1. Utility Responsibilities Tenant shall be solely responsible for the payment of all utilities servicing the premises, including but not limited to electricity, gas, water, sewer, trash collection, and internet/cable services. Tenant shall establish accounts directly with utility providers prior to or upon commencement of the lease term. Failure to maintain active utility accounts may constitute a breach of this Agreement. (Michigan landlord-tenant law permits full utility transfer to tenants when clearly stated in the lease MCL 554.139 requires landlords to maintain premises in reasonable repair, but utility responsibility may be contractually assigned.) 2. Snow Removal & Lawn Maintenance Tenant shall be responsible for snow and ice removal from all walkways, driveways, steps, and entry areas serving the premises within 24 hours of snowfall accumulation, in compliance with any applicable local municipal ordinances. Tenant shall further be responsible for regular lawn mowing, edging, and general grounds upkeep throughout the lease term to maintain the property in a neat and orderly condition. (Under MCL 554.139, the premises must remain fit for use; assigning exterior maintenance to tenants is enforceable when explicitly stated in the lease.) 3. Rent Payment & Late Payment Rent in the amount of $1200 is due and payable on or before the 1st day of each calendar month. A grace period is provided through the 5th day of the month, after which rent shall be considered late. A late fee not to exceed $50 or 5% of the monthly rent (whichever is greater) may be assessed for any payment received after the 5th. (Michigan law does not mandate a grace period, but does require any late fees to be reasonable and clearly stated in the lease. Courts have scrutinized excessively punitive late fee structures.) 4. Non-Payment & Eviction Procedures In the event rent remains unpaid, Landlord shall provide Tenant with a written 7-Day Notice to Quit pursuant to MCL 600.5714, demanding payment of all overdue rent. If Tenant fails to pay all amounts owed within the 7-day notice period, Landlord may initiate eviction (Summary Proceedings) in the appropriate District Court.
