LEASE AGREEMENT ADDRESS: 2644 Fairland Street Cuyahoga Falls, OH 44221 1. AGREEMENT: Lease agreement is for ONE YEAR (12 months total) from date of first month occupancy,. After lease expiration, the lease will be on a month-to-month basis from the 1st of the month to the end, requiring a 30-day written notice before moving. Failure to give written notice will result in loss of security deposit (Premises occupied on the 1st of the month are to be considered leased for the entire month). After 1-year expiration, either party may terminate with 30 day written notice of intention to terminate. Where laws require "just cause", such just cause shall be so stated on said notice. The premises shall be considered vacated only after all areas including storage areas are clear of all residents' belongings, garbage, keys, and all other property furnished for resident's use are turned over to the OWNER. Should the resident hold over beyond the termination date or fail to vacate all possessions on or by the termination date, resident shall be liable for additional rent and/or damages which may include due to owner's loss of prospective new tenants. 2. RENT: Rent in the amount of $1300 per month is to be received by landlord at the above address by the first of each month. A 10% LATE FEE will be applied to rent received later than third (5rd) of the month. If rent is not received by the 10th of the month, an additional per diem of $5 per day late fee will be applied. 3. A security deposit of $1,300 will be collected at the time of move-in. An additional pet deposit of $500 will be required for tenants with pets." 4. OCCUPANTS: Guest(s) staying over 15 days without written consent of OWNER shall be considered a breach of this agreement. Only the following individuals under this agreement and no others shall occupy the residence for more than 15 days unless expressed with written consent of owner and obtained in advance. 5. TENANTS RESPONSIBILITIES: a. Tenant must update and provide OWNER with current phone number to communicate with. b. Gas and Electric Utilities are paid by tenant. Tenant will transfer gas, electric, water and sewer to their name effective of the first day of lease. c. Tenant will maintain minor issues such as, but not limited to clogged drains, plunging toilet etc. if necessary. d. Tenant must report issues to owner including LEAKS- plumbing, roof or any issues that may cause damage to the premises. Failure to report issues result in neglect and may affect security deposit. DO NOT FLUSH FEMININE HYGIENE PRODUCTS, THEY ARE NOT BIODEGRADABLE AND WILL CAUSE DAMAGE. NO WIPES, EVEN IF THEY SAY THEY ARE FLUSHABLE. e. Change furnace filters two times per year to reduce heating and cooling costs & keep furnace running efficiently. Filters to be provided by OWNER. f. Smoke & Co2 Alarms installed throughout for tenant's safety. Tenant's responsibility to ensure devices work properly and working batteries are always in alarms. g. Tenant to be charged for damage to appliances, plumbing, sewage stoppage, carpet, flooring, broken glass, screens, fans, AC unit, storm door, interior and exterior doors & fixtures caused by neglect or carelessness by tenant. h. Lawn will be mowed and maintained 6. Satellite dishes are NOT to be installed anywhere on the premises. Dishes are to be mounted on a pole in the ground & both to be removed before move-out. 7. No new holes are to be drilled through any interior or exterior wall or floor for any reason. Tenant is to be held responsible for all new entry holes made by an outside service provider. No alterations will be made to apartment (paint, holes, etc.). All nails must be removed, repaired prior to move-out. 8. Tenants property and belongings are NOT covered on OWNERS' homeowner's insurance. Tenant must have renter insurance policy to cover any losses for damage of personal property. This includes but not limited to, fire, theft, rain *sump pump failure & flood, acts of GOD, etc. Owner is not responsible for tenants' belongings. 9. Tenant is NOT permitted to change or add locks. 10. No SMOKING in building. 11. NO DRUGS or any ILLIGAL ACTIVITY will be tolerated & is cause for immediate eviction & loss of deposit. 12. No pools or trampolines on premises 13. Cars & Trucks ONLY- No boats, trailers, RVs etc. may be stored on property. 14. RIGHT OF ENTRY & INSPECTION: Owner or maintenance person may enter, inspect and/or make repairs on premises at any time in case of emergency or suspect abandonment. Owner to give tenant 24-hour notice for purpose of showing future tenants, repairs, inspections & maintenance. Upon 30-day written termination notice, owner may enter to inspect premises. 15. NOISE: Tenant agrees not to cause or allow any noise activity on the premises which might disturb the peace and quiet of another resident and/or neighbor. Said noise and/or activity shall breach this agreement. 16. DESTRUCTION OF PREMISES: If the premises become totally or partially destroyed during the term of this agreement so that tenants use is seriously impaired, owner or resident may terminate this agreement immediately upon three day written notice to the other. 17. PROPERTY MAINTENANCE: a. Resident shall dispose all garbage and waste in a clean, safe & sanitary manner into proper receptacles and shall cooperate in keeping the garbage area neat and clean. Resident is responsible for disposing of items such size and nature as are not normally acceptable by garbage hauler. Resident shall be responsible for keeping kitchen and bathroom drains free of things that may cause clogging or damage. Resident is responsible for expenses to clean out any plumbing fixture that may need cleared of stoppage and for the expense or damage caused by stopping waste pipes or overflow from bathtubs, toilets, wash basins or sinks. b. Snow removal on driveway, entryway, stairs, and walkway is tenant's responsibility along with de-icing for safety. Owner is not responsible for injuries related to Ohio weather conditions involving snow, ice, strong winds etc. Do not use salt on the driveway, use calcium chloride c. Flowerbed weeding and trimming are responsibility of tenants. d. Tenants are responsible for any pest control service if they desire such service. Owner is not responsible for any damage from pest to tenant's property. 18. CONDITION OF PREMISES: Resident acknowledges they've examined the premises- furnishing, fixtures, plumbing, heating, electrical facilities, appliances & all items attached to the property condition. If any/all items provided by owner are clean, and in good satisfactory condition unless otherwise stated in this agreement. Resident agrees to keep premises and all items within a good order and condition and to immediately pay for costs to repair or replace any items damaged by resident, guests and/or invitees. At termination of this agreement all the above items in this provision shall be returned to owner in similar clean and good condition, apart from reasonable and 'normal wear and tear'. The premises shall be free of all personal property & trash from resident. Failure to leave belongings behind may result in loss of deposit. It is agreed that all dirt, holes, cigarette smoke damage, tears, burns & stains of any size or amount in carpet, walls, windows, fixtures and/or any part of the premises do NOT constitute to 'normal' wear and tear. 19. Communication between Owner and Tenant should be confirmed in writing via text or email. (Section: 4, 5a, 5d, 15 and any other items that pertain to communication) 20. ASSIGNMENT: Tenant agrees not to transfer, assign, or sublet the premises or any part thereof. 21. Appliances that are property of house owner: fridge, washer, dryer, microwave and oven
