RESIDENTIAL LEASE AGREEMENT This Residential Lease Agreement (the "Agreement" or "Lease") is made and entered into on ______, by and between ______. No additional tenants are allowed without written consent from the Landlord or execution of a new lease agreement. ________________________________________ PREAMBLE WHEREAS, the Landlord is the owner of the property located at (the "Premises"); and WHEREAS, the Landlord wishes to lease the Premises to the Tenant(s) under the terms and conditions contained herein; NOW, THEREFORE, in consideration of the covenants and obligations contained herein, and for other good and valuable consideration, the parties agree as follows: ________________________________________ ARTICLE I TERM The lease term will begin on (the "Commencement Date") and terminate at midnight on , lasting __ months. The Tenant shall vacate the Premises upon the termination of the Agreement unless: (i) the Landlord and Tenant agree to extend the lease or sign a new lease; or (ii) the Landlord accepts further rent from the Tenant (excluding past due rent), thereby creating a month-to-month tenancy. In this case, either party may terminate the agreement with a 30-day written notice. Rent during the month-to-month tenancy will be at a rate agreed upon by both parties or as allowed by law. All other terms of the original Agreement will remain in effect. ________________________________________ ARTICLE II PAYMENTS Rent: The total monthly rent is___. Due Date: Rent is payable on the 1st of each month and considered late after three (3) days. The first month's rent is due upon signing this Agreement. If rent is not received by the fifth (5th) day after the due date, and if the Tenant has a history of poor credit or missed payments, the Landlord reserves the right to issue a 5-Day Notice to Pay or Quit. After this notice period, if the rent remains unpaid, eviction proceedings will begin immediately. Payment Information: Rent payments shall be made in the specified online portal or any subsequent address provided by the Landlord. Non-Refundable Fees: The Tenant will pay a non-refundable $35.00 application fee online as part of the approval process. Security Deposit: A security deposit of ___ or a non-refundable move-in Fee of $1,000 is due upon signing the Agreement. This deposit will cover any damages caused during the tenancy. The deposit, minus any deductions for cleaning or damage, will be returned within 30 days after the Tenant vacates the Premises. The security deposit cannot be used for rent during the lease term. ________________________________________ ARTICLE III DAMAGE TO PREMISES & INSURANCE If the Premises are damaged or destroyed (through no fault of the Tenant) by fire, earthquake, flood, storm, or other unavoidable causes, making the Premises uninhabitable, either party may terminate the Agreement with written notice. Rent will be prorated based on the date the damage occurred. If the damage is due to the Tenant or their guest(s), only the Landlord may terminate the Agreement, and no rent reduction will be made. The Tenant will be responsible for all necessary repairs. Renter's Insurance: The Tenant is required to carry renter's insurance to protect their property. The Landlord is not responsible for loss or damage to the Tenant's personal property, vehicles, or bodily harm caused by theft, vandalism, or negligent acts. The Landlord will not be responsible for any injuries or physical ailments or health complications occurring to tenants or guests during the lease term. The Landlord will carry insurance for the structure and contents owned by the Landlord. ________________________________________ ARTICLE IV OTHER FEES Late Charge: A late fee of $75.00 will be assessed if rent is not paid within three (3) days of the due date. Late fees are considered additional rent. Returned Checks: If any payment is returned, the Tenant will pay a $75.00 fee and may be required to make future payments in cash or certified check. ________________________________________ ARTICLE V USE OF PREMISES The Premises are to be used exclusively by the Tenant and authorized individuals on the rental application. Guests may visit but cannot reside on the Premises without the Landlord's written consent. The Tenant will not store or use illegal substances or hazardous materials on the Premises. Smoking is strictly prohibited in and around the Premises. If the Tenant delays in reporting a maintenance issue, the Landlord reserves the discretion to determine whether the cost of repair is covered by the Landlord or the Tenant. Furnishings: The Landlord will provide a list of furnishings. The Tenant is responsible for returning all furnishings in good condition (minus normal wear). Appliances: The Tenant will also be provided with major appliances. The Landlord is responsible for maintaining major appliances; the Tenant is responsible for fixing / replacing small appliances (coffee maker, light bulbs, etc). Pets: Pets are not allowed without written consent. The Tenant is responsible for any damages caused by pets as well as a monthly pet fee $75.00. ________________________________________ ARTICLE VI ALTERATIONS TO THE PREMISES The Tenant must obtain written permission from the Landlord before making any alterations to the Premises. Any alterations made will become the property of the Landlord and remain on the Premises upon lease termination. ________________________________________ ARTICLE VII KEYS & LOCKS The Tenant will receive two keys upon signing. Lost keys will incur a charge of $40 per replacement. Additional fees apply if the Landlord is called to unlock the Premises. ________________________________________ ARTICLE VIII ASSIGNMENT & SUB-LETTING The Tenant may not assign this Agreement, sublet, or allow others to occupy the Premises without the Landlord's written consent. A cosigner may serve as a proxy for the tenant they cosigned for, in matters relating to communication or lease obligations, at the discretion of the Landlord. If one tenant chooses to break the lease, they may do so without the consent of the other tenant(s). The remaining tenant must reapply for tenancy if they wish to continue living at the Premises. ________________________________________ ARTICLE IX NON-DELIVERY OF POSSESSION If the Landlord is unable to deliver possession of the Premises by the Commencement Date, the start date of the lease will be extended. If possession is not delivered within 30 days, the Tenant may terminate the Agreement and receive a refund of all money paid regarding the lease and move in. ________________________________________ ARTICLE X UTILITIES, STORAGE, & PARKING Utilities: The Tenant is responsible for water, electricity, natural gas, internet and garbage services. Storage: The Tenant may only store their personal belongings. Parking: Only properly licensed and operable vehicles are allowed. No parking on lawns or neighbors' property. ________________________________________ ARTICLE XI MAINTENANCE & REPAIRS The Tenant is responsible for keeping the Premises in good condition. The Tenant must promptly report any damage to the Landlord and allow for inspections as needed. The Tenant is responsible for maintaining the lawn and keeping the premises presentable, with mowing required at least once per month from March through October. The Landlord reserves the right to assess a fine if the property is not maintained in a presentable condition, as determined at the Landlord's discretion. Quarterly inspections and routine maintenance checks will be conducted by the Landlord. The Landlord will provide a 24-hour notice prior to entry, except in the case of emergency. ________________________________________ ARTICLE XII INSPECTION OF PREMISES The Landlord may enter the Premises for inspections with 24-hour notice, or immediately in case of emergency. See Article XI for quarterly inspections. ________________________________________ ARTICLE XIII EARLY TERMINATION OF LEASE The Landlord may terminate the lease for serious violations, criminal activity, or non-payment of rent. The Tenant may terminate the lease with a 30-day written notice. The Tenant must pay a termination charge of 50% of the remaining rent, plus a $400 cleaning fee and property damage repair. ________________________________________ ARTICLE XIV TENANT OBLIGATIONS UPON VACATING The Tenant must return the Premises in good condition, turn in all keys, vacate parking spaces, and provide a forwarding address. ________________________________________ ARTICLE XV NOTICES Notices should be served to the following addresses:.
