LEASE TERMS & REQUIREMENTS LEASE TERM * Initial lease term: 12 months. * The Lease does not automatically renew for an additional 12-month term. * Any renewal, extension, or modification of the Lease must be agreed to in writing by Landlord and Tenant. * No subleasing, assignment, Airbnb, VRBO, short-term rental, or other transfer of occupancy is permitted without Landlord's prior written approval and compliance with applicable law. * Only persons approved and identified as occupants under the Lease may use the Property as their primary residence. MONTHLY RENT * Unfurnished: $1,900/month * Furnished: $2,050/month * Rent is due on the 1st day of each month. * Rent not received by the end of the 5th day of the month is considered late. * A late fee equal to 5% of the unpaid rent balance may be assessed, not to exceed the amount permitted by Virginia law. FUNDS DUE BEFORE MOVE-IN Tenant must pay all required amounts and satisfy all move-in requirements before taking possession of the Property. Amounts due include: * Security deposit equal to one month's rent * First month's rent * If applicable, $500 refundable pet deposit * Any other lawful one-time charges expressly identified in the Lease or applicable addenda The security deposit is not prepaid rent and may not be used by Tenant as the final month's rent. SECURITY DEPOSIT The security deposit may be applied to unpaid rent, permitted charges, damage beyond reasonable wear and tear, actual damages resulting from a breach of the Lease, and other amounts permitted by the Lease and Virginia law. Early termination does not automatically result in forfeiture of the security deposit. Following termination of the tenancy and surrender of possession, Landlord will provide an itemized disposition of the security deposit and return any remaining balance within the period required by Virginia law. Tenant must provide Landlord with a forwarding address for purposes of the security-deposit disposition and other final communications. FURNISHED OR UNFURNISHED OPTION The condo may be rented furnished or unfurnished. The furnished option includes: * Bed/bed frame * Sofa * Automatic standing office desk * Office chair * Coffee table * Patio daybed All Landlord-provided furnishings will be documented by item, condition, and photographs as part of the move-in inventory and condition report. Tenant is responsible for loss of or damage to Landlord-provided furnishings beyond reasonable wear and tear. Landlord-provided furniture may not be removed from the Property, disposed of, materially altered, or relocated outside the Property without Landlord's prior written approval. UTILITIES Tenant is responsible for all utilities and services associated with the unit, including: * Water * Gas * Electricity * Internet * Cable/television or other optional telecommunications services Tenant is responsible for establishing and maintaining all applicable utility accounts for the duration of the tenancy and for paying all charges associated with those accounts. Tenant must keep all required utility services active through the date possession of the Property is returned to Landlord. RENTER'S INSURANCE Tenant must maintain renter's insurance throughout the entire tenancy. Proof of coverage must be provided prior to move-in and upon reasonable request during the Lease term. The policy must include personal liability coverage of at least $100,000. Tenant is responsible for insuring Tenant's own personal property. Landlord's insurance does not insure Tenant's personal belongings. Tenant must notify Landlord of any cancellation, lapse, or material change in required coverage and promptly restore required coverage. SMOKING & VAPING Smoking or vaping of tobacco, marijuana/cannabis, or any other substance is strictly prohibited: * Inside the condo * On the private balcony Tenant is responsible for damage, odors, residue, remediation, or cleaning resulting from a violation of this provision to the extent permitted by law. PET POLICY * Maximum of one pet * Cats or dogs only * Maximum weight: 20 lbs * All pets require Landlord's prior written approval * $500 additional refundable pet deposit * No additional or replacement pet may be brought onto the Property without prior written approval Tenant is responsible for damage, odors, stains, pest treatment, excessive cleaning, or other damage caused by an approved pet beyond reasonable wear and tear. Tenant must comply with all applicable condominium association rules regarding animals. Tenant must keep the approved animal under appropriate control and prevent unreasonable noise, nuisance, property damage, or interference with other residents. The above pet restrictions, pet deposit, and pet-related requirements do not apply to qualifying assistance animals to the extent prohibited by applicable federal or Virginia fair-housing law. Tenant remains responsible for physical damage caused by an assistance animal to the extent permitted by law. CONDOMINIUM RULES Tenant and all occupants, guests, and approved pets must comply with the governing documents, rules, regulations, parking requirements, security procedures, and community policies of The Grove at Arlington. Tenant will be provided with or