Lease terms

1. Premises Landlord leases to Tenant the residential property located at 3260 Webb St Philadelphia PA 19134 ("Premises"). The Premises shall be used solely as a private residence. 2. Term The initial term begins [START DATE] and ends [END DATE], a fixed term of one (1) year. After the initial term, the Lease automatically continues on a month-to-month basis under the same terms until either party gives at least 30 days' written notice. 3. Rent Monthly rent is $1300, due on the 1st of each month, payable to [PAYEE] by [PAYMENT METHODS]. Rent received after 30 days incurs a late fee of $150. A fee of $50 applies to any returned/dishonored payment. 4. Funds Due at Signing Before taking possession, Tenant shall pay: first month's rent $1150 last month's rent $1150, and a security deposit $1150, totaling $3450. 5. Security Deposit Under Pennsylvania law (68 P.S. 250.511a 512), the security deposit may not exceed two months' rent during the first year of the lease, and may not exceed one month's rent after the first year. The deposit will be returned within 30 days after move-out and surrender of the Premises, accompanied by an itemized list of any deductions for unpaid rent or damage beyond normal wear and tear. If Tenant resides on the property more than five years, additional escrow/interest rules apply. Note on your terms: collecting first + last + a security deposit equal to one month already totals two months held as deposit-equivalent in year one PA's two-month cap counts the security deposit specifically, so make sure your security deposit alone stays within two months' rent. Last month's rent collected as prepaid rent is generally treated separately, but keeping the security deposit at or below two months' rent (one after year one) keeps you safely compliant. 6. Utilities Tenant is responsible for all utilities and services for the Premises, including but not limited to gas, water, electric, sewer, trash, and internet, and shall place all applicable accounts in Tenant's name and keep them active throughout the tenancy. 7. Occupancy The Premises shall be occupied only by Tenant(s) named above and: [NAMES/none]. Guests staying longer than [14] consecutive days require Landlord's written consent. 8. No Pets No pets or animals of any kind are permitted without Landlord's prior written consent. Service and assistance animals are accommodated as required by the Fair Housing Act. 9. No Smoking Smoking of any kind including cigarettes, cigars, vaping, and cannabis is prohibited anywhere on the Premises, including interior, balconies, and common areas. Violation is a material breach. 10. Maintenance and Repairs Tenant shall keep the Premises clean and sanitary, promptly report needed repairs, and pay for damage caused by Tenant, occupants, or guests. Landlord shall maintain the Premises in compliance with PA's implied warranty of habitability. Tenant shall not make alterations without written consent. 11. Landlord's Right of Entry Pennsylvania has no statute specifying a notice period for entry. Landlord shall provide at least 24 hours' notice for inspections, repairs, or showings, except in an emergency, when no notice is required. 12. Subletting and Assignment Tenant shall not sublet or assign the Premises without Landlord's prior written consent. 13. Renter's Insurance Tenant [is required / is encouraged] to maintain renter's insurance with at least $[AMOUNT] in liability coverage. 14. Default If Tenant fails to pay rent or violates any term, Landlord may pursue all remedies under Pennsylvania's Landlord and Tenant Act of 1951, including termination and eviction after proper notice (in PA, generally a 10-day notice to quit for nonpayment and 15/30-day notice for other breaches, unless the Lease specifies otherwise). 15. Quiet Enjoyment / Conduct Tenant shall not disturb neighbors or use the Premises for any unlawful purpose. 16. Surrender At end of tenancy, Tenant shall return the Premises in the same condition as received, normal wear and tear excepted, and return all keys.
