SHORT-TERM FURNISHED RESIDENTIAL RENTAL AGREEMENT This Short-Term Furnished Residential Rental Agreement ("Agreement") is intended to create a clear, comprehensive, and legally binding written lease for a short-term furnished residential occupancy. The parties intend that this Agreement be interpreted and enforced under applicable New Mexico law. 1. Parties and Premises This Short-Term Furnished Residential Rental Agreement ("Agreement") is entered into by and between True Nature Healing Center, LLC ("Landlord") and __________________ ("Tenant"). Landlord rents to Tenant the fully furnished dwelling located at: 2100 Calle de la Vuelta, Unit ______, Santa Fe, New Mexico 87505 (the "Premises"), together with the furniture, appliances, fixtures, keys, remotes, linens, kitchenware, and other personal property supplied with the unit. 2. Term of Lease The lease term begins on __________________ at _________ and ends on __________________ at _________. This is a fixed-term residential lease for less than one year. 3. No Automatic Renewal; Extension by Written Agreement Only This Agreement terminates automatically at the end of the stated term unless Landlord and Tenant agree in writing before check-out to extend the tenancy. Any approved extension shall be at the same rental rate unless the parties agree otherwise in writing. Tenant acknowledges that no month-to-month tenancy, holdover tenancy, or renewal shall arise by implication, silence, or acceptance of partial performance unless Landlord expressly agrees in writing. 4. Rent and Payment Terms Total rent for the full lease term is $__________________ and is due in full before Tenant is given possession of the Premises. No keys, codes, or occupancy rights shall be provided until: This Agreement is signed; Rent is paid in full; and All required deposits and fees are paid. Except as otherwise required by applicable law, rent is non-refundable if Tenant elects to depart early or fails to occupy the Premises for all or any portion of the lease term. 5. Security Deposit Tenant shall pay a security deposit of $__________________ before move-in. The security deposit secures Tenant's performance of this Agreement and may be applied to: Damage beyond ordinary wear and tear; Missing items; Excessive cleaning; Smoke remediation; Unauthorized charges; Late charges authorized by this Agreement; and Other lawful amounts due. The security deposit is not last month's rent. Any remaining balance shall be returned with an itemized statement of deductions within the time required by New Mexico law after termination of the tenancy or Tenant's departure, whichever occurs later. 6. Cleaning Fee Tenant shall pay a non-refundable cleaning fee of $200.00. This fee covers standard turnover cleaning only and does not limit Landlord's right to charge additional amounts for excessive dirt, odors, stains, biohazards, trash removal, smoke remediation, or cleaning made necessary by Tenant, occupants, or guests. 7. Furnishings, Inventory, and Condition of Unit The Premises are rented fully furnished. Tenant accepts the Premises and furnishings in their existing condition at move-in, subject to any written move-in condition report. Tenant shall keep all furnishings and household items in good order, use them only for their intended purpose, and return them at move-out in substantially the same condition, ordinary wear and tear excepted. Tenant is responsible for the full reasonable replacement cost of any missing, destroyed, or materially damaged item, together with related delivery, installation, and administrative costs where applicable. 8. Use of Premises and Wellness Environment The Premises shall be used solely as a private residence for approved occupants. No commercial activity, subleasing, assignment, short-term re-rental, event hosting, or unlawful use is permitted. Tenant acknowledges that patients may be participating in wellness programs on the property and agrees to respect the quiet, health-focused environment of the premises, including all reasonable onsite policies intended to protect patient comfort, rest, privacy, and safety. 9. Occupancy Limits and Guests Occupancy is limited to Tenant and any additional occupants specifically approved by Landlord in writing. No overnight guest is permitted without Landlord's prior written approval. Landlord may treat unauthorized occupancy as a material violation of this Agreement. To the extent permitted by law, Tenant shall be responsible for any extra wear, damage, or charges caused by unauthorized occupants or guests. 10. No Pets No pets or animals are permitted in or about the Premises except as required by applicable law regarding service animals or other legally protected accommodations. Unauthorized animals constitute a material breach of this Agreement and may result in additional cleaning, deodorization, flea treatment, repair, and other lawful charges. 11. No Smoking; Fire and Odor Prevention Smoking, vaping, incense, open-flame candles, or burning of any substance is prohibited inside the Premises and in any area where smoke or odor may travel into the building or disturb other occupants. Tenant shall be liable for a minimum smoke-remediation charge of $500.00, plus any additional actual costs of deodorization, filter replacement, cleaning, repainting, or restoration required as a result of Tenant's violation. 