Terms at 29 Great Hill Rd

RENTAL AGREEMENT PARTIES. This Rental Agreement (hereinafter referred to as the "Agreement") entered on March 28, 2026 is made between "Tenant TBA" (hereinafter referred to as the "Tenant") and "NAME TBA" (hereinafter referred to as the "Landlord"), collectively referred to as the "Parties", hereby agree as follows: PREMISES. The rental property (hereinafter referred as the "Premises") is located at: 29 Great Hill Road, Sandwich, MA 02563 RENTAL TERM. The Rental Term shall begin on 10/01/2026 at 3PM and end on 9/30/27 at 10AM. If both Parties mutually agree, all terms of this Agreement may be extended on a month to month basis after the expiration of this lease. RENTAL RATE AND FEES RENTAL RATE. The base rent to be paid by the Tenant to the Landlord throughout the term of this agreement is $5,500/month, and if extended or adjusted equals to $183.33 per night. Monthly payments are due the 1st day in advance of each month. Late payments after 3 days may be charged a daily late fee of 5% of monthly rent. There is an optional private bedroom downstairs with a King sized bed and walk-in closet downstairs that is available for an additional $1,000/month. If included in the lease, the rental agreement would still be limited to a maximum of two tenants in the home. Currently it's used as storage for the Landlord, and if used by the Tenant, the Landlord would remove all of its contents. UTILITIES. Electricity, gas, trash, cable and internet are registered and paid by Tenant. (see b I below). Free utilities include water, hot water, and garbage. Free amenities include access to common areas swimming pool, jacuzzi and exercise room. Landlord pays home owner association and sewer fees. Tenant can activate an electricity account with Eversource at least one week prior to move-in. Gas is activated with National Grid. Internet and cable can be activated with Xfinity. FEES. The Tenant will be responsible for the following: Cleaning fee: $350 (Paid and held from previous agreement) Refundable Damage Deposit: $1000 (Paid and held from previous agreement) TOTAL DUE UPON SIGNING. Cleaning fee ($350), damage deposit ($1000) and first month full rent ($5,500). PAYMENT METHOD. Acceptable payment methods include Electronic Funds Transfer (EFT), Check, PayPal, Venmo, or Zelle. KEYS AND SECURITY. All keys are available at the beginning of the Rental Term at the Premises and shall be returned at the end of the Rental Term. Keys include the basement back door. Replacement fee is $75 per item if lost. SECURITY: The Premises has one external security camera at the front entry pointed only toward the driveway of the property, and one exterior camera pointed toward the back of the home. There is one sync module that connects the exterior camera to the internet and must remain plugged in at all times in the living room's outlet located behind the chest of drawers near the entry. The tenant may request additional cameras for their own private use. PETS. Only with prior permission from the Landlord, the Tenant may be permitted to have 1 small trained and well-behaved dog. The pet fee is an additional $15/day along with an additional $500 refundable damage deposit. PARKING. The Tenant is allowed to park a maximum of 2 cars on the property, and have up to 2 additional cars for short term guests of up to one week. All cars must be in working condition and free of leaking fluids. Parked cars must be kept at least 10 feet away from the edges of the hills at all times. TRASH DISPOSAL. Tenant is responsible for paying for a trash removal company for regular weekly pick-up. CONTACT INFORMATION. The Tenant may contact the Landlord or representative agent with questions or concerns during the Rental Term. A response is required within 48 hours of any written or verbal communication unless prior notification of unavailability is given. At most, 14 days of prior approved unavailability will be allowed. Contact Information TBA WAIVER. No delay or failure of the Landlord to enforce any part of this Agreement shall be deemed as a waiver thereof, nor shall any acceptance of any partial payment of rent or any other amount due be deemed a waiver of the Landlord's right to the entire amount due. SUBLETTING. The Tenant shall not sublet the Premises without the written consent of the Landlord. All subletting tenants are subject to same terms as the primary tenant. ENTRY. The Landlord shall have the right at all reasonable times during the term of this Agreement and any renewal thereof to enter the Premises for the purpose of any repair, modification, installation, inspection or other reasonable action, so long they provide at least twenty-four (24) hours' notice to the Tenant. MAINTENANCE. The Landlord is responsible for plumbing, electrical, appliance and other damage repairs not caused by the Tenant or caused through reasonable wear and tear. The Tenant shall maintain the premises in a reasonably clean, rentable, habitable and well-maintained condition, and use the premises in a careful and lawful manner. The Tenant shall report the need for any plumbing, electrical or safety repairs within 24 hours of the discovery of the issue to the Landlord. The Tenant is responsible for the scheduling of any repair or repair consultation, and if required by the repair company or Landlord, supervise such repairs. The Tenant shall pay for maintenance and repairs should the premises be left in a lesser condition at the end of the lease. The Tenant agrees that the Landlord shall deduct costs of said services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings. OCCUPANCY LIMIT. The rental rate is based upon a maximum occupancy of two (2) occupants. Exceeding occupancy is a serious violation and breach of Agreement, and the Landlord reserves the right to deny access or to have the premises vacated with no refund of monies. Any additional occupants staying more than 3 nights (consecutive or non-consecutive) requires advanced consent of the Landlord and may incur an additional fee of $75/night per visitor. NOTICES. Any and all notices sent by the Landlord or the Tenant to each other shall be sent via email or text. POSSESSION & SURRENDER. Tenant shall be entitled to possession of the Premises on the 1st day of the Rental Term. Upon termination of the Agreement, Tenant shall peaceably surrender the Premises to the Landlord in good condition, as it was at the commencement of the Agreement, excluding reasonable wear and tear. JOINT AND SEVERAL. If the Tenant is comprised of more than one person, each person shall be jointly and severally liable under this Agreement. REFUNDS. The Tenant shall not receive a refund due to a shortened stay and/or poor experience that resulted from unfavorable weather or unforeseen conditions beyond the Landlord's control. LIABILITY. The Landlord is not liable for any loss or damage to the personal property of the Tenant or their Tenants, unless the loss is a direct result of the Landlord's action. The Tenant is liable for the acts of anyone listed in this Agreement in addition to any visitor that they should allow on the Premises. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Tenants if such coverage is desired. HAZARDOUS MATERIALS. The Tenant agrees to not possess any type of personal property that could be considered a fire hazard such as a substance having flammable or explosive characteristics on the Premises. Items that are prohibited to be brought into the Premises, other than for everyday cooking or the need of an appliance, includes but is not limited to gas (compressed), gasoline, ammunition, fuel, propane, kerosene, motor oil, fireworks, or any other related content in the form of a liquid, solid, or gas. ENTIRE AGREEMENT. This Agreement contains all of the terms agreed to by the Parties and may be modified or amended only by written agreement signed by the Landlord and Tenant. This Agreement replaces all previous discussions, understandings, and oral agreements. The Parties agree to the terms and conditions and shall be bound until the termination of the Agreement. RULES AND GOVERNING LAW. This Agreement shall be governed by the laws of the state of Massachusetts. LEAD BASED PAINT. The Premises was built prior to 1978. An attachment titled "Disclosure of Information on Lead-Based Paint and/or Lead-Based Paint Hazards" has been affixed to the Agreement and must be initialed and signed by the Parties.