given access to applicable condominium rules and agrees to comply with them as part of the tenancy. Tenant is responsible, to the extent permitted by law and the Lease, for condominium association fines, charges, repair costs, or other expenses assessed against the unit as a direct result of actions or violations caused by Tenant, authorized occupants, guests, or approved pets. KEYS, FOBS & ACCESS DEVICES Tenant is responsible for the actual replacement cost of lost or damaged: * Building FOBs * Keys * Garage remotes * Parking credentials * Other access devices All Landlord-issued access devices remain the property of Landlord. Tenant may not duplicate, lend, modify, or distribute building access devices to unauthorized persons in violation of condominium rules. All access devices must be returned when possession of the Property is surrendered. PARKING One assigned covered garage parking space is included with the rental. Tenant must comply with all community parking and vehicle-registration requirements. Tenant may not assign, rent, transfer, or permit another person to use the assigned parking space on a continuing basis without Landlord's prior written approval. OCCUPANCY Only individuals listed and approved as occupants under the Lease may reside at the Property. Guests may visit the Property but may not establish residency, use the Property as their primary residence, receive permanent occupancy rights, or otherwise become an unauthorized occupant. Any additional resident must receive Landlord's prior written approval and, where required, complete applicable screening and be added to the Lease. RESIDENTIAL USE The Property is intended primarily for residential use. Ordinary remote work from home is permitted provided it does not: * Violate condominium rules * Create excessive foot traffic * Create unreasonable noise or nuisance * Require structural alterations * Involve unlawful activity * Materially increase risk to the Property or other residents No illegal activity may be conducted at or from the Property. ALTERATIONS Tenant may not make material alterations to the Property without Landlord's prior written approval. This includes, but is not limited to: * Painting * Wallpapering * Permanent fixtures * Major wall mounting * Structural alterations * Replacement or modification of locks * Changes to plumbing * Changes to electrical systems * HVAC modifications * Appliance modifications * Cabinetry alterations * Flooring alterations * Changes to doors or windows Approved alterations must be performed in accordance with Landlord instructions, condominium requirements, and applicable law. PROPERTY CARE & DAMAGE Tenant must keep the condo in a reasonably clean, safe, and sanitary condition and exercise reasonable care of: * The Property * Appliances * Fixtures * Flooring * Furnishings * Balcony * Common areas * Community property Tenant must promptly notify Landlord of conditions including: * Water leaks * Water intrusion * Plumbing problems * HVAC problems * Electrical issues * Appliance malfunctions * Mold or suspected moisture problems * Pest issues * Any other condition that could cause additional damage if left unaddressed Tenant is responsible for damage resulting from Tenant's failure to reasonably and promptly report a known condition when that failure causes additional damage. Tenant is responsible for damage caused by Tenant, authorized occupants, guests, or approved pets beyond reasonable wear and tear. MAINTENANCE & REPAIRS Tenant must promptly report maintenance and repair issues to Landlord. Except where otherwise permitted by law, Tenant may not independently hire contractors, authorize repairs, replace equipment, or make alterations without Landlord's prior approval. Tenant will not be charged for ordinary wear and tear or repairs that are Landlord's responsibility under applicable law. Tenant is responsible for repair costs resulting from misuse, negligence, intentional damage, or actions of Tenant, occupants, guests, or approved pets. MOVE-IN CONDITION REPORT A written move-in condition report will document the condition of the Property shortly after occupancy as required by Virginia law. For furnished rentals, the report will also document Landlord-provided furnishings and their condition. Photographs may be used to supplement the written condition report. Tenant should promptly identify any disagreement with the move-in report within the period provided by applicable law. MOVE-OUT CONDITION Tenant must return the Property in substantially the same condition in which it was received, excluding reasonable wear and tear. At move-out, the Property must be: * Vacated by all occupants * Reasonably clean * Free of Tenant's personal belongings * Free of trash and debris Tenant must return all: * Keys * FOBs * Garage remotes * Parking credentials * Access devices * Landlord-owned furnishings and other property Tenant is responsible for actual replacement costs for missing or damaged Landlord property beyond reasonable wear and tear. Landlord will comply with applicable Virginia requirements concerning the move-out inspection and Tenant's right to participate where applicable. HOA / BUILDING MOVE-IN AND MOVE-OUT REQUIREMENTS Tenant