12. Maintenance, Housekeeping, and Tenant Duties Tenant shall: Keep the Premises clean, sanitary, and safe; Promptly dispose of trash; Use all systems, appliances, plumbing, heating, ventilation, and air conditioning in a reasonable manner; and Promptly notify Landlord of any maintenance issue, leak, unsafe condition, or needed repair. Tenant shall not intentionally or negligently damage, impair, or remove any part of the Premises and shall be responsible for damage caused by Tenant, occupants, invitees, or guests. 13. Landlord Access Landlord may enter the Premises upon reasonable notice for inspection, maintenance, repairs, showing the unit to prospective renters or purchasers, or other lawful purposes. Landlord may enter without prior notice in an emergency, to protect life or property, or when Landlord reasonably believes immediate entry is necessary. 14. Rules, Quiet Enjoyment, and Conduct Tenant, occupants, and guests shall conduct themselves in a manner that does not disturb neighbors, other residents, staff, or patients onsite. The following are prohibited: Loud music; Parties; Nuisance behavior; Harassment or threats; Illegal drugs; Excessive alcohol-related disturbances; and Conduct interfering with the quiet enjoyment of others. Tenant shall comply with all building rules, parking instructions, waste-disposal procedures, and reasonable written policies provided by Landlord. 15. Utilities, Keys, and Security Unless otherwise stated by Landlord in writing, the Premises shall be delivered with the utilities and access devices then serving the unit. Tenant shall safeguard all keys, remotes, and access credentials and shall not duplicate, transfer, or share them except with approved occupants. Charges for lockouts, rekeying, replacement keys, replacement remotes, or other security-related corrective action necessitated by Tenant may be deducted from the security deposit or otherwise charged to Tenant. 16. Casualty, Damage, and Condition at Move-Out Tenant shall surrender the Premises at the end of the lease term in broom-clean condition, free of excess trash and personal property, with: All dishes reasonably cleaned; Furniture returned to its original placement unless otherwise approved by Landlord; and All access devices returned. If Tenant fails to remove personal property, Landlord may exercise any rights available under New Mexico law. Landlord may document the condition of the Premises through photographs, video, inventory review, or inspection reports. 17. Default, Notices of Nonpayment, and Other Breaches If Tenant fails to pay rent when due, Landlord may issue any notice required by New Mexico law for nonpayment of rent and may pursue all remedies allowed by this Agreement and applicable law. If Tenant materially violates this Agreement other than by nonpayment, Landlord may issue the notice required by New Mexico law specifying the breach and an opportunity to cure, if applicable. Nothing in this Agreement authorizes self-help eviction or waiver of any statutory rights or duties. All enforcement shall be pursued in accordance with applicable law. 18. Holdover; Possession After End of Term If Tenant remains in possession after the lease end date without Landlord's written consent, Landlord may pursue possession and all other lawful remedies. Any continued occupancy without written consent shall create liability for holdover damages of $500.00 per day as liquidated damages intended to reflect the difficulty of measuring disruption, scheduling loss, and administrative burden, to the extent permitted by law, together with any other damages, costs, and attorney fees recoverable under applicable law. Acceptance of money after expiration shall not by itself waive Landlord's right to possession unless Landlord agrees in writing to a new tenancy. 19. Liability, Personal Property, and Insurance Tenant assumes responsibility for Tenant's own personal property and for the conduct of occupants and guests. Landlord is not an insurer of Tenant's personal property and shall not be liable for loss or damage caused by theft, weather, interruption of utility service not caused by Landlord's willful misconduct, acts of third parties, or conditions beyond Landlord's reasonable control, except as otherwise required by law. Tenant is encouraged to maintain renter's insurance covering personal property, liability, and temporary living expenses. 20. Indemnity, Governing Law, Entire Agreement, and No Waiver To the fullest extent permitted by law, Tenant shall indemnify and hold Landlord harmless from claims, losses, costs, and damages arising from Tenant's use of the Premises or the conduct of Tenant's occupants or guests, except to the extent caused by Landlord's own negligence or other non-waivable legal responsibility. This Agreement shall be governed by the laws of the State of New Mexico. This Agreement constitutes the entire agreement between the parties and may be modified only by a written agreement signed by both parties. No waiver of any breach shall operate as a continuing waiver of the same or any other breach. 21. Signatures, Notices, and Forwarding Address Tenant shall provide Landlord with a forwarding address for the return of any security-deposit balance and delivery of any accounting statement. Notices under this Agreement shall be given in writing as permitted by law and by the methods authorized under this Agreement or applicable law.
