California Residential Lease Agreement (One-Year Fixed Term) This Residential Lease Agreement ("Agreement") is entered into on ________, 20 , by and between: Landlord: _______________________________________ and Tenant(s): _______________________________________ The Landlord hereby rents to the Tenant, and the Tenant hereby leases from the Landlord, the residential property located at: Property Address: _______________________________________________ Term The tenancy shall begin on ________________, 20 , and shall continue for a fixed term of one (1) year, ending on ________________, 20 ("Lease Term"), unless earlier terminated in accordance with this Agreement or applicable California law. If rent is not received within 5 days after it becomes due, the Tenant agrees to pay a late fee of $50.00. Any remaining balance shall be returned to the Tenant within the time required by California law after the Tenant vacates the Premises. Occupants The Premises shall be occupied only by the following individuals: No additional occupants may reside at the Premises without the Landlord's prior written consent. Use of Premises The Premises shall be used solely as a private residence. The Tenant shall not conduct illegal activities or use the property in any manner that violates applicable laws or materially interferes with neighboring residents. Utilities Tenant shall pay for: Electricity and Gas Landlord shall pay for: Water /Sewer, Trash Maintenance and Repairs The Tenant agrees to keep the Premises clean, sanitary, and in good condition, promptly notify the Landlord of any needed repairs, properly dispose of trash, and refrain from intentionally or negligently damaging the Premises. The Landlord agrees to maintain the Premises in a habitable condition as required by California law. Alterations The Tenant shall not paint, remodel, install fixtures, or make alterations to the Premises without the Landlord's prior written consent. Pets Not Permitted Permitted If permitted, approved pets are: The Tenant shall be responsible for any damage caused by approved pets. Landlord's Right of Entry The Landlord may enter the Premises only as permitted by California law, including for repairs, inspections, showings, emergencies, or other lawful purposes, with the notice required by law unless an exception applies. Assignment and Subletting The Tenant shall not assign this Agreement or sublet the Premises without the Landlord's prior written consent. Rules and Regulations The Tenant agrees to comply with all reasonable written rules and regulations established by the Landlord concerning the use and occupancy of the Premises, provided such rules are applied fairly and consistently. Notices Any notice required under this Agreement shall be delivered personally, by mail, or by any other method permitted under California law. Landlord's Notice Address: Tenant's Notice Address: Expiration or Early Termination This Agreement shall expire automatically at the end of the Lease Term unless renewed or extended in writing by the parties. Any early termination of this Agreement shall be governed by this Agreement and applicable California law. If the property is subject to any applicable state or local rent control or just-cause eviction requirements, any termination or non-renewal shall comply with those laws. Attorney's Fees In any legal action arising out of this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs to the extent permitted by law. Governing Law This Agreement shall be governed by the laws of the State of California. Entire Agreement This Agreement constitutes the entire agreement between the parties and supersedes all prior oral or written agreements concerning the Premises. Any modification to this Agreement must be in writing and signed by both the Landlord and the Tenant.
