Terms at 225 Holding Dairy Dr

## 1. Lease Term The Lease term shall be for **twelve (12) months beginning on __________________ and ending on __________________. This Lease **shall not automatically renew** at the end of the lease term unless agreed to in writing by both parties. ## 2. Rent Monthly rent in the amount of $____________ shall be due on the **1st day of each month**. Any rent not paid when due shall be subject to a late fee in accordance with North Carolina law, which shall be the greater of: * 15.00 or * **5% of the monthly rent amount**. ## 3. Security Deposit Tenants shall pay a security deposit in the amount of $____________. The security deposit shall be returned within **30 days after Tenants vacate the Property less any lawful deductions for damages, unpaid rent, cleaning, repairs, or other amounts permitted under North Carolina law. Tenants acknowledge that the security deposit and Tenant's renter's insurance may be used toward repair costs for damages caused by Tenant, occupants, guests, or invitees. ## 4. Entry by Landlord Tenants shall allow Landlord access to the Property for inspections, repairs, maintenance, showings, or other lawful purposes. Except in emergencies, Landlord shall provide at least **24 hours' notice** prior to entry. ## 5. Maintenance and Repairs Tenants shall: * Promptly report any major maintenance or repair issues to the Landlord as soon as possible. * Maintain the Property in a clean and sanitary condition. * Exercise reasonable care to protect the Property and all improvements. The Property contains extensive upgrades and hardwood flooring throughout the home. Tenants shall not use chemicals, equipment, or materials that may damage the hardwood flooring or other finishes. ## 6. Smoking and Vaping Smoking and vaping of any kind are strictly prohibited inside the Property, garage, and surrounding premises. ## 7. HOA Compliance Tenants agree to comply with all applicable Homeowners Association ("HOA") rules, regulations, covenants, and community standards. Any fines or violations caused by Tenant, occupants, or guests shall be the responsibility of Tenants. ## 8. Landscaping and Yard Care Tenants shall: * Allow Landlord's landscaping contractors access to the Property for routine lawn mowing and landscaping services. * Properly maintain the yard, including watering trees and landscaping as reasonably necessary. Tenants shall not interfere with scheduled landscaping services. Tenants are responsible for Snow cleaning. ## 9. Community Amenities Pool and Clubhouse for rental (HOA permitted). If the HOA doesn't allow Tenant's access then it will not be available. ## 10. Utilities Tenants shall be responsible for payment of all utilities and services associated with the Property. Utilities to be paid by Tenant include, but are not limited to: * Electricity * Gas * Water * Internet/Cable * Trash and Recycling Within two (2) weeks of move-in, Tenants shall provide Landlord with proof of utility activation, including receipts or account confirmations for gas, electric, and water services. ## 11. Occupancy, Guests, and Subletting Tenants shall not sublease, assign, or otherwise transfer any interest in the Property without prior written consent from the Landlord. Guests may not stay at the Property for more than **two (2) consecutive weeks** without the Landlord's prior written approval. ## 12. Pets Negotiable. Will update in the final draft of the lease before signing. ## 13. Locks and Security Tenants shall not change, replace, or rekey any locks at the Property without prior written consent from the Landlord. ## 14. Credit and Background Checks All adults residing at the Property shall be subject to credit and background screening prior to approval for occupancy. ## 15. Notice to Vacate Tenant shall provide at least **sixty (60) days' written notice** prior to vacating the Property. If Tenants vacate prior to the expiration of the Lease term, Tenants shall remain responsible for rent and all obligations under the Lease for the remainder of the lease term unless otherwise agreed in writing or as required by North Carolina law. ## 16. Sale of Property The landlord reserves the right to sell the Property during the Lease term. In the event the Property is sold and the purchaser requires occupancy or termination of tenancy, Tenant agrees to vacate the Property as directed by the Landlord in accordance with applicable North Carolina law and any required notice periods. Tenants agree to reasonably cooperate with showings, inspections, and sale-related access requests. ## 17. Entire Agreement These terms shall be incorporated into and made part of the Residential Lease Agreement between Landlord and Tenant. ## 18. Right of Refusal Submission of a rental application does not constitute a lease agreement or guarantee approval for tenancy. The Landlord reserves the right to reject any rental application for any lawful reason consistent with applicable federal, state, and local housing laws. ## 19. Comprehensive Screening A background check, credit check, rental history verification, and other lawful screening procedures may be performed for every adult eighteen (18) years of age or older intending to reside at the Property. Approval of occupancy is subject to Landlord's screening criteria and verification of information provided in the rental application.
