Lease terms

Standard Lease Terms and Tenant Responsibilities The following terms and conditions are incorporated into and made part of the Lease Agreement. 1. Utilities Tenant is responsible for establishing, maintaining, and paying for all utilities serving the Property during the lease term, including but not limited to: * Electricity * Water and sewer * Trash collection * Internet and cable (if desired) All utility accounts shall be transferred into the Tenant's name by the lease commencement date. 2. Smoking Policy Smoking, vaping, or the use of any tobacco, marijuana, or similar products is strictly prohibited inside the residence, garage, or any enclosed portion of the Property. Evidence of smoking inside the Property may result in additional cleaning, deodorizing, or repair charges. 3. Parking Tenant shall utilize the garage and driveway for parking whenever possible. Street parking is permitted only on a temporary basis. No vehicle may remain parked on the street for more than twenty-four (24) consecutive hours or in violation of any HOA or municipal parking regulations. Commercial vehicles, inoperable vehicles, trailers, boats, RVs, or similar vehicles may not be stored on the Property unless expressly permitted by the HOA and approved by Landlord. 4. Lawn and Landscape Maintenance Tenant is responsible for maintaining the front, rear, and side yard landscaping throughout the lease term, including: * Regular mowing * Edging * Trimming shrubs and bushes * Watering as necessary (subject to local restrictions) * Removal of leaves and debris * General upkeep to maintain a neat appearance The Property shall be maintained in compliance with all HOA landscaping standards. 5. Weed Control Tenant is responsible for actively preventing and removing weeds in both the front and rear yards. Weed growth shall be controlled at all times to maintain compliance with HOA requirements. Any HOA violations or fines resulting from inadequate landscape maintenance shall be the responsibility of the Tenant. 6. Pool Maintenance Professional pool maintenance service is available for an additional monthly fee to be agreed upon by the parties. If Tenant elects not to purchase pool service through Landlord, Tenant assumes full responsibility for maintaining the pool in proper operating condition, including water chemistry, cleaning, and routine maintenance throughout the lease term. Damage resulting from neglect or improper maintenance shall be the responsibility of the Tenant. 7. Hot Tub The hot tub may either remain at the Property or be removed prior to the commencement of the lease at Landlord's discretion. If the hot tub remains, it is provided strictly as a convenience and "as-is," with no warranties or guarantees regarding operation. Due to its age, Landlord shall not be responsible for repairs, maintenance, replacement, or loss of use during the tenancy. 8. Pets Pets are permitted only with prior written approval from Landlord. Approved pets are subject to: * $300 refundable pet deposit per pet * $50 monthly pet rent per approved pet Tenant remains fully responsible for any damage caused by pets beyond normal wear and tear. Unauthorized pets constitute a violation of the Lease Agreement. 9. HVAC Filters Tenant shall replace the HVAC air filter every sixty (60) to ninety (90) days, or more frequently if needed based on occupancy or pet ownership. Failure to properly maintain the HVAC system may result in Tenant being responsible for repair costs caused by neglect. 10. Alterations and Improvements Tenant shall not paint, install fixtures, mount televisions, install shelving, modify landscaping, or make any alterations or improvements to the Property without prior written consent from Landlord. Any approved alterations shall become the property of the Landlord unless otherwise agreed in writing. 11. Smoke and Carbon Monoxide Detectors Tenant is responsible for replacing batteries in smoke detectors and carbon monoxide detectors (if applicable) during the lease term and shall promptly notify Landlord if any detector is not functioning properly. Tenant shall not disable or remove any safety device. 12. Renter's Insurance Tenant shall maintain renter's insurance throughout the lease term with a minimum of $100,000 in personal liability coverage. Proof of insurance shall be provided prior to occupancy and upon renewal if requested by Landlord. Tenant acknowledges that Landlord's insurance does not cover Tenant's personal belongings. 13. HOA Rules and Regulations The Property is subject to the rules, regulations, and governing documents of the Homeowners Association (HOA). Tenant agrees to comply with all HOA requirements throughout the lease term. Any fines, penalties, or costs resulting from Tenant's actions or failure to comply shall be the responsibility of the Tenant. 14. Property Condition Tenant agrees to maintain the Property in a clean, sanitary, and well-maintained condition throughout the lease term. Tenant shall promptly notify Landlord of any maintenance concerns or conditions that could result in additional damage if left unaddressed. Tenant shall be responsible for damage caused by negligence, misuse, abuse, or failure to timely report maintenance issues. 15. Maintenance and Repairs Tenant shall be responsible for routine household maintenance, including replacing light bulbs, maintaining batteries in remote controls and detectors, unclogging drains caused by normal use, and replacing consumable items. Landlord shall remain responsible for major systems and structural repairs, except where damage results from Tenant negligence or misuse. 16. Cleanliness The Property shall be kept in a clean and sanitary condition at all times. Tenant shall promptly remove trash and waste from the Property and prevent conditions that could attract pests or violate HOA or municipal regulations. 17. Keys, Garage Openers, and Access Devices Tenant shall be responsible for all keys, garage door openers, gate remotes, access cards, and similar devices provided at move-in. Lost or unreturned items may be replaced at Tenant's expense. 18. Move-Out Requirements Upon termination of the lease, Tenant shall: * Return the Property in substantially the same condition as received, excluding normal wear and tear. * Remove all personal belongings and trash. * Professionally clean the interior of the home. * Return all keys, garage remotes, and access devices. * Repair any damage beyond normal wear and tear. Any costs incurred by Landlord to restore the Property beyond ordinary cleaning and normal wear may be deducted from the security deposit as permitted by law. 19. Default Failure to comply with any of these provisions shall constitute a violation of the Lease Agreement and may result in fees, damages, or other remedies available under the Lease and applicable Arizona law.
