Lease terms

Utilities not included in rent. 1 year lease with the option to renew for an additional 12 months with mutual agreement, subject to a rent adjustment based on market conditions (not to exceed 5% annually). After the initial term, the lease may convert to month-to-month with 60 days' notice from either party and a 10% rent increase. A $2000 security deposit is due along with the first month's rent at the time of lease signing. Tenant must return the property in similar condition as received, excluding reasonable wear. Tenant Responsibilities: Tenant covers minor repairs, lawn care, pool maintenance, and all utilities (electricity, water, sewer, trash, internet). Landlord Responsibilities: Landlord covers major repairs (e.g., HVAC, roof, plumbing, structural issues), HOA and property taxes, unless damage is caused by tenant negligence. Pool Maintenance: Tenant must maintain the gunite saltwater pool per provided guidelines. Failure to maintain the pool may result in landlord arranging service at tenant's cost. Occupancy: Limited to the tenant, immediate family, or approved occupants. No Subleasing: Subleasing, short-term rentals (e.g., Airbnb), or unapproved occupants are prohibited without written landlord consent. Home-Based Business: Permitted if low-impact (e.g., remote work), compliant with local ordinances, and does not increase property wear or traffic. No Smoking: Smoking (including vaping) is prohibited indoors, on the screened porch, or near the pool area. Alterations: Tenant may not paint, remodel, or alter the property (e.g., walls, fixtures, pool, deck) without written landlord consent. Approved alterations become landlord property unless otherwise agreed. Minor Decor: Tenant may hang pictures with small nails, provided holes are repaired upon move-out. Tenant Insurance: Tenant must maintain renter's insurance with minimum coverage of $100,000 liability and $20,000 personal property, naming landlord as an additional insured. Landlord Insurance: Landlord maintains property and liability insurance, excluding tenant personal property. Landlord Access: Landlord may enter with 24 hours' notice for inspections, repairs, or showings (e.g., for future rentals or sale), except in emergencies (e.g., water leaks). Move-In/Move-Out Inspection: Tenant and landlord will document property condition within 7 days of move-in and at move-out to assess damages. Tenant Default: Failure to pay rent within 10 days of due date or breach of lease terms allows landlord to terminate the agreement and pursue eviction, per Georgia law (O.C.G.A. 44-7-50). Landlord Remedies: Unpaid rent, damages, and legal fees may be deducted from the security deposit or pursued separately. Early Termination: Tenant may terminate early with 60 days' notice and payment of 1.5 months' rent as a penalty. Landlord may terminate early only for cause (e.g., non-payment, lease violation). HOA Compliance: Tenant must comply with any applicable homeowner association rules . Move-Out Cleaning: Tenant must clean the property upon move-out .
