60 days prior to increasing the monthly rent. Rent should be paid in full by the 5th of each month. A $100 penalty will be charged if the rent is not paid in full by the 5th of each month. This agreement shall be terminated if 3 late fees are not paid. The security deposit, the monthly rent payment and any penalty fee will be deposited in a bank account provided by the owner. The security deposit is to be deposited in the bank account provided by the owner prior to the tenant moving in. The security deposit will not be refunded if the tenant ends his/her rental agreement before the 12 months term, or if there is any property damage or equipment that needs to be repaired or replaced at the end of the term and the tenant does renew his/her lease. The security deposit will be refunded in full (+ bank earned interests) at the end of the 12 months term if the tenant does not renew his/her rental agreement. The security deposit shall be deposited in the tenant provided bank account after he/she moves out. No illegal activities are authorized on the property. Unacceptable behaviors such as excessive noise, large parties, drug dealing, underage drinking are strictly prohibited. Any such behaviors will result in an immediate termination of the lease agreement without refund. The tenant is not authorized to sublease the property. Such action will result in an immediate termination of the lease agreement without any refund. TENANT RESPONSIBILITIES The tenant is responsible for all utilities. This includes: water, electricity & gas, internet. The tenant will need to purchase a rental insurance prior to moving in. A copy of the rental insurance shall be provided to the owner prior to moving in. The list of all authorized adult occupants shall be provided to the landlord prior to moving in. The tenant should keep the property clean at all times. The tenant is responsible to repair any damage caused by neglect or abuse. Tenant should keep the property secure at all times. Tenant will be responsible for any vandalism or stolen item in the property due to negligence. Tenant should give a set of keys of any lock replaced (due to key lost) on the property, or contact the owner for a spare key. MAINTENANCE The landlord/owner of the property is responsible for the maintenance of the property. The landlord/owner shall maintain a livable property throughout the tenancy. The landlord shall complete necessary repairs not caused by the tenant (such as repairing a leaky roof, or fixing the heater) The tenant should contact the landlord/owner or his representative immediately if there is a structure issue that needs to be repaired as soon as he/she becomes aware of the problem. CITY RULES & REGULATIONS Tenant should use City provided trash and recycling containers to store the trash and the recycling materials. The trash and recycling containers should be placed at the point of collection on trash & recycling collection days. The tenant is responsible to keep the front, backyard of the property, and rear of the property clean at all times. The tenant will address/pay all sanitation, noise related citations issued during his/her stay. RIGHT OF ENTRY The landlord or his representative (technician who has to make a repair) can enter the property after providing a written notice at least 24 hours before entering the property under the following circumstances: During emergencies. To make repairs or assess the need for repairs. To inspect the premise for damage To show the premises to insurance or mortgage companies To investigate potential tenancy violations under the lease agreement To show the property to prospective tenants or prospective buyers To comply with local, state, or federal law such as to cooperate with law enforcement pursuant to a warrant by court order The landlord can enter the premises without notice under the following circumstances: When invited by the tenant. He reasonably believes that the property has been abandoned If he has taken legal steps, including timely written notices required to ensure abandonment When all applicable requirements for entry are met, the tenant cannot unreasonably deny entry to the landlord, but he/she can request entry moved to a different date. PARKING There is parking for regular size vehicles available in the rear of the property. It's accessible by the alley. Tenant should be careful not to hit neighbor's or owner's properties.