must comply with all applicable building procedures for moving into or out of the Property, including: * Scheduling requirements * Elevator reservations * Loading-area requirements * Building access procedures * Move-in/move-out hours * Any other applicable condominium requirements Tenant is responsible for charges or damages arising from Tenant's failure to comply with applicable building requirements to the extent permitted by law. LANDLORD ACCESS Tenant shall not unreasonably withhold consent for Landlord, Landlord's agents, contractors, or authorized representatives to enter the Property for purposes permitted by Virginia law, including: * Inspection of the Property * Necessary or agreed-upon repairs or maintenance * Providing required or agreed-upon services * Condominium or insurance-related inspections * Showing the Property to prospective tenants or purchasers * Access by contractors or service providers Landlord will provide notice and enter at reasonable times as required by Virginia law. Where applicable, at least 72 hours' notice will be provided for routine maintenance not requested by Tenant unless providing such notice is impractical. Advance consent or notice is not required where emergency entry is permitted by law. During the final 60 days of the Lease term, or after Tenant has provided notice of intent to vacate, Tenant must reasonably cooperate with scheduled showings to prospective tenants or purchasers upon appropriate notice. Tenant's unreasonable refusal to permit lawful access may constitute a violation of the Lease and may subject Tenant to remedies available under Virginia law. EXTENDED ABSENCE Tenant should notify Landlord in writing of any anticipated absence from the Property lasting more than seven consecutive days. Tenant remains responsible during any absence for ensuring that the Property is reasonably secured and that conditions requiring maintenance or emergency attention are promptly reported. Nothing in this provision limits Landlord's rights regarding access, abandonment, or protection of the Property under applicable law. QUALIFICATION REQUIREMENTS Applicants should meet the following minimum screening criteria: * Gross combined household income or other qualifying lawful sources of funds equal to at least 3x monthly rent * Minimum credit score of 680, subject to applicable law * Verifiable income or other qualifying financial resources * Satisfactory rental history * Successful completion of applicable credit, background, and rental-history screening Meeting the minimum qualifications does not guarantee approval. Screening criteria will be applied consistently and in accordance with applicable federal, Virginia, and local fair-housing requirements. LEASE RENEWAL & NON-RENEWAL LANDLORD RENEWAL NOTICE At least 90 days prior to expiration of the Lease, Landlord will provide Tenant with written notice stating whether Landlord intends to offer a renewal. If a renewal is offered, the notice will identify the proposed monthly rent and other material changes to the Lease terms. TENANT RENEWAL DECISION If Landlord offers a renewal, Tenant must either: * Accept the proposed renewal in writing; or * Provide written notice of intent to vacate Tenant's decision must be provided no later than 60 days prior to expiration of the Lease. A renewal is not binding until the renewal agreement or new Lease has been signed by both Landlord and Tenant. NON-RENEWAL If Landlord does not offer a renewal, Tenant must vacate and surrender possession of the Property no later than the final day of the Lease term. If Tenant does not intend to renew, Tenant must provide Landlord with at least 60 days' written notice before expiration of the Lease. Failure to provide the required notice does not automatically renew the Lease for another 12-month term but may subject Tenant to actual damages or other obligations resulting from failure to provide the required notice to the extent permitted by the Lease and Virginia law. NO AUTOMATIC FIXED-TERM RENEWAL The Lease does not automatically renew for another fixed 12-month term. Any new fixed-term tenancy requires a written renewal agreement or new Lease signed by Landlord and Tenant. MONTH-TO-MONTH OCCUPANCY Tenant may not remain in possession after expiration of the Lease without Landlord's written consent. If Landlord agrees to permit Tenant to remain after expiration without executing a new fixed-term Lease, the tenancy may continue on a month-to-month basis under terms agreed to by the parties and applicable Virginia law. Unless another notice period is established in writing, an approved month-to-month tenancy may be terminated by either party by providing at least 30 days' written notice prior to the next rent due date, subject to applicable law. CHANGES TO RENEWAL TERMS A renewal may include changes to: * Monthly rent * Furnished or unfurnished status * Pet arrangements * Parking * Utilities * Other Lease terms Any changes must be communicated and implemented in accordance with applicable law and become effective only through a properly executed renewal agreement or other lawful written modification. LEASE VIOLATIONS & REMEDIES VIOLATION OF LEASE TERMS Tenant's material failure to comply