Lease terms

LEASE TERM This Lease has a duration of 11 months (the "Term"). This Lease automatically terminates on the expiration date unless renewed in writing by both parties. If Tenant remains in possession after expiration without a written renewal accepted by MANAGEMENT, the tenancy becomes a month-to-month tenancy subject to all terms of this Lease. UTILITIES Owner pays for gas, water, sewer, and trash. RULES Tenant, occupants, and guests shall: keep the Property clean, sanitary, and free of accumulated trash; avoid excessive noise and conduct that disturbs neighbors; flush only human waste and toilet paper, and never dispose of grease, wipes, hygiene products, or similar items in drains; promptly report leaks, HVAC failures, electrical problems, pest activity, or smoke detector malfunctions; make no painting, remodeling, lock changes, or other alterations without MANAGEMENT's prior written consent; not duplicate keys or provide keys to unauthorized persons; not cover windows with foil, cardboard, or similar improvised materials; not use balconies or patios for storage; keep hallways and common areas clear of personal property; and not engage in illegal activity on or about the Property. MANAGEMENT shall comply with all applicable building, housing, health, and safety codes and shall make repairs and do whatever is reasonably necessary to keep the Property in a fit and habitable condition, in accordance with Ohio Revised Code 5321.04. Tenant shall promptly give MANAGEMENT written notice of any defect or condition requiring repair. Tenant shall keep the Property safe and sanitary, shall not deface or damage the Property or its fixtures or appliances, and shall maintain in good working order any appliance supplied by MANAGEMENT for which Tenant is responsible, in accordance with Ohio Revised Code 5321.05. Tenant is responsible for the cost of any repair made necessary by the negligence or misuse of Tenant, Tenant's occupants, or Tenant's guests. LANDLORD RIGHT OF ENTRY Except in an emergency, MANAGEMENT shall give Tenant reasonable notice of intent to enter the Property, which notice shall be not less than twenty-four (24) hours except where impracticable, and shall enter only at reasonable times, in accordance with Ohio Revised Code 5321.04. MANAGEMENT may enter without advance notice in a genuine emergency threatening life or property, or if Tenant has abandoned the Property. Entry may be made to inspect the Property, perform repairs or improvements, supply agreed services, or show the Property to prospective tenants, purchasers, lenders, insurers, workers, or contractors. APPLIANCES Any appliances supplied by MANAGEMENT are furnished in working conditions at the start of the Term for Tenant's convenience. MANAGEMENT will repair or replace such appliances within a reasonable time after written notice of a malfunction not caused by Tenant. Tenant may not remove, replace, or install appliances without MANAGEMENT's prior written consent and is responsible for the cost of repair or replacement of any appliance damaged by Tenant's negligence or misuse. PARKING If parking is provided, Tenant shall park only in the space(s) designated by MANAGEMENT, using vehicles that are operable, currently registered, and insured. MANAGEMENT may have any inoperable, unregistered, or improperly parked vehicle towed at the owner's expense. Boats, trailers, campers, and commercial vehicles may not be parked at the Property without MANAGEMENT's prior written consent. SMOKING Smoking, vaping, and the use of tobacco, marijuana, or similar products is prohibited inside the dwelling unit and in all common areas unless MANAGEMENT has authorized a designated area in writing. Violation of this section is a material breach, and Tenant is responsible for the cost of any resulting odor remediation, cleaning, or repair. PETS No pets are permitted at the Property without MANAGEMENT's prior written consent. If a pet is approved, Tenant shall comply with any pet policy, pet fee, or pet deposit required by MANAGEMENT and is responsible for all damage, noise, and waste caused by the pet. MANAGEMENT may withdraw consent for a pet that disturbs other residents or violates this Lease. INSURANCE Tenant is strongly encouraged to obtain and maintain renter's insurance covering Tenant's personal property and personal liability throughout the Term. MANAGEMENT is not responsible for loss of or damage to Tenant's personal property from any cause, including fire, theft, water, or other casualty, except as required by law. DEFAULT AND REMEDIES If Tenant fails to pay rent when due or otherwise breaches a material term of this Lease, MANAGEMENT may pursue all remedies available under Ohio law, including termination of the rental agreement and an eviction action (forcible entry and detainer) under Ohio Revised Code Chapter 1923, following any notice to leave the premises required by law. Ohio Revised Code 5321.17 requires at least thirty (30) days' written notice to terminate a monthto- month tenancy and at least seven (7) days' written notice to terminate a week-to-week tenancy, except that certain drug-related violations described in that section permit termination on three (3) days' notice. Tenant remains liable for rent and other charges accruing through the earlier of the date the Property is re-rented or the end of the Term, together with MANAGEMENT's reasonable costs of re-renting and attorney's fees to the extent permitted by law. NOTICES All notices under this Lease must be in writing and delivered by personal delivery or certified mail, return receipt requested, unless applicable law requires a different method. Notices to MANAGEMENT shall be sent to the address on the first page of this Lease. Notices to Tenant shall be sent to the Property address.