with the Lease may constitute a breach. Examples may include: * Unauthorized smoking or vaping * Unauthorized pets * Unauthorized occupants * Unauthorized subleasing or short-term rental activity * Material property damage * Failure to comply with condominium rules * Improper alterations * Repeated refusal of lawful access * Material property-care violations * Other material violations of the Lease Landlord may exercise remedies available under the Lease and applicable Virginia law, including, where permitted: * Requiring correction of the violation * Recovering actual damages * Recovering authorized charges * Recovering condominium fines attributable to Tenant * Seeking possession of the Property * Terminating the tenancy * Recovering court costs * Recovering reasonable attorney fees where authorized Any legally required notice or opportunity to cure will be provided before termination or other enforcement where required by law. HOA FINES & CHARGES Tenant is responsible, to the extent permitted by law, for condominium fines, charges, repair expenses, or other assessments imposed against the unit as a direct result of violations caused by: * Tenant * Authorized occupants * Guests * Approved pets Landlord will provide reasonable documentation of any such charge upon request. EARLY TERMINATION BY TENANT The Lease is for a fixed term of 12 months. Except where Tenant has a statutory or other legal right to terminate the Lease, Tenant may not terminate the Lease early without Landlord's written agreement. If Tenant vacates or otherwise terminates occupancy before expiration of the Lease without a legally permitted basis for termination, Tenant remains responsible, to the extent permitted by Virginia law, for: * Rent and other amounts due under the Lease until the earlier of: * Expiration of the Lease term; or * Commencement of a replacement tenancy * Actual damages resulting from the breach * Reasonable and documented costs incurred as a direct result of the early termination * Damage to the Property beyond reasonable wear and tear * Damage to Landlord-provided furnishings beyond reasonable wear and tear * Other amounts recoverable under the Lease and applicable law Landlord will make reasonable efforts to mitigate damages by attempting to re-rent the Property as required by Virginia law. Except where a different notice period or termination right is provided by applicable law, Tenant must provide Landlord with at least 60 days' written notice of any requested early termination or intended early move-out. Providing notice does not, by itself, release Tenant from financial obligations under the Lease. Landlord may, at Landlord's discretion, offer Tenant a separate written early-termination or lease-buyout agreement. Any lease-buyout agreement must be in writing and signed by both Landlord and Tenant. LEGALLY PROTECTED EARLY TERMINATION Nothing in the Lease limits rights provided by federal or Virginia law allowing a Tenant to terminate a tenancy under qualifying circumstances, including applicable protections involving: * Qualifying military orders * Family abuse * Sexual assault * Stalking * Other circumstances protected by applicable law Applicable statutory notice and documentation requirements govern any such termination. UNAUTHORIZED HOLDOVER Tenant must vacate and surrender possession of the Property no later than the expiration or lawful termination date of the Lease unless Landlord expressly authorizes continued occupancy in writing. If Tenant remains in possession without Landlord's consent after expiration or lawful termination, Landlord may pursue possession and other remedies available under Virginia law. To the extent permitted by Virginia law and following any notice required by law, Tenant may be responsible for a reasonable liquidated holdover charge of up to 150% of the applicable per-diem monthly rent for each day of unauthorized occupancy, together with actual damages, court costs, and reasonable attorney fees recoverable under the Lease and applicable law. Assessment or payment of a holdover charge does not constitute Landlord's consent to continued occupancy or create a new tenancy unless Landlord expressly agrees otherwise in writing. NOTICES & COMMUNICATION Notices required by the Lease must be provided in writing and delivered in a manner permitted by Virginia law and the Lease. Landlord and Tenant will identify their applicable mailing addresses, email addresses, and other authorized contact information in the Lease. Each party is responsible for promptly notifying the other of changes to designated contact information. Routine communications by text message or email do not waive any formal notice requirement imposed by the Lease or applicable law unless expressly permitted. GOVERNING LAW The Lease and tenancy are governed by applicable federal law, the laws of the Commonwealth of Virginia, applicable Arlington County requirements, and applicable condominium governing documents. If any Lease provision conflicts with a non-waivable requirement of applicable law, the applicable law controls. The invalidity or unenforceability of one provision does not invalidate the remainder of the Lease to the extent permitted by law.
